Application No.: 11/133,373
`Examiner: E. F. Landrum
`Art Unit: 3724
`
`REMARKS
`
`Reconsideration of the pending application is respectfully requested on the basis of
`
`the following particulars:
`
`In the claims
`
`Claim 1 is amended to further recite a restriction unit for restricting pivoting of the
`
`head portion is provided in the main body. Support is found at least at page 17 of the
`
`is amended to remove the feature wherein a
`original specification. Further, claim 1
`direction of a pivoting axis of the head portion is substantially perpendicular to the body
`
`surface when the head portion is placed in a cutting position proximate to the body
`
`surface.
`
`Also, new claims 7—10 are added. Support for the new claims is found at least at
`
`pages 17-20 of the specification.
`
`Rejection of claims 1 and 3-6 under 35 U.S.C. § 112, second paragraph
`
`Claims 1 and 3—6 presently stand rejected as being indefinite.
`
`In particular, the
`
`examiner asserts that it is not understood how the body surface can be used to define the
`
`relationship of the pivoting axis with the rest of the personal trimming system.
`
`By the present amendment, the feature of claim 1 relating to relationship of the
`pivoting axis and the body surface has been cancelled from claim 1.
`In View of the
`
`amendment, withdrawal of this rejection is requested.
`
`Rejection of claims 1-6
`
`Claims 1, 4, and 5 presently stand rejected as being anticipated by Siegler (US.
`
`5,261,162), and claim 3 is rejected as being unpatentable over Siegler. Further, claim 6 is
`
`rejected as being unpatentable over Siegler in View of Lonnecker (US. 4,651,420). These
`
`rejections are respectfully traversed for at least the following reasons.
`
`

`

`Application No.2 11/133,373
`Examiner: E. F. Landrum
`Art Unit: 3724
`
`The present invention as defined in the amended claim 1 is directed to a personal
`
`trimming system for trimming hair from a body surface including an elongated main body
`
`having a motor and a part of a driving unit for converting a rotation of the motor into a
`
`reciprocating motion, the elongated main body having a lengthwise dimension that defines
`
`a length direction of the trimming system; and an elongated head portion extending from
`
`an end of said main body generally along said length direction, the head portion having a
`
`driven member reciprocating generally along said length direction, wherein the head
`
`portion is pivotably supported with respect to the main body, and a gap is provided
`
`between the main body and a step formed on a boundary between an upper portion of the
`
`head portion and a lower portion of the head portion. Further, a restriction unit for
`
`restricting pivoting of the head portion is provided in the main body.
`
`It is respectfully submitted that neither Siegler nor Lonnecker disclose or suggest a
`
`restriction unit for restricting pivoting of the head portion provided in the main body.
`
`Accordingly, these references, both individually and in any combination, fail to disclose or
`suggest each and every element set forth in claim 1, and therefore claim 1 and claims 2-10
`which depend from claim 1 are allowable over the cited references. Applicant respectfully
`
`requests withdrawal of the rejection.
`
`New claims 7-10
`
`New claims 7-10 are added. Claims 7—10 recite material which is novel and non-
`
`obvious in view of the prior art of record, and it is therefore respectfully submitted that
`
`claims 7—10 are fully patentable over all the references of record.
`
`Conclusion
`
`In view of the amendments to the claims, and in further View of the foregoing
`
`remarks,
`
`it is respectfully submitted that the application is in condition for allowance.
`
`Accordingly, it is requested that claims 1 and 3-10 be allowed and the application be
`
`passed to issue.
