`Respondents Phitek Systems Limited (“Phitek”) and Creative Labs, Inc. (“Creative US”)

`(collectively hereafter “Respondents”) hereby submit their initial list of fact witnesses who may

`possess relevant evidence. Respondents will present the testimony of these witnesses live,

`through witness statements, or through their depositions, as permitted by the Ground Rules
`
`(Order No. 2). Inasmuch as certain aspects of discovery are continuing, Respondents reserve the
`
`right to supplement this list as warranted. Further, Respondents reserve the right to call and/or

`examine any witness listed on the witness list of Complainant Bose Corporation or any other
`
`Respondent, or any other party in this Investigation. Finally, Respondents reserve the right to
`
`call rebuttal or impeachment witnesses.
