`The present application is being examined underthe pre-AlA first to invent
`
`provisions.
`
`FINAL OFFICE ACTION
`
`Claim Rejections - 35 USC § 112
`
`The following is a quotation of 35 U.S.C. 112(b):
`(b) CONCLUSION.—The specification shall conclude with one or more claims particularly
`pointing out and distinctly claiming the subject matter which the inventor or a joint inventor
`regards as the invention.
`
`The following is a quotation of 35 U.S.C. 112 (pre-AlA), second paragraph:
`The specification shall conclude with one or more claims particularly pointing out and distinctly
`claiming the subject matter which the applicant regards as his invention.
`
`1.
`
`Claims 1-4 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AlA),
`
`second paragraph, as being indefinite for failing to particularly point out and distinctly
`
`claim the subject matter which the inventor or a joint inventor, or for pre-AlA the
`
`applicant regards as the invention.
`
`Regarding claim 1, the limitation of "a second substrate composedofflexible
`
`material to face the second substrate facing the first substrate”is indefinite, because the
`
`phrase “to face the second substrate facing the first substrate” is unclear. The claimed
`
`limitation requires the second substrate to face the second substrate, and thus, the
`
`metes and bounds of the claim cannot be determined.
`
`It is unclear how a substrate can
`
`face itself? Claims 2-4 depend from claim 1, and thus, are also rejected from the same
`
`issue. For examination purposes, the limitation will be interpreted in the following
`
`manner:
`
`--a second substrate composedofa flexible material, the second substrate facing
`
`the first substrate--.

`
`Claim Rejections - 35 USC § 103
`
`2.
`
`The following is a quotation of pre-AIA 35 U.S.C. 103(a) which forms the basis
`
`for all obviousnessrejections set forth in this Office action:
`
`(a) A patent may not be obtained though the invention is not identically disclosed or described
`as set forth in section 102, if the differences between the subject matter sought to be patented
`andthe prior art are such that the subject matter as a whole would have been obvious at the
`time the invention was made to a person having ordinary skill in the art to which said subject
`matter pertains. Patentability shall not be negatived by the manner in whichthe invention was
`made.
`
`This application currently namesjoint inventors. In considering patentability of the
`
`claims under pre-AlA 35 U.S.C. 103(a), the examiner presumes that the subject matter
`
`of the various claims was commonly ownedatthe time any inventions coveredtherein
`
`were made absent any evidence to the contrary. Applicant is advised of the obligation
`
`under 37 CFR 1.56 to point out the inventor and invention dates of each claim that was
`
`not commonly ownedatthe time a later invention was madein orderfor the examinerto
`
`consider the applicability of pre-AIA 35 U.S.C. 103(c) and potential pre-AIA 35 U.S.C.
`
`102(e), (f) or (g) prior art under pre-AIA 35 U.S.C. 103(a).
`
`3.
`
`Claims 1-4 are rejected under pre-AlA 35 U.S.C. 103(a) as being unpatentable
`
`over Applicant's Admitted Prior Art (hereinafter, AAPA; US Pub. No. 2015/0309382is
`
`referred to in the rejections below) in view of Akiyama et al. (US 2003/0184704; cited by
`
`Applicant, hereinafter, Akiyama).
`
`Regarding claim 1, AAPA discloses a display device (Figs. 6 and 7, § [0006])
`
`comprising:
`
`a first substrate SUB1 (Fig. 7, § [O006}]);
`
`a TFTlayer TFT (Fig. 7, § [0006]) formed abovethe first substrate SUB1 (Fig. 7);
`
`

