`UNOPPOSED MOTION FOR TWO WEEK EXTENSION OF TIME TO RESPOND TO
`BOSE CORPORATION’S MOTIONS FOR SUMMARY DETERMINATION

`Pursuant to 19 C.F.R. § 210.15(d) and § 210.18, Respondents Phitek Systems Limited
`
`(NZ), Creative Labs, Inc., and Audio Technica, U.S. Inc. respectfully request a two (2) week
`
`extension of time to file responses to the three (3) separate motions for summary determination
`
`filed by Complaint Bose Corporation (“Bose”) on June 30, 2008. Bose does not oppose the
`
`filing of this motion or a two (2) week extension. Bose has agreed to the filing of this motion for
`
`a two (2) week extension of time. The Staff does not oppose a two (2) week extension of time.
`
`Bose filed three (3) motions for summary determination on June 30, 2008: (1) Bose
`
`Corporation’s Motion for Summary Determination on Prosecution History Estoppel, Prosecution
`
`Laches, and Inequitable Conduct Defenses; (2) Bose Corporation’s Motion for Summary
`
`Determination that the QuietComfort 2 Headset Practices at Least One Claim of Each Patent-in-
`
`Suit; and (3) Bose Corporation’s Motion for Summary Determination on Importation of Accused
`
`Products by Respondent Phitek Systems Limited. The court issued Order No. 11 on July 7,
`
`2008, extending the target date to August 6, 2009, and postponing the trial date in this
`
`investigation to December 4-12, 2008. During the parties third settlement conference, on July 9,
`
`2008, Complainant Bose and all Respondents agreed to a two (2) week extension of time to
`

`respond to Bose’s three (3) above-identified motions for summary determination. Thus, the
`
`Respondents respectfully request the court grant a two (2) week extension of time to the
`
`Respondents and Staff to respond to Bose’s three (3) motions for summary determination,
`
`making the Respondents’ responses due on July 24, 2008, and the Staff responses due thereafter.
