Application No.: 16/718,910
`
`Docket No.: P191327US00
`
`REMARKS
`
`By this Supplemental Amendment, claims 1-9 are pending. Claim 1 is amended. A new
`
`claim 9 is added. Please consider the additional amendment above together with the Amendment
`
`and Remarkspreviously filed on August 11, 2021.
`
`Applicant’s undersigned representative thanks Examiner Bermudez and her supervisor for
`
`the courtesies extended during the telephone interview of August 18, 2021. Applicant’s separate
`
`record of the substance of the interview 1s incorporated in the remarks below.
`
`During the Interview, the claim language “a protrusion which swells inward to press the
`
`electrode assembly in the first direction, and which deforms with expansion of the electrode
`
`assembly” of claim 1 as distinguishing over Suzuki (US 2016/0204399 A1) was discussed. Since
`
`the above limitation uses functional language, the Examiner suggested that applicant amend claim
`
`1 to define the structure that causes the action being recited, and furtherclarify the feature related
`
`to the expansion of the electrode assembly as seen in Figs. 3-4 of the present application, as
`
`opposedto the transformation of the case structure depicted in Figs. 1 and 4 of Suzuki.
`
`To address the above concerns, applicant’s representative offered to amend claim 1 to
`
`recite further structural limitations regarding the exterior body andits protrusion, now incorporated
`
`in amended claim 1 as presented herein. The Examinerorally agreed that she would consider the
`
`proposed change if presented in a supplemental amendment.
`
`The Examiner also indicated that claim 1 would overcome Suzuki if it is amended to
`
`include the limitation as to the pressuring unit currently recited in present claim 3, minus “a rubber
`
`member” which is allegedly taught in Suzuki. New independent claim 9 incorporates the
`
`previously pending aspects of claims 1 and 3 modified to recite “the pressurizing unit is at least
`
`one selected from a spring and a linear motion device.”

`
`prompt and favorable reconsideration of the rejection and an indication of allowability of all
`
`pending claimsare earnestly solicited.
