`UPDATE TO JULY JOINT STATUS REPORT AND
`REQUEST TO SET SCHEDULING CONFERENCE
`
`I.
`
`INTRODUCTION
`
`At the June 7, 2018 hearing in this case the Court directed the parties to meet and confer regarding
`
`a revised case schedule. At that time, Counsel was not able to reach agreement, and on July 23, 2018 the
`
`parties jointly submitted a case status report (the “Initial Case Status Report”) setting forth their
`
`respective positions and two suggested case schedules. The schedule suggested by Plaintiffs in July of
`
`2018 included an aggressive timeline that concluded with a trial of the class cases in July or August of
`
`2019. This schedule assumed that all of the outstanding depositions—except for the stayed depositions—
`
`would be completed in sufficient time to be analyzed prior to submission of the Plaintiffs’ opening expert
`
`reports. Since the submission of the Initial Case Status Report, the parties have conducted 13 depositions
`
`throughout the world—in many cases, double or triple tracking multiple depositions in a single day.
`
`Despite these efforts, there remain at least eight depositions—in addition to the stayed depositions—to
`
`be taken prior to the submission of Plaintiffs’ expert reports.
`
`Moreover, the Court’s recent ruling on Defendants’ Phase II Joint Motion for Partial Summary
`
`Judgment Dismissing Flextronics’s Sherman Act and California State Law Claims for Foreign
`
`Transactions (the “Flex FTAIA Motion”) will have a significant impact on the Direct Action Plaintiffs’
`
`(“DAPs”)1 expert reports. Indeed, the schedule submitted by Plaintiffs as part of the Initial Case Status
`
`Report expressly noted that resolution of the Flex FTAIA Motion was “essential to the efficient and cost-
`
`effective resolution of Flex’s claims and the Flex Parties reserved the right to seek an additional extension
`
`of the proposed dates to accommodate for the Court’s anticipated ruling” on the Flex FTAIA Motion.
`
`Thus, now that the Flex FTAIA Motion has been resolved, the DAPs, IPPs, and Defendants (collectively,
`
`the “Moving Parties”) agree that the most efficient and cost-effective way for the Moving Parties’ experts
`
`to account for the Court’s ruling on the Flex FTAIA Motion is to revise the schedules originally submitted
`
`with the Initial Case Status Report.
`

`Finally, the Moving Parties recognize that the Court’s decision on whether or not to accept NCC’s
`
`guilty plea will impact the feasibility of the proposed compromise schedule. Thus, the Moving Parties
`
`believe that it would be more efficient to resolve the scheduling issues after the October 3, 2018
`
`sentencing hearing.
`
`Given the circumstances, the Moving Parties reopened their discussions regarding the case
`
`schedule going forward and have agreed upon a compromise schedule—subject to further input from the
`
`Court—which is appended to this Motion as Exhibit A.
`
`The Moving Parties therefore respectfully request that the Court set a status conference at its
`
`convenience to discuss the proposed compromise schedule.
`
`The Moving Parties have discussed the relief requested herein with counsel for DPPs. DPPs have
`
`filed a separate submission in this matter.
`