`

`Application/Control Number: 14/791 ,541
`Art Unit: 2896
`
`Page 4
`
`a display area LC (Fig. 7) including a plurality of display elements (Fig. 7, 7
`
`[0006]: liquid crystal display elements) formed above the TFT layer TFT (Fig. 7);
`
`a wiring connection portion TMA (Fig. 7, [0007]) outside the display area LC
`
`(Fig. 7) of the first substrate SUB1 (Fig. 7), the wiring connection portion (TMA) having a
`
`plurality of terminals ( [0007]: it is implicit that wiring connection portion TMA has a
`
`plurality of terminals),
`
`a second substrate SUB2 (Fig. 7, [0006]) facing the first substrate SUB1 (Fig.
`
`7);
`
`a first adhesive SL (Fig. 7, § [0006]) formed betweenthe first substrate SUB1
`
`(Fig. 7) and the second substrate SUB2(Fig. 7), the first adhesive surrounding the
`
`display area LC (Fig. 7) in plan view (Figs. 6 and 7); and
`
`a wiring substrate FPC (Figs. 6 and 7, 4 [0007]) connected to the plurality of
`
`terminals TMA ( [0007)),
`
`wherein the first adhesive SL (Fig. 7) does not overlap with the wiring connection
`
`portion TMA (Fig. 7) in plan view (Figs. 6 and 7, ¥ [0007]).
`
`Thus, AAPAdisclosesall the limitations of the claim with the exception of
`
`disclosing:
`
`(i) wherein the first and second substrate are composedofa flexible material;
`
`and
`
`(ii) a second adhesive formed betweenthe first substrate and the second
`
`substrate and overlapping the display area in plan view; and
`
`

`

`Application/Control Number: 14/791 ,541
`Art Unit: 2896
`
`Page 5
`
`(iii) wherein the wiring connection portion and the wiring substrate are
`
`sandwiched between the first substrate and the second adhesive.
`
`However, Akiyama discloses an analogous display device (Figs. 32A-32B)
`
`comprisingafirst flexible substrate 104 (Fig. 32B, { [0078]: “first plastic substrate 104”),
`
`and a secondflexible substrate 107 (Fig. 32B, {| [0081]: “second plastic substrate 107”)
`
`facing the first flexible substrate 104 (Fig. 32B). Akiyama further disclosesa first
`
`adhesive 108 (Fig. 32B, [0088]: “epoxy-based adhesive”) betweenthefirst and
`
`second substrate 104, 107 (Fig. 32B); and a second adhesive 901 (Fig. 32B, 4 [0189]:
`
`"layer 901 was formed using an acryl-based adhesive”) betweenthe first and second
`
`substrate 104, 107 (Fig. 32B), wherein the second adhesive 901 (Fig. 32B) overlaps the
`
`display area 102 (Fig. 32A-32B) in plan view (Fig. 32A). Akiyama further discloses
`
`wherein the wiring connection portion 110 (Fig. 32B, § [0087]) and the wiring substrate
`
`317 (Fig. 32B) are sandwiched betweenthefirst substrate 104 (Fig. 32B) and the
`
`second adhesive 901 (Fig. 32B).
`
`Therefore, it would have been obvious to one ofordinary skill in the art at the
`
`time of the invention, to combine the teachings of AAPA and Akiyama, and form the first
`
`and second substrates comprising a flexible material, and form a second adhesive
`
`betweenthefirst and second substrate and overlapping the display area, and wherein
`
`the wiring connection portion and the wiring substrate are sandwiched betweenthe first
`
`substrate and the second adhesive, for the purposeof increasing the flexibility of the
`
`substrates and improving the sealing of the peripheral region of the display device

`Page 6
`
`(Akiyama: § [0189]: “improving the strength in the peripheral region"), and thus,
`
`improving the reliability and performanceof the display device.
`
`Regarding claim 2, AAPAin view of Akiyama disclose the display device of claim
`
`1, as set forth above. Akiyama further discloses a TFT layer (j [0087]: “TFT array using
`
`low-temperature polysilicon as an active layer") formed on thefirst substrate 104 (Fig.
`
`14B). Akiyamafurther discloses an inorganic insulating layer 315 (Fig. 14B) including a
`
`silicon nitride (J [0118]: “silicon nitride”) betweenthe first substrate 104 (Fig. 14B) and
`
`the TFT layer 302/303 (Fig. 14B, {| [0114]: “polysilicon film including an active layer
`
`302”). Therefore, it would have been obvious to one of ordinary skill in the art at the
`
`time of the invention, to incorporate the teaching of Akiyama, and formasilicon nitride
`
`betweenthefirst substrate and the TFTlayer, for the purposeof improving the isolation
`
`and adhesion between the TFT layer and the substrate.
`
`Regarding claim 3, AAPA further discloses wherein the wiring substrate is a
`
`flexible printed circuit (AAPA: Fig. 7, { [0007]: “FPC’).
`
`Regarding claim 4, AAPA in view of Akiyama discloses the display device of
`
`claim 1, as set forth above. Akiyamafurther discloses wherein the first adhesive 901
`
`(Fig. 32B) and the second adhesive 108 (Fig. 32B) are in contact with each other (Fig.
`
`32B)in at least a part of peripheral region of the display area 102 (Fig. 32B).

