`
`
`NOTES AND ORDERS
`
`
`All pending summary judgment motions in the Direct Action Plaintiff cases are denied for the
`reasons stated on the record.
`
`For the AASI, Avnet, and Benchmark plaintiffs’ Daubert motions filed at MDL Dkt. Nos. 623,
`625, and 630, the Court agrees with the parties’ joint suggestion at the hearing that they raise
`issues more suitable for resolution in a motion in limine. The Daubert motions are terminated
`without prejudice on that basis.

`
`Because this completes the coordinated pretrial proceedings in this multi-district litigation (MDL
`No. 2801), the Court will file with the JPML a suggestion of remand. The Court will
`recommend that Case Nos. 17-7046 (Avnet), 17-7047 (Benchmark), and 19-1902 (Jaco) be
`transferred back to the District of Arizona, and Case No. 18-2657 (Arrow) to the District of
`Colorado. Case Nos. 17-3472 (AASI) and 14-3264 (Flextronics) will remain in this District.
`
`For the AASI case, No. 17-3472, the parties are directed to jointly file by May 23, 2022, a
`proposed ADR mechanism and timeline for the case, as well as any other case management
`proposals to bring that case to resolution.
`
`For the Flextronics case, No. 14-3264, the parties are directed to jointly file by May 6, 2022, a
`proposed trial date that would provide for the completion of the trial by September 2, 2022. The
`Court anticipates a trial of 2.5-3 weeks, with a 9 am-4 pm trial day schedule. The joint statement
`should also identify (with docket numbers) any remaining motions that are in need of the Court’s
`resolution prior to trial.
