`
`Claim Rejections - 35 U5C§103
`
`3.
`
`The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness
`
`rejections set forth in this Office action:
`
`A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not
`identically disclosed as set forth in section 102, if the differences between the claimed invention and the
`prior art are such that the claimed invention as a whole would have been obvious before the effective filing
`date of the claimed invention to a person having ordinary skill in the art to which the claimed invention
`pertains. Patentability shall not be negated by the manner in which the invention was made.
`
`4.
`
`Claims 1-3, 6-9 are rejected under 35 U.S.C. 103 as being unpatentable over Smith et al.,
`
`hereinafter referred to as Smith (US 2016 / 0105644 A1 — already of record) in view of Ezoe et al.,
`
`hereinafter referred to as Ezoe (US 2011 / 0234832 A1).
`
`As per claim 1, Smith discloses a monitoring camera system (i.e., 100),
`
`comprising: a camera (i.e., 101), and a master device (i.e., 102, 1000 collectively act as a master
`
`device),
`
`which, in operation, communicates with the camera (i.e., 101) and a mobile communication terminal
`
`(i.e., 103) having a display (Smith: Abstract, Figure 1, [0082], [0097], [0215]; A monitoring system
`
`seen in figure 1 includes at least one camera 101, and a master device (102, 1000), that communicate
`
`to a client device 103.),
`
`wherein the camera, in operation, detects movement and captures a first image at a first timing in an
`
`imaging area (Smith: [0086]-[0088], [0093], [0095], [0098], [0103], [0105]; Figure 2L; Camera 101
`
`detects motion and captures a first image at a first timing in an imaging area.),
`
`captures a second image at a second timing after the first timing in the imaging area (Smith: [0086]-
`
`[0088], [0093], [0095], [0098], [0103], [0105]; Figure 2L; Camera 101 captures a second image after the
`
`first timing in the imaging area using timer 211.),
`
`
`
`Application/Control Number: 16/129,057
`Art Unit: 2488
`
`Page 4
`
`and transmits a predetermined notification to the master device in response to the second image
`
`being captured (Smith: [0086]-[0088], [0093], [0098], [0103], [0105], [0215], Figure 2L; The camera 101
`
`includes a motion detector 204 and detects movement at a first timing and captures video. Timer 211
`
`is set to send another wakeup signal to camera 101 to capture an image after the first detected
`
`motion captured image. The same wakeup signal allows camera 101 to send a predetermined
`
`notification to the master device (102, 1000). The first and second timing result in a before and after
`
`notification, which is defined as a predetermined notification as described in the applicant’s
`
`specification page 17, lines 10-16 and page 26, lines 3-9.),
`
`wherein the master device, in operation, transmits, in response to the predetermined notification
`
`transmitted from the camera being received by the master device, an image request for requesting
`
`the first image and the second image to the camera (Smith: [0086]-[0088], [0093], [0095], [0098],
`
`[0103], [0105], [0215]; Figure 2L; After the master device (102, 1000) receives the predetermined
`
`notification, the master device (102, 1000) requests the first and second captured videos.),
`
`wherein the camera, in operation, transmits, in response to the image request transmitted from the
`
`master device being received by the camera, the first image and the second image together to the
`
`master device (Smith: [0086]-[0088], [0093], [0095], [0098], [0103], [0105], [0215]; Figure 2L; The
`
`camera 101 sends the captured images to master device (102, 1000) based the request.),
`
`and wherein the master device, in operation, transmits, in response the first image and the second
`
`image being received by the master device, the first image and the second image together to the
`
`mobile communication terminal to be displayed on the display (Smith: [0086]-[0088], [0093], [0095],
`
`[0098], [0103], [0105], [0215]; Figure 2L; The master device (102, 1000) sends the captured images to
`
`client device 103 for display).
`
`However Smith does not explicitly disclose “. .. wherein the camera, in operation, transmits
`
`the first image and the second image together
`
`the first image and the second image together
`
`to the mobile communication terminal.”
`
`
`
`Application/Control Number: 16/129,057
`Art Unit: 2488
`
`Page 5
`
`Further, Ezoe is in the same field of endeavor and teaches wherein the camera, in operation,
`
`transmits the first image and the second image together (Ezoe: [0063]; Images captured by the
`
`camera 200 are transmitted to a client 400 via the network 500, and a first panorama image and a
`
`second panorama image are displayed on a display screen of the client 400 together with a live
`
`image.);
`
`the first image and the second image together to the mobile communication terminal (Ezoe: [0063];
`
`Images captured by the camera 200 are transmitted to a client 400 via the network 500, and a first
`
`panorama image and a second panorama image are displayed on a display screen of the client 400
`
`together with a live image.).
`
`Therefore, it would have been obvious to one of ordinary skill in the art before the effective
`
`filing date of the claimed invention, and having the teachings of Smith and Ezoe before him or her,
`
`to modify the camera system of Smith to include the together images feature as described in Ezoe.
`
`The motivation for doing so would have been to improve image viewing by providing multiple
`
`angles of view (Ezoe: [0010], [0166]).
`
`As per claim 2, Smith—Ezoe disclose the system of claim 1, wherein the second timing is a
`
`timing at which detection of the movement by the camera has ended (Smith: [0086]-[0088], [0093],
`
`[0098], [0103], [0105], [0215], Figure 2L; Timer 211 sends multiple wakeup signals to camera 101 that
`
`allow the camera to be configured to capture images. The camera does not have to rely on motion
`
`detection to capture an image.).
`
`As per claim 3, Smith—Ezoe disclose the system of claim 1, wherein the second timing is a
`
`timing at which a predetermined time period has elapsed from the first timing (Smith: [0086]-[0088],
`
`[0093], [0098], [0103], [0105], [0215], Figure 2L; Timer 211 can set multiple timings at which a
`
`predetermined time period has elapsed from the first timing.).
`
`
`
`Application/Control Number: 16/129,057
`Art Unit: 2488
`
`Page 6
`
`As per claim 6, Smith discloses the system of claim 1, wherein the first image and the
`
`second image are displayed side—by—side in the display of the mobile communication terminal (Smith:
`
`[0134], [0174], Figures 6A-6F, 8B; The captured images are displayed on the user’s mobile device
`
`communication device 103).
`
`However, Smith does not explicitly disclose “. .. wherein the first captured image and the
`
`second captured image are displayed side by side.”
`
`Further, Ezoe teaches wherein the first image and the second image are displayed side by
`
`side (Ezoe: Figs. 19, 27; [0063], [0135], [0149]; The first image and the second image are displayed on
`
`a display screen.).
`
`Therefore, it would have been obvious to one of ordinary skill in the art before the effective
`
`filing date of the claimed invention, and having the teachings of Smith and Ezoe before him or her,
`
`to modify the camera system of Smith to include the side—by—side image feature as described in
`
`Ezoe. The motivation for doing so would have been to improve image viewing by providing
`
`multiple angles of view (Ezoe: [0010], [0166]).
`
`As per claim 7, Smith discloses a monitoring method for a monitoring camera system
`
`including a camera (i.e., 100) and a master device (i.e., 102, 1000 collectively act as a master device) in
`
`communication with the camera (i.e., 101) and a mobile communication terminal (i.e., 103) having a
`
`display (Smith: Abstract, Figure 1, [0082], [0097], [0215]; A monitoring system seen in figure 1
`
`includes at least one camera 101, and a master device (102, 1000), that communicate to a client device
`
`103.),
`
`the monitoring method comprising: detecting, by the camera, movement at a first timing in an
`
`imaging area (Smith: [0086]-[0088], [0093], [0095], [0098], [0103], [0105]; Figure 2L; Camera 101
`

