`COMMISSION INVESTIGATIVE STAFF'S UNOPPOSED MOTION FOR AN
`EXTENSION OF TIME TO FILE ITS PRE-HEARING BRIEF AND STATEMENT
`
`The Commission Investigative Staff (“Staff”) respectfully moves for an extension of time
`
`to file its pre-trial statement and brief. The Staff requests that the deadline be moved to October
`
`24, 2008.
`
`Under the current procedural schedule, the pre-trial statement and brief are due on
`
`October 2, 2008. However, the Staff attorney assigned to this Investigation is expected to have
`
`petitions for review and replies to petitions in Investigation No. 337-TA-604 due on October 6,
`
`and October 14, respectively. Moreover, the Staff attorney has a pre-trial brief due in
`
`Investigation No. 337-TA-619 on October 14. Accordingly, the Staff believes that additional

`time is necessary to fully address the issues that are relevant to this investigation.
`
`The Staff submits that the current procedural schedule allows for such an extension
`
`because the hearing in this investigation is not scheduled to take place until December 4-12,
`
` The Staff has simultaneously filed an unopposed motion for a one-week extension to
`1
`file its pre-hearing brief in Inv. No. 337-TA-619 on October 21 in order to provide more time to
`address the issues presented in that investigation.
`

`2008. No other dates in the procedural schedule will be affected by the requested extension. The
`
`private parties have been contacted and do not oppose the Staff’s motion.