`
`4.
`
`Claims 8 and 10 are rejected under pre-AlA 35 U.S.C. 103(a) as being
`
`unpatentable over Applicant's Admitted Prior Art (hereinafter, AAPA; US Pub. No.
`
`2015/0309382 is referred to in the rejections below) in view of Maruyamaetal. (US
`
`2007/0254456; hereinafter Maruyama).
`
`Regarding claim 1, AAPA discloses a display device (Figs. 6 and 7, § [0006])
`
`comprising:
`
`a first substrate SUB1 (Fig. 7, § [O006}]);
`
`a TFT layer TFT (Fig. 7, § [0006]) abovethefirst substrate SUB1 (Fig. 7);
`
`a display area LC (Fig. 7) including a plurality of display elements (Fig. 7, 7
`
`[0006]: liquid crystal display elements) formed above the TFT layer TFT (Fig. 7);
`
`a wiring connection portion TMA (Fig. 7, { [0007]) outside the display area LC
`
`(Fig. 7) of the first substrate SUB1 (Fig. 7), the wiring connection portion (TMA) having a
`
`plurality of terminals (4 [0007]: it is implicit that wiring connection portion TMA has a
`
`plurality of terminals),
`
`a second substrate SUB2 (Fig. 7, [0006]) facing the first substrate SUB1 (Fig.
`
`7);
6 and 7, 4 [0007]) connected to the plurality of
`
`terminals TMA ( [0007)),
`
`

`

`Application/Control Number: 14/791 ,541
`Art Unit: 2896
`
`Page 8
`
`wherein the first adhesive SL (Fig. 7) does not overlap with the wiring connection
`
`portion TMA(Fig. 7) in plan view (Figs. 6 and 7, § [0007]), and the first adhesive does
`
`not make contact with a side surface of the second substrate.
`
`Thus, AAPAdisclosesall the limitations of the claim with the exception of
`
`disclosing:
`
`(i) a second adhesive formed betweenthe first substrate and the second
`
`substrate; and
`
`(ii) wherein the wiring connection portion and the wiring substrate are
`
`sandwiched between the first substrate and the second adhesive, and the second
`
`adhesive does not makecontact with a side surface of the second substrate.
`
`However, Maruyama discloses an analogous display device (Figs. 8-9)
`
`comprising a first substrate 810 (Fig. 9, 4 [0132]) and a second substrate 820 (Fig. 9,
`
`[0134]), wherein the first and second substrate 810, 820 (Fig. 9) are composed of a
`
`flexible material ({ [0132]-[0134]: “flexible substrate 810”, “flexible substrate 820”).
`
`Maruyamafurther discloses a second adhesive 817 (Fig. 9, § [0135]) formed between
`
`the first substrate 810 (Fig. 9) and the second substrate 820 (Fig. 9) and overlapping
`
`the display area (Fig. 9: “Pixel Portion”); and a wiring connection portion (Fig. 9:
`
`“Terminal Portion", {| [0136]: “terminal electrode") formed on the first substrate 810 (Fig.
`
`9). Maruyama further discloses wherein the wiring connection portion (Fig. 9, 4 [0136]:
`
`“terminal electrode") and the wiring substrate 832 (Fig. 9) are sandwiched between the
`
`first substrate 810 (Fig. 9) and the second adhesive 817 (Fig. 9), and wherein the
`
`

