`
`The assigned examining attorney has reviewed the referenced application and determined the
`following.
`
`PRIOR REGISTRATIONS
`The examining attorney refuses registration under Trademark Act Section 2(d1), 15 USC. Section
`1052(d), because the applicant's mark, when used on or in connection with the identified goods, so
`resembles the marks in US. Registration Nos. 1945401, 188271, 1673241, and 0746848 as to be
`likely to cause confusion, to cause mistake, or to deceive. TMEP section 1207. See the enclosed
`registrations.

`
`
`Section 2(d) of the Trademark Act bars registration where a mark so resembles a registered mark,
`that it is likely, when applied to the goods, to cause confusion, or to cause mistake or to deceive.
`TMEP section 1207.01. The Court in In re E. I. DuPont de Nemours & Co., 476 F.2d 1357, 177
`USPQ 563 (CCPA 1973), listed the principal factors to consider in determining whether there is a
`likelihood of confiision. Among these factors are the similarity of the marks as to appearance,
`sound, meaning and'comrnercial impression and the similarity of the goods. The overriding
`concern is to prevent buyer confusion as to the source of the goods.
`[Miss Universe, Inc. v. Miss
`' Teen USA, Inc, 209 USPQ 698 (ND. Ga. 1980). Therefore, any doubt as to the existence of a
`likelihood of confiision must be resolved in favor of the registrant. Lone Star Mfg. Co. v. Bill

`
`Here, the applicant seeks registration ofthe mark PANASONIC for a wide variety of goods,
`including electronic products and batteries. The registrant applies various PANASONIC marks to
`electronic products and batteries. In such circumstances, source confusion is likely.
`
`If the registered marks cited have been assigned to the applicant, the applicant is responsible for
`proving its ownership. TMEP section 812.01. The applicant may record the assignment with the
`Assignment Branch of the Patent and Trademark Office. Trademark Act Section 10, 15 U.S.C.
`Section 1060; 37 C.F.R. Section 2.185. The applicant should then provide the examining attorney
`with the reel and frame numbers at which the assignment is recorded.
`In the alternative, the
`applicant may submit evidence of the assignment ofthe marks to the applicant. This evidence may
`consist of (1) documents evidencing the chain of title or (2) an explanation, in an affidavit or
`supported by a declaration under 37 C.F.R. Section 2.20, of the chain oftitle (specifying each party
`in the chain, the nature of each conveyance, and the relevant dates).
`
`
`
`
`GOODS INDEFINITE AND/OR IMPROPERLY CLASSIFIED
`The identification of goods is unacceptable as indefmite and/or improperly classified. TMEP
`section 804. With the substitution of Int. Cl. 2 (with goods classified in Int. Cl. 1) for Int. Cl. 8 (the
`goods for that class now being listed in Int. Cl. 7), the application identifies 17 classes of goods,
`and the necessary filing fees for that many classes have been received.
`
`Recommended changes are shown in bold. Where “general industrial use” is specified, the
`applicant may substitute a specific field of use. Where a term is followed by “namely” or
`“comprised of”, the applicant must delete the term or list the goods by their common commercial
`name. In Int. Cl. 7, the applicant may substitute the word “machine” for “system”. In Int. Cl. 9, the
`subject matter (the purpose or function) featured on various electronic media (i.e. software, CD,
`optical disc) must be specified. TMEP section 804.03(b). This additional information is necessary
`to permit this Office to reach judgements concerning possible conflicts between the applicant's
`mark and other marks. See In re Linkvesf S.A., 24 USPQ2d 1716 (TTAB 1992).
`
`the goods identified as “credit
`The applicant must submit more detailed information about
`displays”, “language laboratories”, “image pick up tubes”, “cassette library system”, “digital
`telephone service units”, “ammeers”, “LSI”, and “hair stylers” (Int. Cl. 9), “electronic print boards”
`and “check printing accountants” (Int. Cl. 16), “clothes cleaners” (Int. Cl. 21), and “electronic golf
`exercisers” and “wax applicators for ski” ant. Cl. 28)
`to permit proper identification and
`classification. With regard to the other goods, the applicant may adopt the following identification,
