`
`AMENDMENTS TO THE CLAIMS
`
`This listing of claims replaces all prior versions of claims in the application.
`
`Listing of Claims:
`
`1. (Currently Amended) A secondary battery comprising:
`
`a positive electrode;
`
`a negative electrode; and
`
`an electrolyte, wherein
`
`the positive electrode includes:
`
`a positive electrode current collector;
`
`a positive electrode mixture layer including a positive electrode active material containing
`
`a lithium transition metal oxide; and
`
`a protective layer provided betweenthe positive electrode current collector and the positive
`
`electrode mixture layer,
`
`the protective layer includes inorganic compound particles, a conductive agent, and a
`
`binder, and has a recessed structure where the positive electrode mixture layer 1s recessed into the
`
`protective layer, and
`
`a content of the binder is 1 mass % or more and 10 mass % or less based on the total amount
`
`of the protective layer,
`
`wherein a standard deviation o of a thickness distribution of the protective layer is +/- 0.5
`
`uum or more, and
`
`wherein the positive electrode includes a region where the protective layer does not exist
`
`locally, and the positive electrode current collector and the positive electrode mixture layer are in
`
`direct contact with each other in the region.

`
`Docket No.: P190991US00
`
`2. (Original) The secondary battery according to claim 1, wherein a density of the positive
`
`electrode active material in the positive electrode mixture layer is 3.2 g/cm? or more.
`
`3. (Previously Presented) The secondary battery according to claim 1, wherein the standard
`
`deviation o of the thickness distribution of the protective layer is +/- 1.0 um or more.
`
`4. (Previously Presented) The secondary battery according to claim 1, wherein the standard
`
`deviation o of the thickness distribution of the protective layer is 30% or more and 50% orless
`
`based on an average thickness of the protective layer.
`
`5. (Original) The secondary battery according to claim 1, wherein the protective layer has an
`
`average thickness of 3.5 um orless.
`
`6. (Original) The secondary battery according to claim 1, wherein the inorganic compound
`
`particles have a shape formed by connecting a plurality of primary particles.
`
`7. (Canceled)
`
`8. (Original) The secondary battery according to claim 1, wherein the inorganic compound
`
`particles are particles composed of o-alumina.
`
`9. (Original) The secondary battery according to claim 1, wherein the positive electrode active

`
`material is a lithium nickel composite oxide.
`
`10. (Previously Presented) The secondary battery according to claim 1, wherein a total area of
`
`regions where a thickness of the protective layer is 0.5 um orless is 20% or less based ona total
`
`area of the protective layer, and the standard deviation o of the thickness distribution of the
`
`protective layer is 50% or less relative to an average thickness of the protective layer.
`
`11. (Previously Presented) The secondary battery according to claim 1, wherein the protective
`
`layer has a porosity of 30% or more and 60% orless.
