`Claims 1-12 are presently pending, with all pending claims rejected. Applicant
`herein amends claims 1-3, 5-9, 11, and 12, and adds claims 13-16. No new matter has
`been added. Reconsideration is respectfully requested in view of the above amendments

`Claim Rejections Under 35 U.S.C. § 112

`Page 2 of the Office Action sets forth “Claims 1-12 are rejected under 35 U.S.C,
`112(b) or 35 U.S.C. 112 (pre-AIA), second paragraph, as being indefinite....”.
`In particular,
`the Office Action asserts that the term “the respective first points” lacks antecedent basis.
`Applicant herein amends the claims to remove this term. Accordingly, Applicant respectfully
`submits that this rejection is obviated.

`Claim Rejections Under 35 U.S.C.§102

`Page 3 of the Office Action sets forth “Claims 1-4 and 7-10 are rejected under pre-
`AIA 35 U.S.C. 102(b) as being anticipated by Sakai et al. (PGPub# US 2010/0219064 A1).”
`Applicant respectfully submits that these claims are patentable over the applied reference
`for the reasons set forth below.

`Preliminarily, Applicant notes that claims 5, 6, 11, and 12 have not been rejected
`based on prior art. Applicant herein amends these claims to be in independent form,
`including the above amendments for overcoming the rejection based on § 112. Accordingly,
`Applicant respectfully submits that claims 5, 6, 11, and 12 are in condition for allowance.

`The evaporation source holds a deposition material. An angle correcting memberis
`provided so as to cover an upper space of the principal surface of the base member. The
`angle correcting member is positioned in order to create a space in which an evaporation
`particle from the evaporation source does not exist, and in order to confine the deposition
`material
`to have a constant
`incident angle with respect to the base member.
`In this
`manner, the claimed deposition apparatus regulates the incident angle of the deposition
`material with respect to the base member, so that a deposition having a defined directivity
`can be realized by depositing only deposition material having the constant incident angle on
`the base member. These feature are found in the specification, for example, at 4] 92 and
`
`112, and FIG. 1. No new matter is added.
`
`Applicant respectfully submits that the applied reference fails to disclose, teach, or
`suggest at least the above features of claim 1.

`discloses an apparatus having a target 101 and a substrate 106. The substrate is tilted
`relative to the target by an angle of 6, which is from 60° to 90°. The apparatus includes a

`qq 43 and 46.

`The Office Action asserts that mesh 111 of Sakai corresponds to the angle correcting

`member of claim 1. See page 3. Applicant respectfully disagrees.
`
`Mesh 111 provides a path for particles from target 110 to travel to substrate 106.
`See FIGS. 6 and 7. Accordingly, mesh 111 does not create a space in which evaporation
`particles do not exist.
`To the contrary, mesh 111 creates a path to be traversed by
`evaporation particles from target 110. Thus, Sakaiis different from claim 1, which requires
`the angle correcting member to be positioned in order to create a space in which an
`evaporation particle does notexist.
`
`Additionally, mesh 111 does not regulate the incident angle of particles from target
`101. To the contrary, target 101 includes a cover 108 for controlling the directivity of
`particles from target 101 to substrate 106. Accordingly, there is no need for a structure
`

`Applicant herein adds new claims 13-16. Claims 13-16 include all of the features of
`claim 1, from which they depend. Thus, Applicant submits that claims 13-16 are allowable
`over the applied reference for at least the reasons set forth above with respect to claim 1.

`applied reference for at least these additional reasons.
