Application No. 16/930,439
`
`Docket No.: 083710-3083
`
`Introduction
`
`REMARKS
`
`Claims 1-15 are pending, of which claim 1 is independent. Claims 8-14 have been
`
`withdrawn from consideration. No amendment has been madein this response.
`
`Rejections under 35 U.S.C. § 103
`
`Claims 1-7 and 15 were rejected under 35 U.S.C. § 103 as being unpatentable over
`
`Kinoshita et al. (JP 2013073791).
`
`These rejections are traversedfor at least the following reasons.
`
`Regarding claim 1, Kinoshita fails to teach the feature:
`
`“A solid electrolyte material represented by a composition formula LiaYsbMcXe-dFa,
`where
`M includesat least one kind selected from the group consisting of metalloid elements and
`metal elements other than Li and Y;
`X is at least one kind selected from the group consisting Cl, Br, and I;
`O<a;
`0 <b;
`0 <c; and
`0<d <6”
`
`The Office Action asserted that paragraphs [0007]-[0012] and [0026]-[0038] of Kinoshita
`
`teaches the claimed composition formula. Applicant disagrees.
`
`Applicant submits that paragraph [0008] of Kinoshita teaches AsMXe, where A is Li, M
`
`is Mn andit is preferable that the metal element is made of a substituted metal element. The
`
`metal element is one or more elements selected from Ti, V, Cr, Ni, Fe, Co, Cu, Zn, Y, Zr, Nb,
`
`Mo, W, Ca, Sr, Ba, Al, and Bi. Moreover, paragraph [0010] of Kinoshita teaches X consists of F
`
`and O which substitutes a part of F. Further, paragraphs [0026]-[0038] of Kinoshita list
`

`
`examples of the composition, for example, LisMno9sYo.osFs. Kinoshita at most discloses the use
`
`of F as halogen.
`
`Applicant submits that, in claim 1 of the present application, the subscript of X is (6-d),
`
`where 0<d<6, therefore, the subscript of X, 0<6-d<6. That is, the element X is included in the
`
`formula of claim 1, where X is at least one kind selected from the group consisting Cl, Br,
`
`and I. Thus, in claim 1, F and one of Cl, Br and/or I are used(1.e., two or more halogen
`
`elements).
`
`In contrast, none of the elements selected from the group consisting of Cl, Br, and I is
`
`present in the formula of Kinoshita. Therefore, Kinoshita fails to teach:
`
`“A solid electrolyte material represented by a composition formula LiaYsbMcXe-dFa,
`
`where
`M includesat least one kind selected from the group consisting of metalloid elements and
`metal elements other than Li and Y;
`X is at least one kind selected from the group consisting Cl, Br, and I;
`O<a;
`0 <b;
`0 <c; and
`0<d <6”
`
`Therefore, claim 1 is not obvious over Kinoshita. Therefore, claim 1 andall claims
`
`dependent thereon are patentable.

`
`CONCLUSION
`
`Having fully responded to all matters raised in the Office Action, Applicant submitsthat
`
`all claims are in condition for allowance, an indication for which is respectfully solicited. If
`
`there are any outstanding issues that might be resolved by an interview or an Examiner’s
`
`amendment, the Examineris requested to call Applicant’s attorney at the telephone number
`
`shownbelow.
`
`Respectfully submitted,
