`structure, material, or acts in support thereof, and such claim shall be construed to cover the
`corresponding structure, material, or acts described in the specification and equivalents
`thereof.

`The following is a quotation of pre-AIA 35 U.S.C. 112, sixth paragraph:

`Absence of the word “means” (or “step for”) in a claim creates a rebuttable

`presumption that the claim element is not to be treated in accordance with 35 U.S.C.

`112(f) (pre-AIA 35 U.S.C. 112, sixth paragraph). The presumption that 35 U.S.C. 112(f)
`
`(pre-AIA 35 U.S.C. 112, sixth paragraph) is not invoked is rebutted when the claim
`
`element recites function but fails to recite sufficiently definite structure, material or acts
`
`to perform that function.

`Claim elements in this application that use the word “means” (or “step for”) are
`
`presumed to invoke 35 U.S.C. 112(f) except as otherwise indicated in an Office action.

`section..” have been interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth

`paragraph, because it uses/they use the generic placeholders “unit”, or “section”
`
`coupled with functional language without reciting sufficient structure to achieve the
`
`function. Furthermore, the generic placeholder is not preceded by a structural modifier.
`
`Since the claim limitation(s) invokes 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112,
`
`sixth paragraph, claims 1-16 have been interpreted to cover the corresponding structure
`
`described in the specification that achieves the claimed function, and equivalents
`
`thereof.

`A review of the specification shows that the following appears to be the

`corresponding structure described in the specification for the 35 U.S.C. 112(f) or pre-
`
`AIA 35 U.S.C. 112, sixth paragraph limitation: voltage detection circuit 24 shown in Fig.
`
`5 corresponds to the detection unit; an integrated circuit corresponds to the first control
`
`section as disclosed in paragraph 34; an LCD correspond to the display section as
`
`disclosed in paragraph 57; and a receiver and a transmitter as are well known in the art
`
`correspond to the first and second communicating sections.
`
`lf applicant wishes to provide further explanation or dispute the examiner’s
`
`interpretation of the corresponding structure, applicant must identify the corresponding
`
`structure with reference to the specification by page and line number, and to the
`
`drawing, if any, by reference characters in response to this Office action.
`
`If applicant does not intend to have the claim limitation(s) treated under 35
`
`U.S.C. 112(f) or pre-AIA 35 U.S.C. 112 , sixth paragraph, applicant may amend the

`Claim 15 recites the limitation "the second radio communicating section" in lines

`13 and 14. There is insufficient antecedent basis for this limitation in the claim.

`Claim Rejections - 35 USC § 103
`

`The following is a quotation of pre-AIA 35 U.S.C. 103(a) which forms the basis
`
`for all obviousness rejections set forth in this Office action:
`
`(a) A patent may not be obtained though the invention is not identically disclosed or described
`as set forth in section 102 of this title, if the differences between the subject matter sought to
`be patented and the prior art are such that the subject matter as a whole would have been
`obvious at the time the invention was made to a person having ordinary skill in the art to which
`said subject matter pertains. Patentability shall not be negatived by the manner in which the
`invention was made.

`The factual inquiries set forth in Graham v. John Deere Co., 383 U.S. 1, 148

`USPQ 459 (1966), that are applied for establishing a background for determining

`2. Ascertaining the differences between the prior art and the claims at issue.

`This application currently names joint inventors. In considering patentability of the
`
`claims under pre-AIA 35 U.S.C. 103(a), the examiner presumes that the subject matter
`
`of the various claims was commonly owned at the time any inventions covered therein
`
`were made absent any evidence to the contrary. Applicant is advised of the obligation
`
`under 37 CFR 1.56 to point out the inventor and invention dates of each claim that was
`
`not commonly owned at the time a later invention was made in order for the examiner to
`
`consider the applicability of pre-AIA 35 U.S.C. 103(c) and potential pre-AIA 35 U.S.C.
`
`102(e), (f) or (g) prior art under pre-AIA 35 U.S.C. 103(a).
`

`Claims 1, 2, 4, 5, 7, 9, 11, and 13 are rejected under pre-AIA 35 U.S.C. 103(a) as
`
`being unpatentable over Yin in view of Buel et al (Pub. No.: US 2003/0092381,
`
`hereinafter Buel), further in view of Mueller (Pub. No.: US 2009/0082055 A1), and
`
`further in view of Ramaswamy et al (Pat. No.: US 6,668,178 B1, hereinafter
`
`Ramaswamy)
`
`Consider claim 1 Yin discloses a cordless telephone set which performs radio
`
`communication between a handset and a base unit which is provided with an external
`
`power supply (cordless telephone system 100, Fig. 1), wherein the base unit (200)
`
`includes: a detection unit which detects the external power supply (Line status control
`
`230 compares the voltage level of base power supply 240 to a pre-defined threshold
`
`operating level, paragraph 24),
`

