`The applicant was previously advised that the prior specimen of record was unacceptable as evidence of actual trademark use because it does not
`show the mark as it is used in commerce in connection with the goods.(cid:160) The applicant has submitted a substitute specimen which is acceptable,
`but the supporting Declaration is imperfect because it does not contain pertient language, nanely,(cid:160)
`that the specimen was in date of use prior to
`the deadline for filing the Statement of Use,(cid:160)
