`
`Notice of Pre-AlA or AIA Status
`
`The present application, filed on or after March 16, 2013, is being examined under the first
`
`inventor to file provisions of the AIA.
`
`DETAILED ACTION
`
`This office action is a response to the application 17/394,126 filed on 08/04/2021.
`
`Claims 1-9, 11, and 13 - 15 are pending.
`
`Claims 1-9, 11, and 13 - 15 are rejected.
`
`Information Disclosure Statement
`
`The information disclosure statements (IDS) submitted on 2/7/2022, 2/10/2022, 9/16/2022, and
`
`1/23/2024 are in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure
`
`statement is being considered by the examiner.
`
`The following is a quotation of 35 U.S.C. 112(b):
`
`Claim Rejections - 35 USC § 112
`
`(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out
`and distinctly claiming the subject matter which the inventor or a joint inventor regards as the
`invention.
`
`The following is a quotation of 35 U.S.C. 112 (pre-AlA), second paragraph:
`
`The specification shall conclude with one or more claims particularly pointing out and
`distinctly claiming the subject matter which the applicant regards as his invention.
`
`Claims 8 and 9 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AlA), second paragraph,
`
`as being indefinite for failing to particularly point out and distinctly claim the subject matter which the
`
`inventor or a joint inventor (or for applications subject to pre-AlA 35 U.S.C. 112, the applicant), regards
`
`as the invention. The claims identify the “plurality of second reference signals”. However, these claims
`
`
`
`Application/Control Number: 17/633,526
`Art Unit: 2478
`
`Page 3
`
`|’
`have dependencyto claim 1, which only identifies “the second reference signal”. Therefore, the claims
`
`are indefinite as the metes and bounds of the claim language as to the number of second reference
`
`signals cannot be established.
`
`Claim9is further rejected under 35 U.S.C.
The claim identifies an apparatus that is receiving reference signals, and in turn
`
`potentially transmitting on the same signals. In paragraph 0199 of Applicant's specification, the base
`
`station is involved in determining to drop reference signals, but the claim recites a receiving apparatus
`
`and it is not clear how the receiving apparatus would ever decide to transmit the reference signals that
`
`it is receiving on the downlink. It is recommendedthat the claim recite that it is determined by the
`
`receiving apparatus that the referencesignals are dropped.
`
`Claim Rejections - 35 USC § 102
`
`The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis
`
`for the rejections under this section made in this Office action:
`
`A person shall be entitled to a patent unless —
`
`(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale,
`or otherwise available to the public before the effective filing date of the claimed invention.
`
`(a)(2) the claimed invention was described in a patent issued under section 151, or in an application
`for patent published or deemed published under section 122(b), in which the patent or application, as
`the case may be, namesanother inventor and was effectively filed before the effective filing date of
`the claimed invention.
`
`Claims 1 -7, 9, 11, 13, and 14 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by
`
`Ericsson, “Maintenance for RS and QCL”, 3GPP TSG-RAN WG1 Meeting #94bis R1-1811171 dated
`
`October8, 2018 (identified in Applicant’s IDS dated 2/7/2022), hereinafter “3GPP R1-1811171”.

`
`Regarding (Original) claim 1, 3GPP R1-1811171 teaches a receiving apparatus (3GPP R1-1811171:
`
`[Section 3 DMRS,Page 1] a UE is described (correspondsto the "receiving apparatus")) comprising:
`
`control circuitry, which, in operation, decides mapping of a second reference signal (3GPP R1-
`
`1811171: [Section 3 DMRS, Pages 1 & 2] DMRS(corresponds to the "second referencesignal”));
`
`in a second system (3GPP R1-1811171: [Section 3 DMRS, Page 1] NR (corresponds to the
`
`"second system"));
`
`based on information (3GPP R1-1811171: [Section 3 DMRS, Pages 1 & 2] on the basis of RRC
`
`parameter Ite-CRS-ToMatchAround, DMRS symbols, subcarrier spacing, single or double symbol DMRS
`
`positioning, or PDSCH timing (correspondsto the "information") (Examiner notes that any
`
`“information” can be relied upon by the method. The claim doesnotspecify the information, nor how
`
`it is to be used);
`
`that allows mappingofa first reference signal (3GPP R1-1811171: [Section 3 DMRS,Page1]
`
`that can identify the disposition of a CRS (correspondsto the "first reference signal"));
`
`in a first system (3GPP R1-1811171: [Section 3 DMRS, Page 1] LTE (corresponds to the "first
`
`system”")); to be identified; and
`
`receiving circuitry, which, in operation, receives the second reference signal (3GPP R1-1811171:
`
`[Section 3 DMRS, Pages 1 & 2] a DMRS (corresponds to the "second reference signal"));
`
`based on the decided mapping (3GPP R1-1811171: Table 7.4.1.1.2-3 depicts the DMRS symbol
`
`mapping based on the CRS).