`a first radio communicating section which performs modulation and demodulation
`
`with the external power supply (external line-powered base unit 200 is capable of
`
`cordless communications with any of portable units 110, 120, 130, and 140, see
`
`paragraphs 21 and 22);
`
`wherein the handset (110) includes: a battery which provides a power supply to
`
`the base unit in accordance with the external power supply detected by the detection
`
`unit (In the event of a power failure at power line 260, the voltage level conveyed by
`
`base power supply 240 to line status control circuit 230 drops below the pre-defined
`
`threshold level, and in response Regulator 250 then begins drawing power from
`
`portable unit battery 115 through contacts 202, 204 and power control switch 220, see
`
`Fig. 2 and paragraphs 25-27),
`
`a second radio communicating section which performs modulation and
`
`demodulation with a voltage output from the battery (base unit 200 remains operational
`
`during the failure of power line 260 by drawing power from the battery of a portable unit
`
`disposed within the base cradle., see paragraphs 26 and 27).
`
`While Yin discloses a display in both the base unit 200 and in the portable units
`
`110, 120, 130, and 140 as show in Fig. 1, Yin does not expressly disclose a display
`
`section which displays information regarding at least one of the power supply and the
`
`external power supply;
`
`or a first control section which controls transmission power of the first radio
`
`communicating section; or
`
`

`wherein the first radio communicating section transmits predetermined
`
`information to the handset on the basis of the external power supply detected by the
`
`detection unit, and the display section performs a display for encouraging a user to
`
`place the handset on the base unit when the display section has received the

`predetermined information by the second radio communicating section.
`
`In the same field of endeavor Buel discloses a display section which displays
`
`information regarding at least one of the power supply and the external power supply
`
`(The display panel may display, for example, the power status such as back-up battery
`
`capacity, state of the internal battery charger, and the monitoring of an external
`
`connection to AC or DC power, see FIG. 2A and paragraph 27).
`
`Therefore it would have been obvious to a person of ordinary skill in the art at the
`
`time the invention was made, to combine the teachings of Buel with the teachings of Yin
`
`to provide the user with information about the status of a communications device.
`
`Nonetheless, the combination of Yin and Buel does not expressly disclose
`
`a first control section which controls transmission power of the first radio communicating
`
`section; or
`
`wherein the first radio communicating section transmits predetermined
`
`information to the handset on the basis of the external power supply detected by the
`
`detection unit, and the display section performs a display for encouraging a user to
`
`place the handset on the base unit when the display section has received the
`
`predetermined information by the second radio communicating section.

`In the same field of endeavor Mueller discloses a first control section which
`
`controls transmission power of the first radio communicating section (The transmission
`
`power can also be set or regulated, in addition, as a function of the distance of the most
`
`remote mobile station, see paragraph 14).
`
`Therefore it would have been obvious to a person of ordinary skill in the art at the
`
`time the invention was made, to combine the teachings of Mueller with the teachings of
`
`Yin and Buel to apply the lowest possible transmission power.
`
`However the combination of Yin, Buel, and Mueller does not expressly disclose
`
`wherein the first radio communicating section transmits predetermined information to
`
`the handset on the basis of the external power supply detected by the detection unit,
`
`and the display section performs a display for encouraging a user to place the handset
`
`on the base unit when the display section has received the predetermined information
`
`by the second radio communicating section.
`
`In the same field of endeavor Ramaswamy disclose wherein the first radio
`
`communicating section transmits predetermined information to the handset on the basis
`
`of the external power supply detected by the detection unit (as soon as base unit 110
`
`detects that AC power is lost a signal is sent to all handsets to notify them that the base
`
`unit has experienced AC power failure and is in backup mode, see col. 3, II. 29-36).
`
`While Ramaswamy does not explicitly disclose that the notification is presented
`
`on a display for encouraging a user to place the handset on the base unit, a user of a
`
`portable telephone is typically alerted either by an audio and/or a visual and/or vibrating
`
`indication, one of ordinary skill in the art would have found obvious to use the display
`
`

