`NOTICE OF OPPOSITION

`AstroNova, Inc., a Rhode Island Corporation, (“Opposer”) believes that it would be
`
`damaged by registration of the mark ASTROVA (the “Applied-For Mark”), the subject of
`
`Application Serial No. 97/451,321 (the “Application”), owned by Panasonic Avionics
`
`Corporation (“Applicant”).
`
`Opposer states as follows:
`
`1.
`
`Opposer applies its data visualization technology to create products that deliver
`
`accuracy, efficiency, and performance across a broad range of end-user markets.
`
`2.
`
`Since at least as early as 2016, Opposer has used its trademark ASTRONOVA in
`
`connection with its high-quality products.
`
`3.
`
`Opposer owns Registration No. 5,228,691 for the mark ASTRONOVA. A true
`
`and correct copy of the records of Opposer’s registration from the USPTO’s TESS and
`
`Assignments databases are attached hereto as Exhibit A.
`
`4.
`
`Opposer’s registration covers, among other things, “Apparatus for recording data,
`
`telemetry, sound, and video; printers; printers for aerospace applications; computer software and
`

`downloadable computer software for data analysis; computer software and downloadable
`
`computer software for design and printing of labels; blank USB flash drives; probes for testing
`
`electronic circuits; ethernet switches; ethernet switches for aerospace applications” in Class 9.

`The Application was filed on June 9, 2022, on the basis of an intent to use, and no
`
`amendment to allege use has been filed.
`

`The Applied-For Mark, ASTROVA, is highly similar to Opposer’s
`
`ASTRONOVA trademark, in sight, sound, and commercial impression. The marks differ by two
`
`internal letters, comprising a single syllable.
`
`7.
`
`The Application’s broad description of goods includes those that are identical,
`
`similar, and highly related to Opposer’s.
`
`COUNT I – Likelihood of Confusion
`

`
`Opposer has priority in its ASTRONOVA trademark dating back to 2015.
`
`On information and belief, Applicant had no rights or prospective rights in the
`
`Applied-For Mark prior to June 2022.
`

`
`The Applied-For Mark, in connection with the goods set forth in the Application,
`
`is likely to cause confusion, mistake, or deception as to the source, affiliation, sponsorship, or
`
`approval of Applicant’s services, to Opposer’s damage and detriment.
`
`WHEREFORE, Opposer requests that registration of the Applied-For Mark, ASTROVA,
`
`Application Serial No. 97/451,321, be denied, and that this opposition be sustained.
