`Pianos Etc. Inc., 3227 Natoma Way, Orlando, FL 32825, a corporation organized under the laws of

`Florida, (herein after “Opposer”) believes that it will be damaged by registration of the mark
`
` SN 86416292 in IC 15 as shown in the above-identified caption, and hereby opposes the
`
`registration of the same.
`
`
`
`Based upon information and belief, Opposer avers the following reasons why it will be damaged by the
`
`registration of the subject mark and why the public good would be harmed by the registration of the
`
`subject mark:
`
`
`
`1. This notice of opposition is timely under 37 C.F.R. § 2.102 being filed on April 5, 2021, after a
`
`30-day extension of time filed on 03/09/2021.
`
`2. The subject design mark application for
`
` was filed by Panasonic Corporation,
`
`1006, Oaza Kadoma, Kadoma-shi, Osaka JAPAN 571-8501 under Section 1(b), for: IC 15
`
`Guitars; Electronic musical instruments, namely, synthesizers, electronic pianos and organs;
`
`Electronic music producing unit for control of the synthesizers for production of electronic
`
`music; Computer controlled musical instruments, namely, piano module; Keyboard controller
`
`and electronic keyboard; Electronic automatically controlled rhythm machines; Expression
`
`pedals, musical instrument stands and carrying cases with a filing date of Oct. 06, 2014.
`
`3. The subject application has a long prosecution history which is automatically in the record. The
`
`subject application has been pending for 6.5 years at the time of this filing.
`

`STATUTORY CAUSE OF ACTION (AKA STANDING)
`
`4. Opposer has standing as a competitor of applicant if applicant, indeed, were in the musical
`
`instrument business in the US.
`
`5. Opposer has a real interest in preventing the registration of this mark. StuartSpector Designs,
`
`Ltd. v. Fender Musical Instruments Corp, 94 USPQ2d 1549, 1553 (TTAB 2009) (competitors
`
`and retailer of the goods in the applications have demonstrated a real interest in preventing
`
`registration of the proposed marks).
`
`6. Opposer has standing as the refused applicant of an identical word mark, TECHNICS for
`
`musical instruments. Opposer’s refusal of registration citing the subject application as a
`
`potential bar is attached as Exhibit A.
`
`LACK OF BONA FIDE INTENT AT THE TIME OF THE APPLICATION
`
`7. Pursuant to the Lanham Act § 1(b), 15 U.S.C. § 1501(b), this application is void because, at the
`
`time of filing the application, Panasonic did not have a bona fide intention to use the mark in
`
`commerce on the goods at issue. A bona fide intention in this context means "an actual, subjective
`
`state of mind" under "circumstances showing . . . good faith." See Aktieselskabet AF 21 November
`
`2001 v. Fame Jeans Inc., 525 F.3d 8, 21, 381 U.S. App. D.C. 76 (D.C. Cir. 2008).
`
`8. At the time of the application, Panasonic had no documentary evidence to support its allegation
`
`in the application of bona fide intent to use the mark in commerce on the subject IC 15 goods.
`
`9. Background on the lack of bona fide intent can be found from evidence in public records.
`
`10. SEC filings and annual reports for Panasonic show a movement by Panasonic away from
`
`consumer goods beginning prior to 2008 and the same SEC filings and annual reports show a
`
`complete lack of information regarding any investments in the subject goods.
`
`11. The last time that electronic musical instruments were even mentioned in Panasonic’s SEC filings
`
`was 2004.
`
`

`12. “Panasonic is a conglomerate that has diversified from its consumer electronics roots. It has five
`
`main business units: appliances (air conditioners, refrigerators, laundry machines, and TVs); life
`
`solutions (LED lighting, housing systems, and solar panels; connected solutions (PCs, factory
`
`automations, and in-flight entertainment systems); automotive (infotainment systems and
`
`rechargeable batteries); and industrial solutions (electronic devices). After the crisis in 2012,
`
`president Kazuhiro Tsuga has focused on shifting the business portfolio to increase the proportion
`
`of B2B businesses to mitigate the tough competition in consumer electronics products.”1
`
`13. Panasonics 2020 Annual Report discloses no current intent to manufacture or use in commerce
`
`the subject goods under the PANASONIC mark.
`
`14. None of the new business structures announced in the Panasonic Annual Report focus on the
`
`goods applied for in IC 15.
`

`16. Panasonics has no corporate reports filed with the SEC from 2012 to 2021 that disclose any plans
`
`to sell in commerce in the US any of the goods or product lines that include Guitars; Electronic
`
`

