`
`Claim Rejections - 35 USC § 102
`
`1.
`
`The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that
`
`form the basis for the rejections under this section madein this Office action:
`
`A person shall be entitled to a patent unless —
`
`(a)(2) the claimed invention was described in a patent issued under section 151, or in an
`application for patent published or deemed published under section 122(b), in which the
`patent or application, as the case may be, namesanother inventor and waseffectively filed
`before the effective filing date of the claimed invention.
`
`2.
`
`Claim(s) 1, 5, 6, 8, 18, 19 is/are rejected under 35 U.S.C. 102(a)(2) as being
`
`anticipated by Jung et al. (US 2019/0261281).
`
`Regarding Claim 1, Jung teaches a terminal comprising: circuitry, which, in
`
`operation, configures a first power control parameter corresponding toafirst service
`
`when a predetermined condition relating to a control channel to be used for
`
`transmission of assignment information of an uplink signal is satisfied, and configures a
`
`second power control parameter corresponding to a second service when
`
`the predetermined condition is not satisfied (Figure 9, Sections 0030, 0079, 0083, an
`
`uplink (UL) grant is scheduled, which is assignmentinformation as shownin Section
`
`0030, the uplink grant is sent via a control channel in the downlink, the equations of
`
`Sections 0030, 0079 teach a plurality of different power control parameters such asc (j)
`
`and f sub f,c (i,

`|) which can be adjusted based on the type of service such asultra

`
`reliable low-latency (URLLC) service or enhanced mobile broadband (eMBB) as shown
`
`in Section 0083, the term “predetermined condition” is broad and thus can read ona
`
`myriad of conditions such as, in the case of Jung, the conditions of a URLLC service or
`
`a eMBB service); and transmission circuitry, which, in operation, transmits the uplink
`
`signal using a transmission power calculated using the first power control parameter or
`
`the second power control parameter (Figure 9, Sections 0030, 0079, the uplink signal
`
`power is calculated using the power control parameters in the equations suchasc (j)
`
`and f sub f,c (i, 1).
`
`Regarding Claim 19, Jung teaches a transmission method comprising:
`
`configuring a first power control parameter corresponding to a first service when a
`
`predetermined condition relating to a control channel to be used for transmission of
`
`assignment information of an uplink signal is satisfied, and configuring a second
`
`power control parameter corresponding to a second service when the predetermined
`
`condition is not satisfied (Sections 0030, 0079, 0083, an uplink (UL) grant is scheduled,
`
`which is assignmentinformation as shown in Section 0030, the uplink grant is sent via a
`
`control channel in the downlink, the equations of Sections 0030, 0079 teach a plurality
`
`of different power control parameters such as c (j) and f sub f,c (i,

`
`adjusted based on the type of service such asultra reliable low-latency (URLLC) service

`or enhanced mobile broadband (eMBB)as shownin Section 0083, the term
`
`“predetermined condition” is broad and thus can read on a myriad of conditions such as,
`
`in the case of Jung, the conditions of a URLLC service or a eMBB service); and
`
`transmitting the uplink signal using a transmission power calculated using the first
`
`power control parameter or the second power control parameter (Sections 0030, 0079,
`
`
`
`Application/Control Number: 17/049,433
`Art Unit: 2645
`
`Page 4
`
`the uplink signal power is calculated using the power control parameters in the
`
`equations such as c (j) andfsub f,c (i, 1).
`
`Regarding Claim 5, Jung teachesall of the claimed limitations recited in Claim 1.
`
`Jung further teaches wherein the predetermined condition is that the control channel is
`
`a control channel that is received at the terminal within a predetermined time period
`
`after a signal requesting scheduling ofthe first service is transmitted from the terminal
`
`(Section 0030, in order to receive the UL grant the UE typically requests a scheduling
`
`for said uplink transmission, the grant is received via some kind of control channel a
`
`period of time after said request).
`
`Regarding Claim 6, Jung teachesall of the claimed limitations recited in Claim 1.
`
`Jung further teaches wherein the predetermined condition is that the control channel is
`
`a control channel that the terminal receives first after a signal requesting scheduling of
`
`the first service is transmitted from the terminal (Section 0030, in order to receive the UL
`
`grant the UE typically requests a scheduling for said uplink transmission, the grant is
`
`received via some kind of control channel after said request).
`
`Regarding Claim 8, Jung teachesall of the claimed limitations recited in Claim 1.
`
`Jung further teaches wherein the predetermined condition is that a time period until the
`
`terminal transmits the uplink signal after the terminal receives the control channel is
`
`within a predetermined time (Section 0030, the UE will transmit an uplink signal a period
`
`of time after receiving the UL grant via some kind of control channel).
`
`Regarding Claim 18, Jung teachesall of the claimed limitations recited in Claim
`
`1.
`
`Jung further teaches wherein the transmission power calculated using the first
`
`power control parameter is greater than the transmission power calculated using the
`
`
`
`Application/Control Number: 17/049,433

`
`second power control parameter (Sections 0030, 0079, the uplink signal poweris
`
`calculated using the power control parameters in the equations such asc (j) and f sub
`
`f,c (i, 1), these power control parameters can change thus rendering a scenario wherein
`
`the transmission power defined by said power control parameters changes thus further
`
`rendering a scenario wherein power in one instance is greater than the transmission
`
`power in another instance).
`

`invention is not identically disclosed as set forth in section 102, if the differences between the
`claimed invention and the prior art are such that the claimed invention as a whole would have
`been obvious before the effective filing date of the claimed invention to a person having
`ordinary skill in the art to which the claimed invention pertains. Patentability shall not be
`negated by the manner in which the invention was made.
`
`4.
`
`Claims 2, 3 is/are rejected under 35 U.S.C. 103 as being unpatentable over Jung
`
`et al. (US 2019/0261281) in view of Hosseini et al. (US 2018/0376464).

`(Section 0029, since there is a limited amountof resourcesthere will be a threshold
`
`associated with said limitation thus rendering a scenario wherein the number of
`
`resource elements is equal to said threshold).
`
`It would have been obvious to one of ordinary skill in the art prior to the effective
`
`filing date of the claimed invention to modify the system of Jung with the above features
`
`of He for the purpose of efficiently transmitting signals on the uplink as taught by He.

`
`Claim 17 is/are rejected under 35 U.S.C. 103 as being unpatentable over Jung et
`
`al. (US 2019/0261281) in view of Papasakellariou et al. (US 2010/0195575)
`
`Regarding Claim 17, Jung teachesall of the claimed limitations recited in Claim
`
`1.
`
`Jung does not teach wherein the predetermined condition is that a ratio of a number
`
`of resources of uplink control information included in the uplink signal to a number of
`
`resources of an entirety of the uplink signal is larger than a predetermined threshold
`
`value.
`
`Papasakellariou, which also teaches a wireless communication system, teaches
`
`wherein the predetermined condition is that a ratio of a number of resources of uplink
`
`control information included in the uplink signal to a number of resources of an entirety
`
`of the uplink signal is larger than a predetermined threshold value (Section 0026).
