`
`In Respond to Final Office Action mailed 12/17/2015
`
`REMARKS
`
`Reconsideration is requested in view of the above amendments and the following
`
`remarks. Claim 1 has been revised. Support for the revisions in claim 1 can be found in,
`
`e.g., paragraphs [0050]-[0051], [0060]-[0061], [0085]—[0091], [0093]—[0095] and [0099]-
`
`[0102] of the specification and Figs. 6, 8—11 and 14—17. Claims 3 and 8 have been
`
`revised editorially. New dependent claim 14 has been added. Support for claim 14 can
`
`be found at, e. g., paragraph [0079] of the specification and Fig. 11. Claims 1—14 are
`
`pending in the application. Claims 5-13 remain withdrawn.
`
`Claim Rejections — 35 USC § 102
`
`Claims 1-4 are rejected under 35 USC § 102(b) as being anticipated by JP 2004
`
`130063 (Lifescan). Applicant respectfully traverses this rejection.
`
`Claim 1 requires a body case having a feeding opening configured such that a
`
`biological information measurer can be attached thereto externally. The feeding section
`
`is configured to load one of the plurality of biological information detection sensors fed
`
`to the feeding opening into the biological information measurer, when the biological
`
`information measurer is attached to the feeding opening externally. The feeding section
`
`is configured to release and transfer the loaded biological information detection sensor to
`
`the biological information measurer, when the attached biological information measurer
`
`is pulled out from the feeding section. This feature allows easy loading of biological
`
`information detection sensors onto a biological information measurer, and as a result,
`
`simplifies the biological information measurement process (see page 4, lines 8—11 of the
`
`specification).
`
`Lifescan fails to disclose a body case having a feeding opening configured such
`
`that a biological information measurer can be attached thereto externally, as required by
`
`claim 1. Nor does Lifescan disclose that the feeding section is configured to load one of
`
`the plurality of biological information detection sensors fed to the feeding opening into
`
`the biological information measurer, when the biological information measurer is
`
`attached to the feeding opening externally, as required by claim 1. Nor does Lifescan
`
`disclose that the feeding section is configured to release and transfer the loaded biological
`
`information detection sensor to the biological information measurer, when the attached

`
`biological information measurer is pulled out from the feeding section, as required by
`
`claim 1.
`
`Instead, Lifescan merely discusses a cassette including a plurality of sensors (see
`
`Lifescan, Abstract and Figs. 1-12). Lifescan is completely silent as to a body case having
`
`a feeding opening configured such that a biological information measurer can be attached
`
`thereto externally, as required by claim 1, much less any mechanism to release and
`
`transfer a loaded biological information detection sensor to the biological information
`
`measurer, as required by claim 1.
`
`For at least these reasons, claim 1 is patentable over JP 2004 130063. Claims 2—4
`
`depend from claim 1 and are patentable along with claim 1 and need not be separately
`
`distinguished at this time. Applicant does not concede the correctness of the rejection.
`
`In View of the above, favorable reconsideration in the form of a notice of
`
`allowance is respectfully requested. Any questions regarding this communication can be
`
`directed to the undersigned attorney, Douglas P Mueller, Registration No. 30,300, at
`
`(612) 455—3804.
