`Determination of Patent Term Adjustment under 35 U.S.C. 154 (b)
`(Applications filed on or after May 29, 2000)
`
`The Office has discontinued providing a Patent Term Adjustment (PTA) calculation with the Notice of Allowance.
`
`Section 1(h)(2) of the AIA Technical Corrections Act amended 35 U.S.C. 154(b)(3)(B)(i)to eliminate the requirement
`that the Office provide a patent term adjustment determination with the notice of allowance. See Revisions to Patent
`Term Adjustment, 78 Fed. Reg. 19416, 19417 (Apr. 1, 2013). Therefore, the Office is no longer providing an initial
`patent term adjustment determination with the notice of allowance. The Office will continue to provide a patent term
`adjustment determination with the Issue Notification Letter that is mailed to applicant approximately three weeks prior
`to the issue date of the patent, and will include the patent term adjustmenton the patent. Any request for reconsideration
`of the patent term adjustment determination (or reinstatement of patent term adjustment) should follow the process
`outlined in 37 CFR 1.705.
`
`Any questions regarding the Patent Term Extension or Adjustment determination should be directed to the Office of
`Patent Legal Administration at (571)-272-7702. Questions relating to issue and publication fee payments should be
`directed to the Customer Service Center of the Office of Patent Publication at 1-(888)-786-0101 or (571)-272-4200.

`
`Drawings
`
`4.
`
`The drawings are objected to for the following and mustbecorrected:
`
`e The drawings do not meet the requirements 37 CFR § 1.84 becauseall lines are
`
`rough, not durable, clean, black (except for color drawings), sufficiently dense
`
`and dark, and uniformly thick and well-defined. The weightofall lines and letters
`
`must be heavy enough to permit adequate reproduction. This requirement
`
`applies to all lines howeverfine, to shading, and to lines representing cut
`
`surfacesin sectional views. Lines and strokes of different thicknesses may be
`
`used in the same drawing wheredifferent thicknesses have a different meaning.

`
`Corrected drawing sheets are required in reply to the Office action to avoid
`
`abandonmentof the application. Any amended replacement drawing sheet should
`
`include all of the figures appearing on the immediate prior version of the sheet, evenif
`
`only one figure is being amended. Thefigure or figure number of an amended drawing
`
`should not be labeled as “amended.” If a drawing figure is to be canceled, the
`
`appropriate figure must be removed from the replacement sheet, and where necessary,
`
`the remaining figures must be renumbered and appropriate changes madeto the brief
`
`description of the several views of the drawings for consistency. Additional replacement
`
`sheets may be necessary to show the renumbering of the remaining figures. If all the

`
`figures on a drawing sheet are canceled, a replacementsheetis not required. A
`
`marked-up copy of the drawing sheet(labeled as “Annotated Sheet”) including an
`
`annotation showing thatall the figures on that drawing sheet have been canceled must
`
`be presented in the amendment or remarks section that explains the change to the
`
`drawings. Each drawing sheet submitted afterthe filing date of an application must be
`
`labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuantto 37
`
`CFR 1.121 (d).
`
`6.
`
`Whenpreparing new or replacement drawings, be careful to avoid introducing
`
`new matter. New matter is prohibited by 35 U.S.C. 132 and 37 CFR 1.121 (f).
`
`7.
`
`The necessity for good drawings in a design patent application cannot be
`
`overemphasized. As the drawing constitutes the whole disclosure of the design, it is of
`
`utmost importancethatit be so well executed both asto clarity of showing and
`
`completeness, that nothing regarding the design sought to be patentedis left to
`
`conjecture. An insufficient drawing maybefatal to validity (85 U.S.C. 112(a) or pre-AlA
`
`35 U.S.C. 112, first paragraph). Moreover, an insufficient drawing may have a negative
`
`effect with respect to the effective filing date of a continuing application.