`
`capturing, by the camera, a first image at the first timing in the imaging area (Smith: [0086]-[0088],
`

`
`image at a first timing in an imaging area.);
`
`capturing, by the camera, a second image at a second timing after the first timing in the imaging area
`
`(Smith: [0086]-[0088], [0093], [0095], [0098], [0103], [0105]; Figure 2L; Camera 101 captures a second
`
`image after the first timing in the imaging area using timer 211.);
`
`transmitting, by the camera, a predetermined notification to the master device in response to the
`
`second image being captured (Smith: [0086]-[0088], [0093], [0098], [0103], [0105], [0215], Figure 2L;
`
`The camera 101 includes a motion detector 204 and detects movement at a first timing and captures
`
`video. Timer 211 is set to send another wakeup signal to camera 101 to capture an image after the
`
`first detected motion captured image. The same wakeup signal allows camera 101 to send a
`
`predetermined notification to the master device (102, 1000). The first and second timing result in a
`
`before and after notification, which is defined as a predetermined notification as described in the
`
`applicant’s specification page 17, lines 10-16 and page 26, lines 3-9.);
`
`transmitting, by the master device and in response to the predetermined notification transmitted
`
`from the camera being received by the master device, an image request for requesting the first image
`
`and the second image to the camera (Smith: [0086]-[0088], [0093], [0095], [0098], [0103], [0105],

`
`the first image and the second image together to the mobile
`

`
`Further, Ezoe is in the same field of endeavor and teaches transmitting, by the camera the
`
`first image and the second image together (Ezoe: [0063]; Images captured by the camera 200 are

`
`predetermined time period elapses from a first timing and resumes processing of detecting the

`
`Therefore, it would have been obvious to one of ordinary skill in the art before the effective
`
`filing date of the claimed invention, and having the teachings of Smith—Ezoe and Borg before him or
`
`her, to modify the motion detection system of Smith—Ezoe to include the discontinue processing
`
`feature as described in Borg. The motivation for doing so would have been to improve reduction in
`
`power by providing power—conserving means which turns on power to the camera and
`
`theprocessing and communication circuits onlywhen they are being used (Borg: col 1, lines 58-61).
`
`As per claim 5, Smith—Ezoe disclose the system of claim 3, wherein the camera, in
`
`operation, discontinues processing of deteetrng—the—movement [camera function] until a
`
`predetermined time period elapses from the first timing and resumes processing of detest-ing—t—he
`
`movement [camera function] after the predetermined time period has elapsed from the first timing
`
`(Smith: [0093]; Camera discontinues processing by operating in a sleep state in one predetermined
`
`time period and wakes up to process and capture images at another predetermined time period,
`
`while the motion sensor remains powered.).
`
`However Smith—Ezoe do not explicitly disclose “. .
`
`. discontinues processing of detecting the
`
`movement until a predetermined time period elapses from the first timing and resumes processing
`
`of detecting the movement after the predetermined time period has elapsed from the first timing.”
`
`Further, Borg is in the same field of endeavor and teaches discontinues processing of
`
`detecting the movement until a predetermined time period elapses from the first timing and resumes
`
`processing of detecting the movement after the predetermined time period has elapsed from the first
`
`timing (Borg: col 2, lines 35-52; An infrared sensor 3 detects people and operates in a 15 second

`
`period elapses from a first timing and resumes processing of detecting the motion after the second
`
