`Plaintiff FastVDO LLC and Defendant Olympus America Inc. (“OAI”), subject to the approval

`Olympus Imaging America Inc. (“OIMA”) is hereby substituted as a defendant in
`
`place of OAI, which was incorrectly named as a defendant;
`

`OAI is not involved in the making, using, testing, or selling of any of the accused
`

`products;
`
`OAI does not derive revenue from the accused products;
`
`OAI is hereby dismissed from this case without prejudice; and
`
`OIMA shall answer, move or otherwise plead in response to the Amended
`
`Complaint on or before January 6, 2012.
