`made FINAL with respect to U.S. Registration No. 0751288.(cid:160) 37 C.F.R. §2.64(a).(cid:160) The trademark
`examining attorney has considered applicant’s arguments carefully and found them unpersuasive.

`he applicant asserts that the term “whisper” is weak as applied to fans since it suggests that the relevant
`goods are quiet.(cid:160) Even if applicant has shown that the cited mark is “weak,” such marks are still entitled
`to protection against registration by a subsequent user of the same or similar mark for the same or closely
`related goods or services.(cid:160) See Hollister Incorporated v. Ident A Pet, Inc., 193 USPQ 439 (TTAB 1976)
`and cases cited therein.

`he registrations cited by the applicant in support of its argument are not conclusive since the goods
`differ from those of the applicant and the registrant.(cid:160) The applicant has identified its goods as “ventilating
`exhaust fans,” and the registrant has identified its goods as “electrical ventilating fans.” (cid:160) The goods of
`the parties are related in that they are both ventilating fans.(cid:160) The applicant has not challenged this finding.(cid:160)
`The goods in the relevant registrations and sole application, which were cited by the applicant and feature
`the word “whisper” in the marks, consist of evaporative air cooling units for domestic and commercial
`use and ceiling fans.(cid:160) These goods are different from the goods identified by the applicant and the
`registrant.(cid:160) This determination is based upon the attached webpages found during an Internet search
`conducted on August 17, 2007.(cid:160) The records of this Office clearly indicate that the registrant is the only
`
`entity that has registered the term “WHISPER” for ventilating fans. (cid:160)(cid:160)(cid:160)
`
`(cid:160) The applicant’s mark is
`Therefore, the sole distinction between the parties’ marks is the term “green”.
`WHISPERGREEN, and the registrant’s mark in is WHISPER. (cid:160) The marks are similar in appearance,
`sound, connotation and overall common commercial impression in that they each contain (and begin
`with) the wording “whisper”. (cid:160) Both marks connote that the relevant goods are quiet as a “whisper”. (cid:160)
`Furthermore, the additional wording in the applicant’s mark is merely suggestive of a feature of the
`goods, namely, the ventilating exhaust fans are built to save energy and are therefore “green” or
`environmentally friendly.(cid:160) Please see the attached dictionary definition of “green.” (cid:160) Purchasers could
`
`reasonably believe that the same entity is manufacturing both types of “whisper” ventilating fans. (cid:160)(cid:160)
`
`The applicant’s mere addition of the term “green” to the registered mark does not obviate the similarity
`between the marks nor does it overcome a likelihood of confusion under Section 2(d).(cid:160) In re Chatam
