`Claim Rejections - 35 USC § 103
`
`10.
`
`The rejection under 35 U.S.C. 103 as being unpatentable over Kim et al. (US
`
`Publication 2013/0143109) or Byun in view of Aoshima et al. (US Publication
`
`2003/0031923) are maintained. The rejection is repeated below for convenience.
`
`11.
`
`In the event the determination of the status of the application as subject to AIA 35
`
`U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any
`
`correction of the statutory basis for the rejection will not be considered a new ground of
`
`rejection if the prior art relied upon, and the rationale supporting the rejection, would be
`
`the same under either status.

`
`The following is a quotation of 35 U.S.C. 103 which forms the basis for all
`
`obviousness rejections set forth in this Office action:
`
`A patent for a claimed invention may not be obtained, notwithstanding that the claimed
`invention is not identically disclosed as set forth in section 102, if the differences between the
`claimed invention and the prior art are such that the claimed invention as a whole would have
`been obvious before the effective filing date of the claimed invention to a person having
`ordinary skill in the art to which the claimed invention pertains. Patentability shall not be
`negated by the manner in which the invention was made.
`
`13.
`
`Claim 4 is/are rejected under 35 U.S.C. 103 as being unpatentable over Kim et
`
`al. (US Publication 2013/0143109) or Byun et al. in view of Aoshima et al. (US
`
`Publication 2003/0031923).
`
`Regarding claim 4, the Byun ei: al. er the Kim et at. reference is silent in
`
`disciesing the number of the single plate cells in each bieek to be 29 or more and the
`
`eesitive electrerle lead and the negative electrode leads each have a thickness et‘ 20
`
`micrens er less. Hewever, the Aeshirne et at. reierence discleses that cehvehtion
`
`thickness el the leads are about 320 micrens The Acsnime et at. reference dieeese
`
`From the viewpoint of the volume energy density and the weight energy density, the
`
`thinner the thickness of the positive electrode current collector, the better. Therefore, it
`
`would have been obvious to one of ordinary skill in the art to make the electrode leads
`
`to have a conventional thickness of 3-20 microns disclosed by the Aoshima et al.
`
`reference for the lead thicknesses of the Byun et al. or the Kim eta 1. reference to
`
`improve volume energy density and the weight energy density.
`
`Furthermere, the Byun ei: al. er the Kim et at. reference is silent in disclosing the
`
`plate cells in each block is 20 or more, however, it would be obvious to one of ordinary
`
`skill in the art before the effective filing date of the invention to incorporate more cells
`
`including 20 or more since the increase in cells would increase power density. A patent

`
`for a combination, which only unites old elements with no change in their respective
`
`functions, obviously withdraws what is already known into the field of its monopoly and
`
`diminishes the resources available to skillful men. Where the combination of old
`
`elements performed a useful function, but it added nothing to the nature and quality of
`
`the subject matter already patented, the patent failed under §103. When a patent
`
`simply arranges old elements with each performing the same function it had been
`
`known to perform and yields no more than one would expect from such an
`
`arrangement, the combination is obvious. KSR v. Teleflex

`
`Claim 7 is/are rejected under 35 U.S.C. 103 as being unpatentable over Kim et

`2011/0171516).
`

`
`above and further incorporated herein. The Kim reference discloses at least one of the
`
`positive electrode terminal and the negative electrode terminal includes a base part
`
`extends substantially perpendicular to the single plate cell stacking direction, but is
`
`silent in disclosing a first lead connection part that is formed substantially perpendicular
`
`to the base part and to which the leads of the first block are connected and a second
`
`lead connection part that is formed substantially perpendicular to the base part and to
`
`which the leads of the second block are connected and the lead connection parts

`
`Response to Arguments
`
`Applicant's arguments filed 7/11/19 have been fully considered but they are not
`
`persuasive. Applicant’s principal arguments are:
`
`The Applicants argues, “applicant note that Cho Fig. 2 (reproduced right
`
`discloses that the stacking order of the electrode plate leads with respect to the
`
`electrode terminal on the positive electrode side is the same as that on the negative
`
`electrode side.”
`
`

`

`Application/Control Number: 15/749,561
`Art Unit: 1725
`
`Page 12
`
`However, the Cho et al. reference discloses a stacking order of the lead plate in
`
`respect to the electrode terminal on the positive electrode said is opposite side of the
`
`battery as that of the negative electrode side. That is, the positive lead plate with
`
`respect to the terminal is stacked on one side of the battery and the negative lead plate
`
`with respect to the negative terminal is stacked on the opposite side of the battery.
`
`Therefore, broadly interpreting the claims, the Cho et al. reference reads on the claimed
`
`invention. Also, the in Paragraph 33 and the Applicants response, the arrows are
`
`pointed to the opposite side of the batteries and is also interpreted as such.
`
`The Applicants discloses, “Applicant resoeottolly notes that as seen in Figs. 5
`
`and T" (reproduced right} of him as weli as throughout the reierehee, there is no
`
`disclosure as to that a stacking order of the positive electrode leadwstaoked part with
`
`reseeet to the positive electrode tennihai is oeoosite to that of the negative eieetrode
`
`lead-stacked part with reseeot to the negative electrode terminal.
`
`As Kilh does not provide lor ali the aspects as new oiaimed, applicant resoeottuiiy
`
`submits that parent claim 1 as how presented, as weli as its respective deeendeht
`
`olaims are not entieieated by Kim.”
`
`However, the Kim reterenoe disclose in Paragraph 7’2 that the electrode lead
`
`tales ol tilt) and i 50 is sahdwiohed in between the eieotrode tabs lEG and 130 as
`
`shown in Fig. 8. As can he seen in Fig. $3, the eieotrode iead of left is sandwiched
`
`between i2t) and same see he said tor eieetrode iead ”it-3i) can he sendwiehed between
`
`l3€i on too and on the bottom, or tilt) on top is taught to he stashed in the opposite
`
`order of the 120 on the bottom of lead i 4G, therelore Kim et at. reierenoe reads on the
`
`claimed invention.

`
`The Applicants argue, “Byuh as wett as througheut the reference, there is he diesiosure
`
`as to thet e stackihg order of the positive etectrede teadeteoked part with respect te the
`
`peeitive etectrode termihat is eppoeite te that of the ‘ negative eteetrode teed—stacked
`
`part with reepeet to the negative eieetrede termihat.“
`
`Hewever, the Byura et at. reference diseteses the muitipie wounded cetts are
`
`stacked with positive eiectrode termthat with respect to the pesttive teed portion are or:
`
`the opposite side e‘t the battery then that of the hegative eteetrode terminat with respect
`
`te the negative teed eorttert.
`
`Conclusion
`
`15.
