`In the Office Action, election is required between Species I, FIG. 4, corresponding to a

`secondary battery having an insulating tape wherein the porous region is formed by interposing a

`porous layer formed of a resin between the base layer and the adhesive layer, and SpeciesII, FIG.
`
`5, corresponding to a secondary battery having an insulating tape wherein the porous region 1s
`
`formedof a protrusion and a depression in a surface of the base layer opposite the adhesivelayer.
`
`Applicant hereby elects the subject matter of Species A, FIG. 4, readable on claims 1-6 for
`
`prosecution in this application. This election is made without traverse, and Applicants’ rights to
`
`the filing of a Divisional Application directed to the non-elected subject matter under 35 U.S.C.
`
`§120 and 35 U.S.C. §121 are retained.
