`JOINT MOTION TO MODIFY THE PROCEDURAL SCHEDULE
`
`The Commission Investigative Staff (“Staff”), Complainant Bose Corporation, Inc.
`
`(“Complainant”), and Respondents Phitek Systems Limited, Creative Labs, Inc., Audio-Technica
`
`U.S., Inc., and Panasonic of North America (“Respondents”) (collectively “the Parties”), move
`
`for an order modifying Order No. 12: Modifying the Procedural Schedule. The Parties request
`
`that the deadline for responding to motions in limine be moved to November 17, 2008, and the
`
`deadline for exchanging demonstrative exhibits be moved to November 20, 2008.
`
`Under the current procedural schedule, the deadline for submitting responses to motions
`
`in limine is November 10, 2008, and the deadline for exchanging demonstrative exhibits is
`
`November 13, 2008. The Parties are currently undertaking serious settlement negotiations and
`
`are optimistic that these negotiations will succeed. However, the next deadline for the Parties to
`
`submit responses to a total of twelve motions in limine is Monday, November 10, 2008 followed
`
`by a deadline of Thursday, November 13, 2008 to exchange demonstrative exhibits. This
`
`extension will not affect any other dates in the procedural schedule, including trial, which is
`
`currently scheduled for December 4-12, 2008.
`
`Accordingly, the Parties believe that the additional requested time will greatly assist the
`
`Parties in fully addressing the issues in the instant settlement negotiations.