`provided in the portable units 110, 120, 130, 140 disclosed by Yin, as modified by Buel
`
`and Mueller, to notify a user that the base unit has experienced AC power failure and is
`
`in backup mode as disclosed by Ramaswamy since further continued operation is
`
`available by replacing portable units within the base cradle 202.
`
`Consider claim 2, and as applied to claim 1 above, Mueller discloses wherein
`
`the first radio communicating section receives, from the handset, radio wave information
`
`which indicates a received signal strength of a radio signal which is received by the
`
`second radio communicating section from the first radio communicating section, and the
`
`first control section reduces the transmission power of the first radio communicating
`
`section in response to the received signal strength indicated by the radio wave
`
`information on the basis of the external power detected by the detection unit (The
`
`transmission power can also be set or regulated, in addition, as a function of the
`
`distance of the most remote mobile station. For this purpose, a field intensity
`
`measurement device that determines the reception field intensity received from a mobile
`
`station can be provided, which device measures the field intensity of the signal and
`
`makes the value available to the microprocessor for evaluation. The microprocessor
`
`establishes the setting value for the transmission stage in the fixed station and/or in the
`
`mobile station, see paragraph 14).
`
`Therefore it would have been obvious to a person of ordinary skill in the art at the
`
`time the invention was made, to combine the teachings of Mueller with the teachings of
`
`Yin, Buel, and Ramaswamy to apply the lowest possible transmission power.
`

`Consider claim 4, and as applied to claim 1 Yin discloses wherein the handset
`
`further includes a second control section which starts up a hand-free call function if the
`
`handset is placed on the base unit (telephone calls can be conducted using any of
`
`portable units 120, 130, or 140, or a speakerphone (e.g., speakerphone 208 in FIG. 1),
`
`see paragraph 27).
`
`Consider claim 5, and as applied to claim2 above, Buel discloses a display
`
`section which displays information regarding at least one of the power supply and the
`
`external power supply (The display panel may display, for example, the power status
`
`such as back-up battery capacity, state of the internal battery charger, and the
`
`monitoring of an external connection to AC or DC power, see FIG. 2A and paragraph
`
`27).
`
`However the combination of Yin, Buel, and Mueller does not expressly disclose
`
`wherein the first radio communicating section transmits predetermined data to the
`
`handset when the detection unit has detected that a voltage from the external power
`
`supply does not exceed a predetermined value.
`
`In the same field of endeavor Ramaswamy discloses wherein the first radio
`
`communicating section transmits predetermined data to the handset when the detection
`
`unit has detected that a voltage from the external power supply does not exceed a
`
`predetermined value (as soon base unit 110 detects that AC power is lost and begins to
`
`draw on DC power from battery 119, a signal is sent to all handsets to notify them that
`
`

`the base unit has experienced AC power failure and is in backup mode, see col. 3:29-
`
`36).
`
`Therefore it would have been obvious to a person of ordinary skill in the art at the
`
`time the invention was made, to combine the teachings of Ramaswamy with the
`
`teachings of Yin, Buel, and Mueller to alert any user to investigate AC power failure and
`
`to alert users that communication may be lost if the backup power is drained before AC
`
`power is restored.
`
`Consider claim 7, and as applied to claim 2 above, Yin discloses wherein the
`
`cordless telephone set includes a plurality of handsets (one or more portable units 110,
`
`120, 130, and 140), and when any one of the plurality of handsets is placed on the base
`
`unit, the first radio communicating section communicates with a different handset which
`
`is not placed on the base unit with a predetermined voltage output from the battery
`
`(base unit 200 remains operational during the failure of power line 260 by drawing
`
`power from the battery of a portable unit disposed within the base cradle [i.e. portable
`
`unit 110]. Thus, telephone calls can be conducted using any of portable units 120, 130,
`
`or 140, or a speakerphone (e.g., speakerphone 208 in FIG. 1.) When battery 115 within
`
`portable unit 110 becomes depleted, portable unit 110 can be replaced by placing
`
`portable unit 120 within the base unit cradle, such that further continued operation is
`
`available, see paragraph 27).

