`Applicant's arguments with respect to claims 12-13 have been considered but they are
`
`mootin view of the new groundsofrejection necessitated by amendmentsinitiated by the
`
`applicant. Examiner addresses the main arguments of the Applicant as below.
`

`Regarding the 35 U.S.C. 112(a) rejection, the amendmentfiled on 8/9/2023 addresses
`
`the issue. As a result, the 35 U.S.C. 112(a) rejection is withdrawn.
`

`Regarding the 35 U.S.C. 103 rejection, the Applicant amended the claims then argued,
`
`“However, Kitazato, fails to disclose correcting different presentation times between a data unit
`
`whose presentation time indicates a time before a leap second occurs and a data unit whose
`
`presentation time indicates a time after a leap second has occurred among a plurality of data
`
`units that are subsets of an MPU. Accordingly, Kitazato necessarily fails to teach "for each of
`
`the plurality of second data units, (i) the processor does not apply the offset value to the
`
`presentation time of the second data unit when the presentation time of the data unit indicates a
`
`time before the leap second occurs, and(ii) applies the offset value to the presentation time of
`
`the second data unit when the presentation time of the second data unit indicates a time after
`
`the leap second has occurred," where the plurality of second data units are subsets ofthefirst
`
`data unit, as required by the above-notedfeatures of claim 12.” [Paragraphs 7-8 on page 7 of
`
`the Remarks].

`Examiner respecttully disagrees. Kitazato (US Patent Application Publication
`
`2018/0034571 A1), (“Kitazato”) discloses the arguedlimitation as follow:

`

`Accordingly, the Examiner respectfully maintains the rejections and applicability of the arts
`
`used.

`The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness

`In the event the determination of the status of the application as subject to AIA 35 U.S.C.

`102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103)is incorrect, any correction of the

`statutory basis for the rejection will not be considered a new ground ofrejection if the prior art
`
`relied upon, and the rationale supporting the rejection, would be the same undereitherstatus.

`The factual inquiries set forth in Graham v. John Deere Co., 383 U.S. 1, 148 USPQ 459
`
`(1966), that are applied for establishing a background for determining obviousness underpre-
`
`AIA 35 U.S.C. 103(a) are summarized asfollows:
`
`1. Determining the scope and contents of the prior art.
`
`2. Ascertaining the differences between the prior art and the claims at issue.
`
`3. Resolving the level of ordinary skill in the pertinentart.
`
`4. Considering objective evidence present in the application indicating obviousness or
`
`nonobviousness.

`This application currently namesjoint inventors. In considering patentability of the claims
`
`underpre-AlA 35 U.S.C. 103(a), the examiner presumesthat the subject matter of the various
`
`claims was commonly ownedat the time any inventions covered therein were made absent any
`
`evidenceto the contrary. Applicant is advised of the obligation under 37 CFR 1.56 to point out
`
`the inventor and invention dates of each claim that was not commonly ownedatthe timealater
`
`invention was madein orderfor the examinerto consider the applicability of pre-AIA 35 U.S.C.
`
`103(c) and potential pre-AIA 35 U.S.C. 102(e), (f) or (g) prior art under pre-AlA 35 U.S.C.
