`The present application, filed on or after March 16, 2013, is being examined under the

`first inventor to file provisions of the AIA.

`Claim Rejections - 35 US C § 112

`The following is a quotation of 35 U.S.C. 112(b):
`(b) CONCLUSION.7The specification shall conclude with one or more claims particularly pointing
`out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the
`invention.

`The specification shall conclude with one or more claims particularly pointing out and distinctly
`claiming the subject matter which the applicant regards as his invention.

`Claims 1—12 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre—AIA), second
`
`paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject
`
`matter which the inventor or a joint inventor, or for pre—AIA the applicant regards as the
`
`invention. Regarding claims 1 and 8, the applicant claims “in a provisionally fixed state of the
`
`first lens frame and the third lens frame, the third lens frame is movable in a radial direction with
`
`respect to the first lens frame”, however, it is unclear to the Examiner as to how the third lens
`
`frame can be movable and fixed at the same time (i.e. is it fixed in the axial direction and the
`
`circumvolving directions, but, also movable in the radial direction at the same time; is it fixed
`
`only in the axial direction, but, also movable in the radial and circumvolving directions, etc.).
`
`For purposes of expediting prosecution the examiner interprets that the third lens frame is ——
`
`fixed only in the axial direction, but, also movable in the radial and circumvolving directions——.
`

`Applicant’s arguments with respect to claims 1—12 have been considered but are moot
`
`because the arguments do not apply to any of the references being used in the current rejection.

`Claims 1—12 would be allowable if rewritten or amended to overcome the rejection(s)

`under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre—AIA), 2nd paragraph, set forth in this Office action

`(note; the Examiner points out that the claims would be allowable only if applicant were to
`
`amend the claims to incorporate limitations where the third lens frame is fixed only in the axial
`
`direction, but, also movable in the radial and circumvolving directions).

`Applicant's amendment necessitated the new ground(s) of rejection presented in this
`
`Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a).

`A shortened statutory period for reply to this final action is set to expire THREE