`

`Application/Control Number: 14/791 ,541
`Art Unit: 2896
`
`Page 9
`
`second adhesive 817 (Fig. 9) does not make contact with a side surface of the second
`
`substrate 820 (Fig. 9).
`
`Therefore, it would have been obvious to one ofordinary skill in the art at the
`
`time of the invention, to combine the teachings of AAPA and Maruyama, and form a
`
`second adhesive betweenthe first and second substrate, and wherein the wiring
`
`connection portion and the wiring substrate are sandwiched betweenthe first substrate
`
`and the second adhesive, for the purpose of improving the sealing of the display device
`
`(Maruyama: 4 [0130]), and thus, improving thereliability and performanceof the display
`
`device.
`
`Regarding claim 10, AAPA in view of Maruyamafurther discloses wherein the
`
`wiring substrate is a flexible printed circuit (AAPA: Fig. 7, {| [0007]: “FPC”) (Maruyama:
`
`Fig. 9, | [0136]: “flexible printed circuit").
`
`5.
`
`Claims 9 and 11 are rejected under pre-AlA 35 U.S.C. 103(a) as being
`
`unpatentable over AAPA(cited above) in view Maruyama (cited above), as applied to
`
`claim 8 above, and furtherin view of Akiyama (US 2003/0184704; cited above).
`
`Regarding claim 9, AAPAin view of Maruyama disclose the display device of
`
`claim 8, as set forth above. However, the combination of AAPA in view of Maruyama
`
`doesnotexplicitly disclose an inorganic insulating layer including a silicon nitride
`
`betweenthefirst substrate and the TFT layer.
`
`However, Akiyama discloses an analogous display device (Fig. 14B) comprising
`
`a first flexible substrate 104 (Fig. 14B, {J [0078]: “first plastic substrate 104”), and a
`
`

`

`Application/Control Number: 14/791 ,541
`Art Unit: 2896
`
`Page 10
`
`second flexible substrate 107 (Fig. 14B, {| [0081]: “second plastic substrate 107”) facing
`
`the first flexible substrate 104 (Fig. 14B). Akiyama further discloses a TFT layer (
`
`[0087]: “TFT array using low-temperature polysilicon as an active layer") formed on the
`
`first substrate 104 (Fig. 14B). Akiyama further discloses an inorganic insulating layer
`
`315 (Fig. 14B) including a silicon nitride (qj [0118]: “silicon nitride”) between the first
`
`substrate 104 (Fig. 14B) and the TFT layer 302/303 (Fig. 14B, {J [0114]: “polysilicon film
`
`including an active layer 302”). Therefore, it would have been obvious to one of
`
`ordinary skill in the art at the time of the invention, to incorporate the teaching of
`
`Akiyama, and formasilicon nitride betweenthe first substrate and the TFTlayer, for the
`
`purposeof improving the isolation and adhesion between the TFT layer and the
`
`substrate.
`
`Regarding claim 11, AAPA in view of Maruyama disclosesthe display device of
`
`claim 8, as set forth above. However, the combination does notexplicitly disclose
`
`wherein the first adhesive and the second adhesive are in contact with each otherin at
`
`least a part of peripheral region of the display area. However, Akiyama discloses an
`
`analogous display device (Figs. 32A-32B) comprisingafirst flexible substrate 104 (Fig.
`
`32B, J [0078]: “first plastic substrate 104”), and a second flexible substrate 107 (Fig.
`
`32B, J [0081]: “second plastic substrate 107”) facing the first flexible substrate 104 (Fig.
`
`32B). Akiyama further discloses a first adhesive 106/901 (Fig. 32B, 4 [0188]) and a
`
`second adhesive 103 (Fig. 32B, § [0188]) formed betweenthefirst and second
`
`substrate 104, 107 (Fig. 32B), wherein the first adhesive 106/901 (Fig. 32B) and the
`
`

