`
`Since the rights granted by a US. patent extend oniy throughout the territory of the United States and have no
`effect in a foreign country, an inventor who wishes patent protection in another country must appiy for a patent
`in a specific country or in regionai patent offices. Appiioants may wish to consider the fiiing of an internationai
`appiication under the Patent Cooperation Treaty (PCT). An internationai (PCT) appiication generaiiy has the same
`effect as a reguiar nationai patent appiioation in each PCTmemher country. The PCT process simpiities the fiiing
`of patent appiioations on the same invention in member countries, but does not resuit in a grant of "an internationai
`patent" and does not eiiminate the need of appficants to fife additionai documents and fees in countries where patent
`protection is desired.
`
`Aimost every country has its own patent few, and a person desiring a patent in a partiouiar country must make an
`appiicatioh for patent in that country in accordance with its particuiar iaws. Since the iaws of many countries differ
`in various respects from the patent few of the United States, appiioants are advised to seek guidance from specific
`foreign countries to ensure that patent rights are not iost prematureiy.
`
`Apoiicants aiso are advised that in the case of inventions made in the United States, the Director of the USPTO must
`issue a iicense before appiicants can appiy for a patent in a foreign country. The tiiing of a US. patent appiioation
`serves as a request for a foreign fiiing iicense. The appiicaticn's tiiing receipt contains further information and
`guidance as to the status of appiioant's iioense for foreign fiiing.
`
`Appficants may wish to eonsuft the USPTO hooiriet, "Generai information Concerning Patents" (specificaiiy, the
`section entitied “Treaties and Foreign Patents") for more information on timetrames and deadiines tor fiiing foreign
`patent appiieations. The guide is avaiiahie either by contacting the USPTO Contact Center at 800—786—331 99, or it
`can be viewed on the USPTO website at http://wwwuspto.gov/weh/oftices/pac/doc/generai/index.htmi.
`
`For information on preventing theft of your intetieotuat property (patents, trademarks and copyrights), you may wish
`to oonsuit the US. Government website, http://www“stopfakesgov. Part of a Department of Commerce initiative,
`this website inciudes seif-heip "tooihits" giving innovators guidance on how to protect inteiiectuai property in specific
`countries such as China, Korea and Mexico. For questions regarding patent enforcement issues, appiicahts may
`caii the US. Government hotiine at 1-886-999-f-iALT (1-886-999-4258).
