`SUMMARY DETERMINATION TO BE DEEMED TIMELY FILED

`Complainant United States Steel Corporation (“U. S. Steel”) respectfully moves for its
`
`Opposition to the motions for summary determination of the Baosteel, Angang, and WISCO
`
`Respondents (Mot.. Nos. 1002-082 & 1002-084) filed one minute after the filing deadline (EDIS
`
`Doc. ID 619141) to be deemed timely filed on August 4, 2017.1 All Respondents in this
`
`Investigation and the Office of Unfair Import Investigations Staff consent to this motion and have
`
`agreed to waive the two-day notice requirement in Ground Rule 3.2. As service of the motion and
`
`accompanying exhibits was effectuated in a timely manner on August 4, there is no prejudice to
`
`any party.
`
`U. S. Steel’s Opposition and the 64 supporting exhibits required several different uploads
`
`into the EDIS system. The final submission was successfully entered into the system at 5:15 PM
`
`
`1 Dockets informed Complainant that CBI header was missing from certain pages of the filing.
`If the motion is granted, U. S. Steel will accordingly also add a CBI header in compliance with
`EDIS requirements.

`EDT, however the EDIS system registered the full upload at 5:16 PM EDT, one minute after the
`
`filing deadline.
`
`U. S. Steel respectfully submits that no party is prejudiced by its one-minute late filing of
`
`the Opposition because the parties’ service copies were timely completed well before the 7 PM
`
`EDT agreed deadline for service. The Administrative Law Judge has previously granted motions
`
`to file documents late in this Investigation. See Order No. 47 (granting leave to file late); Order
`
`No. 79 (granting leave to file a corrected opposition brief one day after the opposition’s deadline).
`
`U. S. Steel respectfully requests that the Administrative Law Judge do the same here and
`
`issue an order allowing U. S. Steel’s Opposition to the Baosteel, Angang, and WISCO
`
`Respondents’ Motions for Summary Determination to be filed one minute late.
`
`Ground Rule 3.2 Certification. Prior to filing this motion, counsel for U. S. Steel made
`
`reasonable, good-faith efforts to resolve the matter by contacting counsel of record in this
`
`Investigation. All Respondents in this Investigation have confirmed that they do not oppose this
`
`motion and agreed to waive the two-day notice requirement of Ground Rule 3.2. The Office of
`
`Unfair Import Investigations Staff likewise does not oppose this motion and waived the two-day
`
`notice requirement.
`
`For these reasons, U. S. Steel respectfully requests that this motion be granted and its
`
`Opposition to the Baosteel, Angang, and WISCO Respondents’ Motions for Summary
`
`Determination (EDIS Doc. ID 619141) be deemed timely filed on August 4, 2017.