`
`Regarding (Original) claim 11, 3GPP R1-1811171 teaches a receiving method, comprising:
`
`deciding, by a receiving apparatus (3GPP R1-1811171: [Section 3 DMRS, Page 1] a UE is
`
`described (corresponds to the "receiving apparatus"));
`
`
`
`Application/Control Number: 17/633,526
`Art Unit: 2478
`
`Page 5
`
`mapping of a second referencesignal (3GPP R1-1811171: [Section 3 DMRS, Pages 1 & 2] DMRS
`
`(corresponds to the "second referencesignal”));
`
`in a second system (3GPP R1-1811171: [Section 3 DMRS, Page 1] NR (corresponds to the
`
`"second system"));
`
`based on information (3GPP R1-1811171: [Section 3 DMRS, Pages 1 & 2] on the basis of RRC
`
`parameter Ite-CRS-ToMatchAround, DMRS symbols, subcarrier spacing, single or double symbol DMRS
`
`positioning, or PDSCH timing (corresponds to the "information")(Examiner notes that any
`
`“information” can be relied upon by the method. The claim doesnot specify the information, nor how
`
`it is to be used);
`
`that allows mappingofa first reference signal (3GPP R1-1811171: [Section 3 DMRS, Pages 1 &
`
`2] that can identify the disposition of a CRS (correspondsto the "first reference signal"));
`
`in a first system (3GPP R1-1811171: [Section 3 DMRS, Page 1] LTE (correspondsto the "first
`
`system")) to be identified; and
`
`receiving, by the receiving apparatus, the second reference signal (3GPP R1-1811171: [Section 3
`
`DMRS,Pages 1 & 2] a DMRS(correspondsto the "second referencesignal”));
`
`based on the decided mapping (3GPP R1-1811171: Table 7.4.1.1.2-3 depicts the DMRS symbol
`
`mapping based on the CRS).
`
`Regarding (Original) claim 2, 3GPP R1-1811171 teaches the receiving apparatus according to claim 1,
`
`wherein in a case wherecontentsindicated in the information (3GPP R1-1811171: [Section 3 DMRS,
`
`Pages 1 & 2] on the basis of RRC parameter Ite-CRS-ToMatchAround, DMRS symbols, subcarrier
`
`spacing, single or double symbol DMRSpositioning, or PDSCH timing (corresponds to the
`
`"information") Examiner notes that any “information” can be relied upon by the method. The claim
`
`does not specify the “information”, nor howit is to be used);
`
`
`
`Application/Control Number: 17/633,526
`Art Unit: 2478
`
`Page 6
`
`satisfy a certain condition (3GPP R1-1811171: [Section 3 DMRS, Page 2] DM-RSpositions for
`
`PDSCH duration (as measured from the beginningofthe slot) of 13 and 14 are lo,12 instead of the
`
`default lo,11. Examiner notes that the condition where the PDSCH duration is 13 symbols or 14
`
`symbols does not depend on whether the symbol where the CRSis placed overlaps the symbol where
`
`the DMRSis configured);
`
`the control circuitry decides that a position of the second referencesignal is a symbol different
`
`from a symbol configured for the receiving apparatus (3GPP R1-1811171: [Section 3 DMRS, Page
`
`2] when a condition is satisfied where PDSCH duration is 13 symbols or 14 symbols, content indicated
`
`by the RRC parameter determines that a DMRSposition is a different symbol than a default symbol
`
`(corresponds to the "symbol set by the receiving device").
