`EXPLANATION OF WHY CONTESTED CHARGE IS IN ERROR
`
`On July 11, 2013 a Certification and Request for Consideration of an Information
`Disclosure Statement Filed After Payment of the Issue Fee Under the QPIDS Pilot
`Program was filed in the subject application, which included a “Conditional” RCE and
`an Information Disclosure Statement. The RCE fee ($1,200) and the Petitions fee
`($140) were paid using a credit card on the same date.
`
`On September 19, 2013, the Examiner considered the references that were filed on
`July 11, 2013, and he issued a Supplemental Notice of Allowability. On December 17,
`2013, the allowed application issued as U.S. Patent No. 8,608,318.
`
`Since the Examiner considered the references and felt that the reopening of
`prosecution was not necessary, the RCE should not have been processed and the RCE
`

`fee should have been returned. According to our records, the $1,200 RCE fee has not
