`REQUEST TO SUSPEND APPEAL
`
`Pursuant to T.B.M.P. Sec. 1213, Panasonic Corporation of North America
`(“Applicant”) respectfully submits this Request For Suspension of the above-referenced
`Appeal.
`
`Applicant’s Application for Applicants mark E-WEAR 8: Design as applied to
`digital camcorders, digital still cameras, digital audio players and digital voice recorders;
`liquid crystal display viewers for the viewing of videos, namely video monitors and dot-
`matrix SD-enabled printers for printing digitally recorded video images (“Applicants
`Mark”) has been refused registration on the following grounds: (1) likelihood of
`confusion with Registration No. 2,293,127 for the mark ELECTRONIC WEAR covering
`electronic cordless telephone accessories, namely, antennas, backup batteries, phone
`batteries, battery eliminators, electrical cables, carrying cases and protectors, cellular
`phones, electrical cigarette lighter socket adapters, electrical cellular connectors,
`electrical coaxial connectors, digital display units, telephone headsets, telephone
`microphones, power supplies, voice storage circuits, electrical cellular wire connectors
`and telephone mounts (the “Cited Mark”); and (2) that the E—WEAR element of
`Applicant’s Mark is descriptive and must be disclaimed.

`Applicant timely filed a Notice of Appeal on May 5, 2006.
`
`As discussed more fully below, upon information and belief, a Section 8
`Declaration of continued use (or excusable nonuse) was not filed with respect to the
`Cited Mark by the May 11, 2006 deadline, and therefore, the Cited Mark will be canceled
`in due course and will no longer bar registration of Applicant’s Mark. Applicant
`respectfully requests that action on this Appeal be suspended until it can be definitively
`determined whether the Cited Mark has been cancelled.
`
`ARGUMENT
`
`As indicated in the attached printout from the United States Patent and
`Trademark Office website, the Cited Mark was registered on November 11, 1999. A
`Section 8 Declaration of continued use had to be filed by November 11, 2005, with a six
`month grace period until May 11, 2006. See T.M.E.P. Sec. 1604.04 (explaining that
`“ [f] or registrations issued under the Trademark Act of 1946”, “the owner of the
`registration must file an affidavit or declaration of continued use or excusable nonuse”
`“on or after the fifth anniversary and no later than the sixth anniversary after the date of
`registration” “or the registration will be cancelled”; explaining that the affidavit or
`declaration “may be filed within a grace period of six months after the end of the
`deadline”).

`There is no indication on the attached printout, dated May 15, 2006, that the
`requisite Declaration was filed.

`Accordingly, Applicant respectfully requests that the instant Appeal be suspended
`pending a determination as to whether the requisite Declaration has been filed with
`respect to the Cited Mark. See T.B.M.P. Sec. 1213 (“prior to the issuance of the Board’s
`decision in an ex parte appeal, proceedings with respect to the appeal may be suspended
`by the Board upon written request by applicant showing good cause for the requested
`suspension. Examples of situations in which the Board may suspend proceedings in an
`appeal [include] .

`. A registration cited as a reference, under Section 2(d) of the Act

`In the event the requisite Declaration has not been filed with respect to the Cited
`Mark, it is respectfully submitted that the Cited Mark should no longer present an
`obstacle to registration, and the only issue remaining for appeal will be the whether the
`E-WEAR portion of Applicants Mark must be disclaimed.

`CONCLUSION
`
`For the foregoing reasons, Applicant respectfully requests that the Board suspend
`the instant Appeal pending determination as to whether the Cited Mark has been
`canceled for failure to file a Section 8 Declaration.