`

`Application/Control Number: 14/791 ,541
`Art Unit: 2896
`
`Page 11
`
`second adhesive 103 (Fig. 32B) are in contact with each other (Fig. 32B) in at least a
`
`part of peripheral region of the display area 102 (Fig. 32B).
`
`Therefore, it would have been obvious to one of ordinary skill in the art at the
`
`time of the invention, to incorporate the teaching of Akiyama, and havethe first
`
`adhesive and the second adhesive in contact with each otherin at least a part of
`
`peripheral region of the display area, for the purpose of improving the sealing of the
`
`display area, and thus, improving the reliability of the display device.
`
`6.
`
`Applicant's argumentsfiled 4/26/2017 have been fully considered but they are
`
`Response to Arguments
`
`not persuasive.
`
`Regarding the combination of AAPA, Maruyama and Akiyama, Applicant argues
`
`that the combination at of the teachings “would at best embodya structure wherein a
`
`second adhesive is under the TFT layer. The combination of AAPA, Maruyama and
`
`Akiyama cannot and does not embody any structure or operation wherein a wiring
`
`substrate and/or a wiring connection portion is sandwiched betweena first substrate
`
`and a second adhesive, as in the claimed invention. The argumentis not persuasive for
`
`the reasons setforth below.
`
`Regarding the new limitations in claim 1:
`
`AAPAdiscloses wherein thefirst adhesive SL (Fig. 7) does not overlap with the
`
`wiring connection portion TMS (Fig. 7, § [0007]). Furthermore, Akiyama discloses a
`
`second a second adhesive 901 (Fig. 32B, § [0189]: "layer 901 was formed using an
`
`

`

`Application/Control Number: 14/791 ,541
`Art Unit: 2896
`
`Page 12
`
`acryl-based adhesive”) between the first and second substrate 104, 107 (Fig. 32B),
`
`wherein the second adhesive 901 (Fig. 32B) overlaps the display area 102 (Fig. 32A-
`
`32B) in plan view (Fig. 32A). Akiyama further discloses wherein the wiring
`
`connection portion 110 (Fig. 32B, J [0087]) and the wiring substrate 317 (Fig. 32B)
`
`are sandwiched between thefirst substrate 104 (Fig. 32B) and the second
`
`adhesive 901 (Fig. 32B). Therefore, it would have been obvious to one of ordinary skill
`
`in the art at the time of the invention, to combine the teachings of AAPA and Akiyama,
`
`and form the first and second substrates comprising a flexible material, and form a
`
`second adhesive betweenthe first and second substrate and overlapping the display
`
`area, and wherein the wiring connection portion and the wiring substrate are
`
`sandwiched betweenthefirst substrate and the second adhesive, for the purposeof
`
`increasing theflexibility of the substrates and improving the sealing of the peripheral
`
`region of the display device (Akiyama: {[ [0189]: “improving the strength in the peripheral
`
`region"), and thus, improving the reliability and performanceof the display device.
`
`Regarding new claim 8:
`
`AAPAdisclosesall the limitations of claim 8, as set forth in the rejection above,
`
`with the exception of disclosing: (i) a second adhesive formed betweenthe first
`
`substrate and the second substrate; and (il) wherein the wiring connection portion and
`
`the wiring substrate are sandwiched betweenthe first substrate and the second
`
`adhesive, and the second adhesive does not make contact with a side surface of the
`
`second substrate.

`
`However, Maruyama discloses an analogous display device (Figs. 8-9)
`
`comprising a first substrate 810 (Fig. 9, [0132]) and a second substrate 820 (Fig. 9, |
`
`9). Maruyamafurther discloses wherein the wiring connection portion (Fig. 9,
`
`[0136]: “terminal electrode") and the wiring substrate 832 (Fig. 9) are sandwiched
`
`between the first substrate 810 (Fig. 9) and the second adhesive 817 (Fig. 9), and
`
`wherein the second adhesive 817 (Fig. 9) does not make contact with a side
`
`surface of the second substrate 820 (Fig. 9). Therefore, it would have been obvious
`
`to one of ordinary skill in the art at the time of the invention, to combine the teachings of
`
`AAPAand Maruyama, and form a second adhesive betweenthe first and second
`
`substrate, and wherein the wiring connection portion and the wiring substrate are
`
`sandwiched betweenthefirst substrate and the second adhesive, for the purposeof
`
`improving the sealing of the display device (Maruyama: § [0130]), and thus, improving
`
`the reliability and performance of the display device.
