`
`After entry of the foregoing amendment, claims 15—28 and 35-37 will be pendingin the
`
`present application. Claims 15 and 27 are amended. Claims 35-37 are added. Applicant
`
`submits that no new matter has been introducedin the present application by the foregoing
`
`amendment. Support for the foregoing amendment maybe foundin at least paragraphs [0028],
`
`[0021] and [0087]-[0094] and Figure 18 of the filed application.
`
`Applicant submits that claims 15 and 29 are supported by the earliest priority document
`
`of the present application.
`
`Claim Rejections — 35 U.S.C. $103:
`
`Claims 15-17, 22 and 27-29 are rejected under 35 U.S.C. §103 as being unpatentable
`
`over U.S. Patent Application Publication No. 2019/0246356 to Kim etal. (hereinafter “Kim”)
`
`and U.S. Patent Application Publication No. 2018/0288703 to Sunet al. (hereinafter “Sun”).
`
`Claims 18—20 and 30 are rejected under 35 U.S.C. §103 as being unpatentable over Kim, Sun
`
`and U.S. Patent Application Publication No. 2018/0049131 to Huangetal. (hereinafter “Huang
`
`131”). Claims 21, 23 and 31-34 are rejected under 35 U.S.C. §103 as being unpatentable over
`
`Kim, Sun and U.S. Patent Application Publication No. 2019/0045445 to Huanget al. (hereinafter
`
`“Huang °445”). Claims 24-26 are rejected under 35 U.S.C. §103 as being unpatentable over
`
`Kim, Sun and U.S. Patent Application Publication No. 2019/0028967 to Ahnet al. (hereinafter
`
`“Ahn).
`
`Claim 15, as amended,recites:
`
`A station comprising:
`circuitry which, in operation,
`negotiates Wake-Up Radio (WUR)parameters with an access point
`(AP), and switches from WUR mode suspend to WUR modeby initiating and
`completing a WUR modesetup frame exchange; and
`communicates a recommended data rate for a WUR frame
`transmissionfrom the AP; and
`a transmitter which, in operation, transmits a WUR modesetup frameto the
`AP in the WUR mode setup frame exchange,
`wherein the circuitry maintains a portion of the WUR parameters negotiated
`with the AP after entering the WUR mode suspend from the WUR mode.

`Applicant submits that Kim, Sun, Huang ’131, Huang ’445 and Ahn donotdisclose at
`
`least the above-recited subject matter of claim 15.
`
`Kim discloses that “in [a] WUR system using low transmissionrate, it is preferable to
`
`design a size of the WUR packet with a minimum size” and “the data rate of the WUR packetis
`
`not limited to 250 kbps, but lower data rate (e.g., 62.5 kbps) or higher data rate may be
`
`supported” (¥[0177]). Kim discloses that “in the case that multiple data rates are supported for
`
`WUR packet transmission, information indicating the data rate whichis actually used may be
`
`included in the WUR packet” (¥[0177]).
`
`Kim does not disclose that a station “communicates a recommendeddata rate for a WUR
`
`frame transmission from the AP”as recited in amended claim 15. Per Kim, when multiple data
`
`rates are supported, information indicating the data rate used is included in the WURpacket. Per
`
`Kim, the WUR packetitself includes information about the data rate used for the WUR packet.
`
`However, Kim does not disclose or suggested that a station communicates a recommended data
`
`rate fora WUR frametransmission from the access point. Kim doesnot disclose that the station
`
`provides a recommendeddata rate for a transmission from the access point.
`
`Thus, Kim doesnotdisclose the subject matter of amended claim 15.
`
`Sun, Huang ’131, Huang 445 and Ahn donotcure the deficiencies of Kim and do not
`
`disclose or suggest the subject matter of claim 15.
`
`Thus, claim 15 is patentable in view of Kim, Sun, Huang ’131, Huang °445 and Ahn.
`
`Withdrawal of the pending 35 U.S.C. §103 rejection of claim 15 is respectfully requested.
`
`Furthermore, claims 16—26 are dependent on claim 15 andare, therefore, patentable in
`
`view of Kim, Sun, Huang ’131, Huang ’445 and Ahnforat least the same reasonsrecited above
`
`and by virtue of the additional claim features set forth therein. Accordingly, withdrawal of the
`
`35 U.S.C. §103 rejections of claims 16—26 1s respectfully requested.
`
`Although not identical in scope or language, the allowability of claims 27 and 28 will be
`
`apparent in view of the reasons recited above. Accordingly, withdrawal of the 35 U.S.C. §103
`
`rejections of claims 27 and 28 is respectfully requested.
`
`Newclaims 35-37 are dependent on claim 15, either directly or indirectly. New claims
`
`35-37 are patentable in view of Kim, Sun, Huang ’131, Huang 445 and Ahnforat least the
`
`same reasonsrecited above andby virtue of the additional claim features set forth therein.
