`
`SSUE/MAILING DATE: 8/20/2007
`
`(cid:160)T
`
`HIS IS A FINAL ACTION.
`
`The assigned examining attorney has reviewed the applicant’s correspondence received on August 2,
`2007, in the referenced application and determined the following.(cid:160) The amended identification of goods is
`acceptable.(cid:160) The following issue, however, remains outstanding.
`
`(cid:160)F
`
`INAL REFUSAL TO REGISTER THE MARK
`
`(cid:160)F
`
`or the reasons set forth below, the refusal under Trademark Act Section 2(d), 15 U.S.C. §1052(d), is now
`made FINAL with respect to U.S. Registration No. 0751288.(cid:160) 37 C.F.R. §2.64(a).(cid:160) The trademark
`examining attorney has considered applicant’s arguments carefully and found them unpersuasive.
`
`(cid:160)T
`
`he applicant asserts that the term “whisper” is weak as applied to fans since it suggests that the relevant
`goods are quiet.(cid:160) Even if applicant has shown that the cited mark is “weak,” such marks are still entitled
`to protection against registration by a subsequent user of the same or similar mark for the same or closely
`related goods or services.(cid:160) See Hollister Incorporated v. Ident A Pet, Inc., 193 USPQ 439 (TTAB 1976)
`and cases cited therein.
`
`(cid:160)T
`
`he registrations cited by the applicant in support of its argument are not conclusive since the goods
`differ from those of the applicant and the registrant.(cid:160) The applicant has identified its goods as “ventilating
`exhaust fans,” and the registrant has identified its goods as “electrical ventilating fans.” (cid:160) The goods of
`the parties are related in that they are both ventilating fans.(cid:160) The applicant has not challenged this finding.(cid:160)
`The goods in the relevant registrations and sole application, which were cited by the applicant and feature
`the word “whisper” in the marks, consist of evaporative air cooling units for domestic and commercial
`use and ceiling fans.(cid:160) These goods are different from the goods identified by the applicant and the
`registrant.(cid:160) This determination is based upon the attached webpages found during an Internet search
`conducted on August 17, 2007.(cid:160) The records of this Office clearly indicate that the registrant is the only
`
`entity that has registered the term “WHISPER” for ventilating fans. (cid:160)(cid:160)(cid:160)
`
`(cid:160) The applicant’s mark is
`Therefore, the sole distinction between the parties’ marks is the term “green”.
`WHISPERGREEN, and the registrant’s mark in is WHISPER. (cid:160) The marks are similar in appearance,
`sound, connotation and overall common commercial impression in that they each contain (and begin
`with) the wording “whisper”. (cid:160) Both marks connote that the relevant goods are quiet as a “whisper”. (cid:160)
`Furthermore, the additional wording in the applicant’s mark is merely suggestive of a feature of the
`goods, namely, the ventilating exhaust fans are built to save energy and are therefore “green” or
`environmentally friendly.(cid:160) Please see the attached dictionary definition of “green.” (cid:160) Purchasers could
`
`reasonably believe that the same entity is manufacturing both types of “whisper” ventilating fans. (cid:160)(cid:160)
`
`The applicant’s mere addition of the term “green” to the registered mark does not obviate the similarity
`between the marks nor does it overcome a likelihood of confusion under Section 2(d).(cid:160) In re Chatam
`International Inc., 380 F.3d 1340, 71 USPQ2d 1944 (Fed. Cir. 2004) (“GASPAR’S ALE and “JOSE
`GASPAR GOLD”); Coca-Cola Bottling Co. v. Joseph E. Seagram & Sons, Inc., 526 F.2d 556, 188 USPQ
`105 (C.C.P.A. 1975) (“BENGAL” and “BENGAL LANCER”); Lilly Pulitzer, Inc. v. Lilli Ann Corp.,
`
`(cid:160)
`

`
`376 F.2d 324, 153 USPQ 406 (C.C.P.A. 1967) (“THE LILLY” and “LILLI ANN”); In re El Torito
`Rests. Inc., 9 USPQ2d 2002 (TTAB 1988) (“MACHO” and “MACHO COMBOS”); In re United States
`Shoe Corp., 229 USPQ 707 (TTAB 1985) (“CAREER IMAGE” and “CREST CAREER IMAGES”); In
`re Corning Glass Works, 229 USPQ 65 (TTAB 1985) (“CONFIRM” and “CONFIRMCELLS”); In re
`Riddle, 225 USPQ 630 (TTAB 1985) (“ACCUTUNE” and “RICHARD PETTY’S ACCU TUNE”);
`In
`re Cosvetic Laboratories, Inc., 202 USPQ 842 (TTAB 1979) (“HEAD START” and “HEAD START
`COSVETIC”); TMEP §1207.01(b)(iii).
`
`(cid:160)T
`
`he fact that purchasers are sophisticated or knowledgeable in a particular field does not necessarily mean
`that they are sophisticated or knowledgeable in the field of trademarks or immune from source confusion.(cid:160)
`See In re Decombe, 9 USPQ2d 1812 (TTAB 1988); In re Pellerin Milnor Corp., 221 USPQ 558 (TTAB
`1983); TMEP §1207.01(d)(vii).(cid:160) Furthermore, the presumption under Trademark Act Section 7(b), 15
`U.S.C. §1057(b), is that the registrant is the owner of the mark and that use of the mark extends to all
`goods identified in the registration.(cid:160) The presumption also implies that the registrant operates in all
`normal channels of trade and reaches all classes of purchasers of the identified goods.(cid:160) In re Melville
`Corp., 18 USPQ2d 1386, 1389 (TTAB 1991); McDonald’s Corp. v. McKinley , 13 USPQ2d 1895, 1899
`(TTAB 1989); RE/MAX of America, Inc. v. Realty Mart, Inc., 207 USPQ 960, 964-5 (TTAB 1980).
`
`Any doubt regarding a likelihood of confusion is resolved in favor of the prior registrant.(cid:160) Hewlett-
`Packard Co. v. Packard Press Inc., 281 F.3d 1261, 62 USPQ2d 1001, 1004 (Fed. Cir. 2002); In re Hyper
`
`Shoppes (Ohio), Inc., 837 F.2d 463, 6 USPQ2d 1025 (Fed. Cir. 1988); TMEP §§1207.01(d)(i).(cid:160)(cid:160)(cid:160)