`
`Regarding (Original) claim 3, 3GPP R1-1811171 teaches the receiving apparatus according to claim 2,
`
`wherein the condition (3GPP R1-1811171: [Section 3 DMRS, Page 2] DM-RSpositions for PDSCH
`
`duration (as measuredfrom the beginning of the slot) of 13 and 14 are lo,12 instead of the default
`
`lo,11. Examiner notes that the condition is the PDSCH);
`
`is independent of whether a symbol in which the first reference signal is mapped and the
`
`symbol configured for the second referencesignal for the receiving apparatus overlap with each
`
`other. (3GPP R1-1811171: Figure 3 and [Section 3 DMRS, Page 2] For PDSCH mapping Type A, when
`
`Ite-CRS-ToMatchAroundis configured and dmrs-AdditionalPosition= 'posl ', and single-symbol DMRS,
`
`then the DM-RSpositions for PDSCH duration (as measured from the beginningof the slot) of 13 and
`
`14 are lo,12 instead of the default lo,11. Examiner notes that the condition where the PDSCH duration
`
`is 13 symbols or 14 symbols does not depend on whether the symbol wherethe CRSis placed overlaps
`
`the symbol where the DMRSis configured).
`
`
`
`Application/Control Number: 17/633,526
`Art Unit: 2478
`
`Page 7
`
`Regarding (Currently Amended) claim 4, 3GPP R1-1811171 teaches the receiving apparatus according
`
`to claim 1, wherein in a case wherea first symbol in which the first reference signal is mapped (3GPP R1-
`
`1811171: [Section 3 DMRS] on the basis of the RRC parameter, when the symbol where the CRSis
`
`disposed (corresponds to the "first symbol”));
`
`and a second symbol configured for the second referencesignal for the receiving apparatus
`
`overlap with each other (3GPP R1-1811171: Figure 3 and [Section 3 DMRS], overlaps the symbol where
`
`the DMRSis configured to the UE (corresponds to the "second symbol");
`
`the control circuitry decides that a position of the second referencesignal is a third symbol
`
`different from the second symbol (3GPP R1-1811171: Figure 3 and [Section 3 DMRS] the position of the
`
`DMRSis determined to be a non-overlapping symbolthatis different from the symbol where the
`
`DMRSis configured (corresponds to the "third symbol")).
`
`Regarding (Original) claim 5, 3GPP R1-1811171 teaches the receiving apparatus according to claim 4,
`
`wherein the control circuitry determines whether the first symbol and the second symbol overlap with
`
`each other (3GPP R1-1811171: [Section 3 DMRS, Page 2] the symbol where the CRSis disposed
`
`overlaps the symbol where the DMRSis configured, on the basis of PDSCH (correspondsto the "data
`
`containing the secondreference signal"));
`
`based on assignmentinformation of data (3GPP R1-1811171: [Section 3 DMRS, Page 3
`
`7.4.1.1.2] scheduling of the PDSCH resources (correspondsto the "assignment information"));
`
`including the second reference signal and information on the mapping of the first reference
`
`signal (3GPP R1-1811171: [Section 3 DMRS, Page 1] RRC parameterrelated to the disposition of the
`
`CRS).
`
`
`
`Application/Control Number: 17/633,526
`Art Unit: 2478
`
`Page 8
`
`Regarding (Original) claim 6, 3GPP R1-1811171 teaches the receiving apparatus accordingto claim 4,
`
`wherein in a case where contents indicated in the information satisfy a certain condition, (3GPP R1-
`
`1811171: [Section 3 DMRS, Page 2] For PDSCH mapping TypeA, when /te-CRS-ToMatchAroundis
`
`configured and dmrsAdditionalPosition='pos!', and single-symbol DMRS. Examiner notes that the
`
`condition is the single-symbol DMRS);
`
`the control circuitry decides that the position of the second reference signal is the third symbol ,
`
`(3GPP R1-1811171: [Section 3 DMRS, Page 2] the position of the DMRSis determined to be a symbol
`
`that does not overlap with the CRS (corresponds to the "third symbol")).