`Consider claim 9, and as applied to claim 2 above, Yin discloses a switch circuit
`
`which cuts off power supply to the first radio communicating section from the secondary
`
`battery of the handset placed on the base unit when the detection unit has detected that
`
`a voltage from the external power supply exceeds a predetermined value and allows
`
`power supply to the first radio communicating section from the secondary battery of the
`
`handset placed on the base unit when the detection unit has detected that the voltage
`
`from the external power supply does not exceed the predetermined value (POTS mode
`
`power control switch 220 responds to the logic low state of control line 232 by switching
`
`into a closed state, such that charge contacts 202, 204 are connected through power
`
`control switch 220 to voltage regulators 250 via regulator circuit input 252. Regulator
`
`250 then begins drawing power from portable unit battery 115 through contacts 202,
`
`204 and power control switch 220, see paragraph 26).
`
`Consider claim 11, and as applied to claim 1, Buel discloses wherein the display
`
`section displays information indicating that the external power is unavailable (The
`
`display panel may display, for example, the power status such as back-up battery
`
`capacity, state of the internal battery charger, and the monitoring of an external
`
`connection to AC or DC power, see FIG. 2A and paragraph 27).
`
`Therefore it would have been obvious to a person of ordinary skill in the art at the
`
`time the invention was made, to combine the teachings of Buel with the teachings of
`
`Yin, Mueller, and Ramaswamy to provide the user with information about the status of a
`
`communications device.

`Consider claim 13, and as applied to claim 1, Buel discloses wherein the display
`
`section displays information that the external power supply is available if the detection
`
`unit detects that a voltage from the external power supply exceeds a predetermined
`
`value. (The display panel may display, for example, the power status such as back-up
`
`battery capacity, state of the internal battery charger, and the monitoring of an external
`
`connection to AC or DC power, see FIG. 2A and paragraph 27).
`
`Therefore it would have been obvious to a person of ordinary skill in the art at the
`
`time the invention was made, to combine the teachings of Buel with the teachings of
`
`Yin, Mueller, and Ramaswamy to provide the user with information about the status of a
`
`communications device.

`Claim 3 is rejected under pre-AIA 35 U.S.C. 103(a) as being unpatentable over
`
`Yin in view of Buel, further in view of Mueller, further in view of Ramaswamy, and further
`

`Therefore it would have been obvious to a person of ordinary skill in the art at the

`time the invention was made, to combine the teachings of Kurchuk with the teachings of

`Yin, Buel, Mueller, and Ramaswamy to allow establishment of simultaneous links

`between a base and near and far handsets, with minimal degradation of SNR and BER.

`regarding at least one of the power supply and the external power supply (The display

`panel may display, for example, the power status such as back-up battery capacity,

`state of the internal battery charger, and the monitoring of an external connection to AC
`
`or DC power, see FIG. 2A and paragraph 27 in Buel). Yin discloses that the base unit
`
`remains operational during the failure of the power line by drawing power from the
`
`battery of the handset in the base cradle (see paragraph 27). Ramaswamy discloses a
`
`locking mechanism to prevent removal of the backup battery (col. 3, II. 37-51). Given

`prevent the removal of the handset. Consider Yamaguchi, which discloses showing a

`Therefore it would have been obvious to a person of ordinary skill in the art at the
`
`time the invention was made to show a message alerting the user as disclosed in
`
`Yamaguchi in the cordless telephone set of Yin as modified by Buel, and further
`
`modified by Mueller in order to the cordless telephone set from becoming inoperative.

`Claims 14-16 are rejected under pre-AIA 35 U.S.C. 103(a) as being unpatentable
`
`over Yin in view of Buel, and further in view of Ramaswamy.

`Consider claim 14, Yin discloses a power supplying method which is performed
`
`between a handset (110) and a base unit (200) which is provided with an external
`
`power supply, the method comprising: detecting the external power supply (Line status
`
`control 230 compares the voltage level of base power supply 240 to a pre-defined
`
`threshold operating level, paragraph 24); providing a power supply from the handset to
`
`the base unit in accordance with the external power supply (In the event of a power
`
`failure at power line 260, the voltage level conveyed by base power supply 240 to line
`
`status control circuit 230 drops below the pre-defined threshold level, and in response
`
`Regulator 250 then begins drawing power from portable unit battery 115 through
`
`contacts 202, 204 and power control switch 220, see Fig. 2 and paragraphs 25-27;.

`
`be supplied to the base unit.

`
`least one of the power supply and the external power supply (The display panel may
`
`display, for example, the power status such as back-up battery capacity, state of the
`
`internal battery charger, and the monitoring of an external connection to AC or DC
`
`power, see FIG. 2A and paragraph 27).
`
`Therefore it would have been obvious to a person of ordinary skill in the art at the
`
`time the invention was made, to combine the teachings of Buel with the teachings of Yin
`
`to provide the user with information about the status of a communications device.
`
`However the combination of Yin and Buel does not expressly disclose

`transmitting predetermined information from the base unit to the handset on the basis of

`
