`On January 18, 2011, the Commission published its Supplement to the Strategic Human
`
`Capital Plan 2009-2013 (“Supplemental Plan”). In this plan, the Commission stated that on a trial
`
`basis the Office of Unfair Import Investigations was to implement new staffing approaches with
`
`respect to at least a portion of its caseload. In this regard, the Commission stated “OUII will cease
`
`to be a party altogether in a subset of section 337 cases.” Supplemental Plan at 19. At this
`
`juncture, due in part to a recent increase in complaint filings, OUII has identified the above-
`
`captioned investigation as a case in which OUII will cease to participate. Accordingly, OUII will
`
`not further participate in any stage of the investigation, including claim construction, discovery,
`
`motions practice and the evidentiary hearing.
