Application No.: 16/343,922
`
`Docket No.: P190412US00
`
`REMARKS
`
`By this Amendment, claims 1-6 are pending. Claim 1 is amended herein to furtherrecite
`
`that “the maleimide compoundincludes at least any one ofN-methylmaleimide, N-ethylmaleimide,
`
`N-propylmaleimide, N-butylmaleimide, or N-vinylmaleimide,” by incorporating
`
`part of
`
`the
`
`previously pending aspect of claim 5. Claim 5 is amended to limit the maleimide compoundto
`
`“N-ethylmaleimide.” Further support is detailed below.
`
`Applicant’s Response to Claim Rejections under 345 U.S.C.§103
`
`Claims 1-6 are rejected under 35 U.S.C. § 103 as being unpatentable over PGPUB
`
`2019/0058221 to Burkhardtet al. and further in view of PGPUB 2017/0210855 to Wangetal.
`
`In response thereto, applicant respectfully submits that the claims as presented are not
`
`obvious over Burkhardt in view of Wang for at least the reason that the combination does not
`
`provide for all the aspects of the claims, nor is there any rationale prompting a skilled artisan to
`
`modify the combination so as to derive the current invention.
`
`Specifically, applicant respectfully submits that there is no manner wherebyaskilled
`
`artisan could derive at least the aspects of parent claim 1 as to wherein the maleimide compound
`
`includes at least any one of N-methylmaleimide, N-ethylmaleimide, N-propylmaleimide, N-
`
`butylmaleimide, or N-vinylmaleimide.
`
`Per page 2 bridging page 3 of the Office Action, the rejection as to claim 1 primarilyrelies
`
`upon Burkhardt. The rejection acknowledges that Burkhardt fails to teach a maleimide compound
`
`used in the electrolyte layer of a battery, and cites to Wang to supplement this missing aspect.
`
`Further, regarding claim 5, the rejection on page 4 of the Office Action states that “Wang teaches

`
`the maleimide compound exemplified to be N-phenylmaleimide [0011, 0030, 0048],” which
`
`allegedly reads on the maleimide compoundinstantly claimed.
`
`Applicant respectfully notes that now amended claim 1
`
`recites that
`
`the maleimide
`
`compound includes
`
`at
`
`least
`
`any
`
`one of N-methylmaleimide, N-ethylmaleimide, N-
`
`propylmaleimide, N-butylmaleimide, or N-vinylmaleimide—excluding N-phenylmaleimide from
`
`the list of possible maleimide compounds. Contrary, relied on Wang merely discloses N-
`
`phenylmaleimide, but does not provide for N-methylmaleimide, N-ethylmaleimide, N-
`
`propylmaleimide, N-butylmaleimide, or N-vinylmaleimide, as required by amended claim 1.
`
`Burkhardt does not cure the deficiency of Wang.
`
`Further, there would be no rational prompting a skilled artisan to modify the arguendo
`
`combination by replacing N-phenylmaleimide taught by Wang with another maleimide compound
`
`to reach the invention as now presented.
`
`Wherefore, applicant respectfully submits that parent claim 1, as well as its respective
`
`dependent claims are not obvious over Burkhardt in view of Wang, and,
`
`in light thereof,
`
`respectfully requests favorable reconsideration.
`
`In view of the foregoing amendments and accompanying remarks, it is submitted thatall
`
`pending claims are in condition for allowance. A prompt and favorable reconsideration of the
`
`rejection and an indication of allowability of all pending claimsare earnestly solicited.
