`Claims1, 3, 6, 7 and 9 are pending, of which claim 1 is independent.
`
`Claim 1 has been amended to include the features of claim 3 and additional features that
`
`have not recited yet. Claims 3 and 8 have been cancelled without prejudice. The amendmentis
`
`supported by, for example, paragraph [0038] of the specification. The drawings and the
`
`specification have been amended. No new matter has been added.
`
`Entry of various comments regarding the claims and/orthe art, in the Office Action,
`
`should not be construed as any acquiescence or agreement by Applicants with the stated
`
`reasoning, regardless of whether or not these remarks specifically address any particular
`
`commentfrom the Office Action.

`Reconsideration of this application for allowanceofall pending claims is hereby

`respectfully requested in view of the amendments to the claims and following remarks

`Objection to the Drawings
`
`The drawings were objected to. Applicant believes that the amendments made to the
`
`drawings and the specification are fully responsive to the Examiner’s concerns. Withdrawal of
`
`the objection to the drawings is, therefore, respectfully solicited.

`Claim Rejection Under 35 U.S.C.§102/103
`
`Claims 1-6 and 8-9 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Andel
`
`(U.S. Patent Publication No. 2010/0000749 A1, “Andel’”). Claim 7 is rejected under 35 U.S.C.
`
`103 as being unpatentable over Andel (US 2010/0000749 A1), in view of Hirabayashietal.
`
`(U.S. Patent No. 9,205,547 B2, “Hirabayashi’). Without conceding any correctness of the
`
`rejections, Applicant traverses the rejections for at least the following reasons.
`
`Ata minimum, Andelfails to disclose that the connection structure is a structure in
`
`which a convex portion or a concave portion provided on an outer circumferential surface of
`
`the first hammer movably disposed in a concave portion or a convex portion provided on an
`
`inner circumferential surface of the second hammerwith the circumferential clearance whichis
`
`determined according to a motorrotation speed during a tightening work, when viewed from
`
`

`the axial direction, and the second hammerhas an impact on the first hammer in contact with
`
`the anvil, as recited by claim 1.
`
`In the present application, as paragraph [0038] of the present specification discloses, “In
`
`the bolt tightening work, a workerpulls the operation switch 4 to a maximum amountin a
`
`movable range. Whenthe operation switch 4 is pulled, the control unit 5 rotates the driver 10,
`
`whichis a motor, at a predetermined rotation speed.”
`
`In the present invention, the circumferential clearance is designed based on the
`
`predeterminedrotation speed “so that the sub-hammer 21 can apply the rotation force to the main
`
`hammer20, before the main hammer 20 moves away from the anvil 22” as described in
`
`paragraph [0040]. That is, the second hammerhasan impact on the first hammer which does not
`
`move away from the anvil and is in contact with the anvil.
`
`Applicant respectfully submits that Andel fails to disclose the circumferential clearance
`
`which is determined according to a motor rotation speed during a tightening work,as recited by
`
`claim 1.

`Assuch, claim 1 and all claims dependent thereon are patentable over the cited
`
`references.