`musical instruments, namely, synthesizers, electronic pianos and organs; Electronic music
`
`producing unit for control of the synthesizers for production of electronic music; Computer
`
`controlled musical instruments, namely, piano module; Keyboard controller and electronic
`
`keyboard; Electronic automatically controlled rhythm machines; Expression pedals, musical
`
`instrument stands and carrying cases. This time period includes the time of the subject
`
`application and reasonable periods before and after.
`
`17. Panasonic has not sold any new models of Guitars; Electronic musical instruments, namely,
`
`synthesizers, electronic pianos and organs; Electronic music producing unit for control of the
`
`synthesizers for production of electronic music; Computer controlled musical instruments,
`
`namely, piano module; Keyboard controller and electronic keyboard; Electronic automatically
`
`controlled rhythm machines; Expression pedals, musical instrument stands and carrying cases
`
`since 2005.
`
`18. Panasonic had no plans to sell new models of Guitars; Electronic musical instruments, namely,
`
`synthesizers, electronic pianos and organs; Electronic music producing unit for control of the
`
`synthesizers for production of electronic music; Computer controlled musical instruments,
`
`namely, piano module; Keyboard controller and electronic keyboard; Electronic automatically
`
`controlled rhythm machines; Expression pedals, musical instrument stands and carrying cases
`
`when they filed the subject application in 2014.
`
`19. Panasonic had no plans to acquire any businesses already in the markets for the subject goods
`
`when it filed the subject application.
`
`20. Panasonic has not acquired any businesses already in the markets for the subject goods since it
`
`filed the subject application.
`
`21. Panasonic had no plans to include any new information regarding Guitars; Electronic musical
`
`instruments, namely, synthesizers, electronic pianos and organs; Electronic music producing unit
`
`for control of the synthesizers for production of electronic music; Computer controlled musical
`
`

`instruments, namely, piano module; Keyboard controller and electronic keyboard; Electronic
`
`automatically controlled rhythm machines; Expression pedals, musical instrument stands and
`
`carrying cases on its new revamped website for North America, na.panasonic.com, when the new
`
`website premiered in 2018 indicating no intent to resume use.
`
`22. USPTO records indicate that Panasonic had a previous registration for several musical
`
`instruments that is now abandoned after being surrendered by Panasonic.
`
`23. Panasonic’s previous registration, RN 1487415, was for ELECTRONIC ORGANS,
`
`ELECTRONIC KEYBOARDS, ELECTRONIC PIANOS AND ELECTRONIC RHYTHM
`
`SYNTHESIZERS.
`
`24. In the required maintenance filing under Section 8&9 for this RN 1487415 on April 10, 2008,
`
`USPTO records show Panasonic deleted and voluntarily surrendered the whole class 15
`
`containing ELECTRONIC ORGANS, ELECTRONIC KEYBOARDS, ELECTRONIC PIANOS
`
`AND ELECTRONIC RHYTHM SYNTHESIZERS from this registration.
`
`25. A reasonable business, who had a bona fide intent to use a mark in United States commerce,
`
`would have undertaken steps to avoid voluntarily surrendering their RN 1487415 registration
`
`for ELECTRONIC ORGANS, ELECTRONIC KEYBOARDS, ELECTRONIC PIANOS AND
`
`ELECTRONIC RHYTHM SYNTHESIZERS if they had an intent to resume.
`
`26. Voluntarily abandoning use in commerce of TECHNICS for ELECTRONIC ORGANS,
`
`ELECTRONIC KEYBOARDS, ELECTRONIC PIANOS AND ELECTRONIC RHYTHM
`
`SYNTHESIZERS with no intent to resume occurred in 2005 when Panasonic discontinued
`
`creating new inventory of these musical instruments and sold off their inventory.
`
`27. The discontinuation of less profitable consumer product lines has been a goal of Panasonic for
`
`many years and is well documented in their annual reports.
`
`28. TECHNICS disinterest in musical instruments has been clear for over a decade.
`

`29. In 2008, Panasonics allowed KIMBALL PIANO USA, INC. to register TECHNICS for musical
`
`instruments, namely, electronic and digital keyboard instruments of all kinds: electronic pianos,
`
`electronic keyboards, electronic organs, electronic synthesizers, digital pianos, digital
`
`keyboards, digital organs, digital synthesizers.
`
`30. This KIMBALL PIANO USA, INC. TECHNICS registration has been cancelled by opposer.
`
`31. Panasonics took no steps to cancel the KIMBALL PIANO USA, INC. RN 3548924 musical
`
`instruments mark after filing the subject application even though the KIMBALL PIANO mark
`
`had been cited as a bar to registration. The subject long list of goods in several ICs for the subject
`
`application has been held up for years because of the KIMBALL registration.
`
`32. Panasonics recently (June 5, 2018) allowed KIMBALL PIANO USA, INC. to register
`
`TECHNICS for t-shirts in RN 5486208.
