`After entry of the foregoing amendment, claims 1-10 will be pending in the present

`application. Claims 1-10 are amended. Applicant submits that no new matter has been
`
`introduced in the present application by the foregoing amendment.

`Allowable Subject Matter:

`Claims 2, 5, 7 and 8 are allowable. Applicant thanks the Examinerfor indicating the
`
`allowable subject matter but believes broader subject matter is available.

`Claim Rejections — 35 U.S.C.
`
`$103:
`
`Claims 1, 3, 4, 6, 9 and 10 are rejected under 35 U.S.C. §103 as being unpatentable over
`
`U.S. Patent Application Publication No. 2019/0191443 to Sanoetal. (hereinafter “Sano”) and
`
`Mitsubishi Electric, “Discussions on UL multiplexing,” R1-1804947, Agenda Item: 7.2.4 Study
`
`of handling UL multiplexing of transmissions with different reliability requirements, 3GPP TSG
`
`RAN WGI Meeting #92b, Chennai, China, April 16-20, 2018 (hereinafter “R1-1804947”).
`
`Claim 1, as amended,recites:
`
`A terminal, comprising:
`circuitry, which, in operation, determines a transmission operation ofafirst
`uplink transmission corresponding to a first service, and a second uplink
`transmission corresponding to a second service, based on the first uplink
`transmission and a setting of a reference signal included in the second uplink
`transmission, and
`a transmitter, which in operation, transmits an uplink signal including at
`least a signal of the first uplink transmission based on the determined transmission
`operation.

`Applicant submits that Sano and R1-1804947 do not disclose or suggest at least the
`
`above-italicized subject matter of amended claim 1.
`
`The Examinerasserts (page 3 of the Office Action) that Sano discloses the above-
`
`italicized subject matter of claim 1 with the exception of determining the transmission operation
`
`based on “a setting of a reference signal included in the second uplink transmission,” which the
`
`Examinercites R1-1804947 as disclosing.

`R1-1804947 discloses that a “pre-emption indicator (PI) in [a] PDCCHcan be usedto
`
`notify eMBB UEs[of] possible locations for URLLC transmission.” R1-1804947 discloses that
`
`“the eMBB UE can blank resources indicated by the PI where URLLCtransmission make [sp?
`
`may| take place.” R1-1804947 discloses that “the resources to be blanked can be indicated
`
`dynamically using PI or semi-statically via RRC” (Section 3.1 and Figures 1-3).
`
`However, the pre-emption indicator of R1-1804947is not a setting of a reference signal
`
`included in the second uplink transmission. The pre-emption indicator is transmitted to an
`
`eMBBUE in the downlink by a downlink channel (the physical downlink control channel
`
`(PDCCH)). The pre-emption indicator of R1-1804947 is not included in an uplink transmission.
`
`Rather, the pre-emption indicator of R1-1804947is received by the UE in the downlinkeither
`
`dynamically (by the PDCCH)or by semi-static downlink RRC signaling. R1-1804947 does not
`
`disclose that the pre-emption indicator is included in an uplink transmission by the eMBB UE or
`
`another UE.
`
`Thus, R1-1804947 does not cure the deficiencies of Sano.
`
`Claim 1 is patentable in view of Sano and R1-1804947. Withdrawal of the pending 35
`
`U.S.C. §103 rejection of claim 1 is respectfully requested.
`
`Furthermore, claims 3, 4, 6 and 9 are dependent on claim 1 andare, therefore, patentable
`
`in view of Sano and R1-1804947 for at least the same reasonsrecited above and byvirtue of the
`
`additional claim features set forth therein. Accordingly, withdrawal of the 35 U.S.C. §103
`
`rejections of claims 3, 4, 6 and 9 is respectfully requested.
`
`Although not identical in scope or language, the allowability of claim 10 will be apparent
`
`in view of the reasons recited above. Accordingly, withdrawal of the 35 U.S.C. §103 rejections
`
`of claim 10 is respectfully requested.
