`WHEREAS the parties have conferred and reached agreement on the proposed extension

`of certain deadlines in this case that will not impact the filing of the pretrial order or the dates for

`the pretrial conference or trial;

`IT IS HEREBY STIPULATED AND AGREED, subject to the Court’s approval, that the

`* If the Court has not issued a claim construction ruling concerning the Kao patent by Tuesday,
`March 10, the deadline for serving‘ opening reports regarding infringement or invalidity of the
`Kao patent shall be 10 days from the entry of the Court’s claim construction ruling. The
`deadlines for any rebuttals to those reports and any replies to those rebuttals shall be shifted
`accordingly.