`
`Regarding (Original) claim 7, 3GPP R1-1811171 teaches the receiving apparatus accordingto claim 6,
`
`wherein the condition (Examiner notes that the condition is the single-symbol DMRSfrom claim 6);
`
`is independent of whether the first symbol and the second symbol overlap with each
`
`other. (3GPP R1-1811171: Figure 3 and [Section 3 DMRS Page 2] The additional DMRSis moved to the
`
`13'* symbol in case the PDSCH duration is 13 or 14 OFDM symbols, for the single-symbol DMRScase).
`
`Regarding (Original) claim 9, 3GPP R1-1811171 teaches the receiving apparatus according to claim 1.
`
`3GPP R1-1811171 continuesto disclose wherein the control circuitry decides not to transmit. 3GPP R1-
`
`1811171 also discloses any one of twoofa plurality of the second reference signals, the two of the
`
`plurality of second reference signals being signals with time spacing equal to or less than a threshold
`
`value in the decided mapping. (3GPP R1-1811171: [Section 7 PT-RS] When a UE is scheduled to
`
`transmit PUSCH with allocation duration of 2 symbols with mapping type B andif Lpz-rs is set to 2 or 4,
`
`the UE shall not transmit PT-RS. When a UE is scheduled to transmit PUSCH with allocation duration of
`
`4 symbols with mappingtype B,and if Lpr-rs is set to 4, the UE shall not transmit PT-RS). Examiner
`
`notesthat this is considered a negative limitation. Therefore, the teaching of 3GPP R1-1811171 that the
`
`
`
`Application/Control Number: 17/633,526
`Art Unit: 2478
`
`Page 9
`
`UE is not transmitting is considered corresponding to deciding not to transmit. The examiner cannot
`
`find any basis for this decision within this claim, nor in claim 1.
`
`Regarding (New) claim 13, 3GPP R1-1811171 teaches the receiving apparatus according to claim 4.
`
`3GPP R1-1811171 continuesto disclose wherein in a case where a subcarrier spacing configured for the
`
`receiving apparatusis a specific value, (3GPP R1-1811171: [Section 3 DMRS, Page 1] operating on 15
`
`kHz subcarrier spacing)
`
`the control circuitry decides that a position of the second reference signal is a symbol different
`
`from a symbol configured for the receiving apparatus. (3GPP R1-1811171: [Section 3 DMRS, Page 2] For
`
`PDSCH mapping TypeA, when /te-CRS-ToMatchAroundis configured and
`
`dmrsAdditionalPosition='posi ', and single-symbol DMRS, then the DM-RSpositions for PDSCH
`
`duration (as measured from the beginning of the slot) of 13 and 14 are /o,12 instead of the default
`
`lo,11).
`
`Regarding (New) claim 14, 3GPP R1-1811171 teaches the receiving apparatus according to claim 4.
`
`3GPP R1-1811171 continuesto disclose wherein in a case where a subcarrier spacing configured for the
`
`receiving apparatus is 15kHz, (3GPP R1-1811171: [Section 3 DMRS, Page 1] operating on 15 kHz
`
`subcarrier spacing)
`
`the control circuitry decides that a position of the second referencesignal is a symbol different
`
`from a symbol configured for the receiving apparatus. (3GPP R1-1811171: [Section 3 DMRS, Page 2] For
`
`PDSCH mapping Type A, when /te-CRS-ToMatchAroundis configured and
`
`dmrsAdditionalPosition='posi ', and single-symbol DMRS, then the DM-RSpositions for PDSCH
`
`duration (as measured from the beginning of the slot) of 13 and 14 are /o,12 instead of the default
`
`lo,11).

`
`Claim Rejections - 35 USC § 103
`
`In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102
`
`and 103 (or as subject to pre-AlA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory
`
`basis (i.e., changing from AIA to pre-AlA) for the rejection will not be considered a new ground of
`
`rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same
`
`under either status.
