`as being indefinite for failing to particularly point out and distinctly claim the subject matter which the
`
`inventor or a joint inventor (or for applications subject to pre-AlA 35 U.S.C. 112, the applicant), regards
`
`as the invention. The claim identifies an apparatus that is receiving reference signals, and in turn
`
`potentially transmitting on the same signals. In paragraph 0199 of Applicant's specification, the base
`
`station is involved in determining to drop reference signals, but the claim recites a receiving apparatus
`
`and it is not clear how the receiving apparatus would ever decide to transmit the reference signals that
`
`it is receiving on the downlink.It is recommendedthat the claim recite that it is determined by the
`
`receiving apparatus that the referencesignals are dropped.
`

`1811171 also discloses any one of twoofa plurality of the second reference signals, the two of the
`
`plurality of second reference signals being signals with time spacing equal to or less than a threshold
`
`value in the decided mapping. (3GPP R1-1811171: [Section 7 PT-RS] When a UE is scheduled to
`
`transmit PUSCH with allocation duration of 2 symbols with mapping type B andif Lpz-rs is set to 2 or 4,
`
`the UE shall not transmit PT-RS. When a UE is scheduled to transmit PUSCH with allocation duration of
`

`Claim Rejections - 35 USC § 103

`In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102
`
`and 103 (or as subject to pre-AlA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory
`
`basis (i.e., changing from AIA to pre-AlA) for the rejection will not be considered a new ground of
`
`rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same
`
`under either status.
`
`The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections
`
`set forth in this Office action:
`
`A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is
`not identically disclosed as set forth in section 102, if the differences between the claimed invention
`and the prior art are such that the claimed invention as a whole would have been obvious before the
`effective filing date of the claimed invention to a person having ordinaryskill in the art to which the
`claimed invention pertains. Patentability shall not be negated by the manner in which the invention
`was made.
`
`The factual inquiries for establishing a background for determining obviousness under 35 U.S.C.
`
`103 are summarized as follows:
`
`1. Determining the scope and contentsofthe prior art.
`
`2. Ascertaining the differences between the prior art and the claims at issue.
`
`3. Resolving the level of ordinary skill in the pertinent art.
`
`4. Considering objective evidence present in the application indicating obviousness or

`Claim 8 is rejected under 35 U.S.C. 103 as being anticipated by Ericsson, “Maintenance for RS

`
`Regarding (Currently Amended) claim 8, 3GPP R1-1811171 teaches the receiving apparatus according
`
`to claim 1. However, 3GPP R1-1811171 does not disclose wherein in a case where a position of at least
`
`one reference signal of a plurality of the second reference signals is changed, the control circuitry
`
`changesa position of a remaining reference signal. SEO does teach wherein in a case where a position
`
`of at least one reference signal of a plurality of the second reference signals is changed, the control
`
`circuitry changes a position of a remaining reference signal. (SEO: Figure 10(b) and [0098] FIG. 10(b),
`
`the location of the DM-RS maybeshifted to a time axis as much as two symbols without separate
`
`configuration).
`
`It would have been obvious to one of ordinary skill in the art, before the effective filing date of
`
`the claimed invention, to modify the teachings of 3GPP R1-1811171 with the DMRS symbol shifting of
`
`SEO so that the downlink control information of the user equipment mayeffectively be detected in the
`
`wireless communication system.
`
`Claim 15 is rejected under 35 U.S.C. 103 as being anticipated by Ericsson, “Maintenancefor RS
`
`and QCL”, 3GPP TSG-RAN WG1 Meeting #94bis R1-1811171 dated October 8, 2018 (identified in
`
