`a batterycan (case 200,fig 1) that includes a cylinder portion (lateral plate 121, fig 3) anda
`
`bottom portion (bottom plate 122, fig 3), the cylinder portion having an opening edge portion at one of
`
`end portions of the cylinder portion (open at edge of crimping part 124 at top of cylinder in Fig 3), the
`
`other one of the end portions of the cylinder portion being closed by the bottom portion (122 closed at
`
`bottom of cylinder in Fig 3);
`
`an electrode body that is housed in the cylinder portion (electrode assembly 110 within 121,fig
`
`3; and
`
`a sealing member that is fixed to the cylinder portion to seal an opening of the opening edge
`
`portion (cap assembly 130 and conductive cover 150 being couples to upper part of case 120, [0039] and

`Regarding claim 26, Bae discloses the limitations of claim 1 above and discloses the sealing

`portion includes a fifth gasket that seals a space between the opening edge portion and the cap
`
`(insulation member 160 between open edge of 121 at 124 and conductive cover 150, figs 2-3 and
`
`[0047]), and
`
`the fifth gasket is provided between the opening edge portion and the top plate portion (160
`
`between open edge at 124 and flat part 151 of cover 150, [0047] and fig 3), and

`Examiner notes that“fifth” is a relative term, and the positively recited structure ofthe instantly

`claimed fifth gasket is indeed met by Bae as cited herein.
`
`Regarding claim 27, Bae discloses the limitations of claim 26 above and discloses the sealing
`
`member further includes a sixth gasket (gasket 140,fig 3) that seals a space between the sealing plate
`
`and the cap (gasket 140 surrounds periphery of 131 and is thus in a space between 131 and 150, [0038]
`
`andfig 3), and
`
`the sixth gasketis provided spaced apart from thefifth gasket (140 and 160 are spatially
`
`separate pieces as shownin Fig 3).
`
`Examiner notes that “fifth” and “sixth” are relative terms, and the positively recited structure of
`
`the instantly claimed fifth and sixth gaskets is indeed met by Bae as cited herein.
`
`Regarding claim 28, Bae discloses the limitations of claim 27 above and discloses the cap
`
`includes a supporting portion (region 153a, fig 4) that extends towardthe bottom portionin the axial
`
`direction (vertically downward,figs 2 and 4) on an inner circumferential side of the top plate portion
`
`relative to a position of the side wall portion (153a is more radially inward than 152,fig 4 and [0039]),
`
`the sixth gasket is provided between an inner circumferential surface of the supporting portion
`
`(gasket 140 is radially inward relative to 153a, fig 3) and at least an outer circumferential edge portion of

`is also provided between an outer circumferential edge portion of the sealing plate and the top plate

`portion (insulation member 160 is positioned above and extendsradially outward relative to
`
`outer/upper circumferential edge of 131, and is positioned below flat part 151; fig 3) tosealaspace
`
`between the sealing plate and the cap (thus, 160 seals between 131 and 150; [0047] and figs 2-3)
`
`Regarding claim 30, Bae discloses the limitations of claim 26 above and discloses an end portion
`
`of the cylinder portion on a side of the opening edge portion (outer portion of crimping part 124 is
`
`radially outward relative to its inner open edge,fig 3) has ashape that is bent or curved outwardin a
`
`radial direction of the cylinder portion (outwardly curved portion of 124, fig 3) and then extends toward
`
`the bottom portion (outer edge extends from 124 toward 123 and toward 122,fig 3), and

`the fifth gasket is provided between the top plate portion andaportion of the shape that
`
`extends from a bent or curved position toward the bottom portion (160 is between 151 and the curved

`
`of 120,figs 2-3).

`Double Patenting
`

`The nonstatutory double patenting rejection is based on a judicially created doctrine grounded
`
`in public policy (a policy reflected in the statute) soas to prevent the unjustified or improper timewise
`
`extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple
`
`assignees. Anonstatutory double patenting rejection is appropriate where the conflicting claims are not
`
`identical, but at least one examined application claim is not patentably distinct from the reference
`
`claim(s) because the examinedapplication claim is either anticipated by, or would have been obvious
`
`over, the reference claim(s). See, e.g., Inre Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); Inre
`
`Goodman,11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); Inre Longi, 759 F.2d 887, 225 USPQ 645 (Fed.
`
`Cir. 1985); Inre Van Ornum,686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164

`Thefiling of a terminal disclaimer by itselfis not a complete reply to a nonstatutory double

`patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a

`reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional
`
`the reply must be complete. See MPEP § 804, subsection|.B.1. For a reply to a non-final Office action,