`
`The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections
`
`set forth in this Office action:
`
`A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is
`not identically disclosed as set forth in section 102, if the differences between the claimed invention
`and the prior art are such that the claimed invention as a whole would have been obvious before the
`effective filing date of the claimed invention to a person having ordinaryskill in the art to which the
`claimed invention pertains. Patentability shall not be negated by the manner in which the invention
`was made.
`
`The factual inquiries for establishing a background for determining obviousness under 35 U.S.C.
`
`103 are summarized as follows:
`
`1. Determining the scope and contentsofthe prior art.
`
`2. Ascertaining the differences between the prior art and the claims at issue.
`
`3. Resolving the level of ordinary skill in the pertinent art.
`
`4. Considering objective evidence present in the application indicating obviousness or
`
`nonobviousness.
`
`Claim 8 is rejected under 35 U.S.C. 103 as being anticipated by Ericsson, “Maintenance for RS
`
`and QCL”, 3GPP TSG-RAN WG1 Meeting #94bis R1-1811171 dated October 8, 2018 (identified in

`
`2015/0223211 A1), hereinafter SEO.
`
`Regarding (Currently Amended) claim 8, 3GPP R1-1811171 teaches the receiving apparatus according
`
`to claim 1. However, 3GPP R1-1811171 does not disclose wherein in a case where a position of at least
`
`one reference signal of a plurality of the second reference signals is changed, the control circuitry
`
`changesa position of a remaining reference signal. SEO does teach wherein in a case where a position
`
`of at least one reference signal of a plurality of the second reference signals is changed, the control
`
`circuitry changes a position of a remaining reference signal. (SEO: Figure 10(b) and [0098] FIG. 10(b),

`the location of the DM-RS maybeshifted to a time axis as much as two symbols without separate
`
`configuration).
`
`It would have been obvious to one of ordinary skill in the art, before the effective filing date of
`
`the claimed invention, to modify the teachings of 3GPP R1-1811171 with the DMRS symbol shifting of
`
`SEO so that the downlink control information of the user equipment mayeffectively be detected in the
`
`wireless communication system.
`
`Claim 15 is rejected under 35 U.S.C. 103 as being anticipated by Ericsson, “Maintenancefor RS
`
`and QCL”, 3GPP TSG-RAN WG1 Meeting #94bis R1-1811171 dated October 8, 2018 (identified in
`
`Applicant’s IDS dated 2/7/2022), hereinafter “3GPP R1-1811171”, in view of Kim et al. (US
`
`2021/0058949 A1; support for the rejection can be found in the Korean Applications 10-2019-0040392
`
`(04/05/2019)), hereinafter KIM.
`
`Regarding (New) claim 15, 3GPP R1-1811171 teaches the receiving apparatus according to claim
`
`4, however 3GPP R1-1811171 does not disclose wherein in a case where a physical downlink shared

`channel (PDSCH) resourcesare indicated by PDSCH mapping type B and a duration of the PDSCH
`
`resources is a specific duration, the control circuitry decides that a position of the second reference
`
`signal is a symbol different from a symbol configured for the receiving apparatus. KIM doesdisclose
`
`wherein in a case where a physical downlink shared channel (PDSCH) resources are indicated by PDSCH
`
`mapping type B (KIM: [0103] In PDSCH mappingtypeB) and a duration of the PDSCH resourcesis a
`
`specific duration (KIM: [0103] CORESET overlaps with the position of a DMRStransmission symbol),
`
`the control circuitry decides that a position of the second reference signal is a symbol different from a
`
`symbol configured for the receiving apparatus. (KIM: [0103] the position of the DMRStransmission
`
`symbol may beshifted to the symbol next to the last symbol of the CORESET).
`
`It would have been obvious to one of ordinary skill in the art, before the effective filing date of
`
`the claimed invention, to modify the teachings of 3GPP R1-1811171 with the DMRS symbol shifting of
`
`KIM so that radio signal transmission and reception can be efficiently performed in a wireless
`
`communication system.
