`
`Docket No.: 083710-2981
`
`Introduction
`
`REMARKS
`
`Claims 1, 5-7 and 10-18 are pending, of which claim 1 is independent.
`
`No amendmenthas been madeto the claimsin this response. No new matter has been
`
`added.
`
`Patentability under 35 U.S.C. § 103
`
`Claims 1, 7, 11 and 13-16 were rejected under 35 U.S.C. § 102(a)(1) as being anticipated
`
`by Iwasaki (US 6,325,611). Claims 5, 6, 10, 12, 17 and 18 were rejected under 35 U.S.C. § 103
`
`as being unpatentable over Iwasaki in view of Masumoto (US 2013/0316209). Without
`
`conceding any correctness of the rejections, Applicant traverses the rejections for at least the
`
`following reasons.
`
`Ata minimum, noneofthe cited references disclose or suggestthat the overlap part of
`
`the negative electrode current collection lead is not located on the boundary between the 1A arc
`
`column region and the second columnar region of the electrode group andis located at least one
`
`of: within the 1A arc column region, within the 1B arc column region, or over the boundary
`
`between the 1B arc column region and the second columnar region of the electrode group, as
`
`recited by claim 1. Please see, for example, FIGS. 7B-7E of the present application.
`
`The Office Action asserted that first columnar region is above line A and below line B on
`
`annotated Fig. 4 of Iwasaki shown in page 5 of the present Office Action. Applicant respectfully
`
`disagrees.
`
`In claim 1, a first columnar region is a region in which the numberoftimesthe positive
`
`electrode mixture layers are stacked in the radial direction of the electrode group is highest. In
`
`
`
`Application No. 16/762,720
`
`Docket No.: 083710-2981
`
`FIG. 4 of Iwasaki, item 1b is the positive electrode mixture layer. Apparently, the number of
`
`times of the positive electrode mixture layers 1b aboveline A is the sameasthat in the region
`
`between line A and line B. Similarly, the alleged second columnar region in FIG. 4 has a higher
`
`numberof times of the positive electrode mixture layers that the region below line B.
`
`
`
`Annotated fig. 4
`
`In claim 1, a 1A arc columnregion includes an outer periphery-side end surface of the
`
`positive electrode mixture layers and a 1B arc columnregion doesnotinclude the end surface.
`
`In FIG. 4 of Iwasaki, the alleged 1A arc columnregion (aboveline A) does not include an outer
`
`periphery-side end surface of the positive electrode mixture layers 1b.
`
`Moreover, since Iwasaki does not expressly disclose the center of the closed-end
`
`cylindrical battery casing, the cross point of lines A and B on annotated FIG. 4 of Iwasaki does
`
`not necessarily pass the center.
`
`Assuch, since the interpretation of and reliance on FIG. 4 of Iwasaki are erroneous and
`
`have no factual basis, the rejection of claim 1 has no merit. Thus, claim 1 andall claims
`
`dependentthereon are patentable over the cited reference.

`
`CONCLUSION
`
`Having fully respondedto all matters raised in the Office Action, Applicant submits that
`
`all claims are in condition for allowance, an indication for whichis respectfully solicited. If
`
`there are any outstanding issues that might be resolved by an interview or an Examiner’s
`
`amendment, the Examineris requested to call Applicant’s attorney at the telephone number
`
`shownbelow.
`
`To te extent necessary, a petition for an extension of time under 37 C.F.R. § 1.136 is
`
`hereby made. Please charge any shortage in fees due in connection with the filing of this paper,
`
`including extension of time fees, to Deposit Account 500417 under Order No. 083710-2981 and
