`
`OFFICE ACTION
`
`(cid:160)T
`
`O AVOID ABANDONMENT, THE OFFICE MUST RECEIVE A PROPER RESPONSE TO THIS OFFICE ACTION WITHIN 6 MONTHS
`OF THE ISSUE/MAILING DATE.
`
`(cid:160)I
`
`SSUE/MAILING DATE: 8/24/2007
`
`The assigned examining attorney has reviewed the application and preliminary amendment and determined the following:
`
`(cid:160)P
`
`rior Pending Application
`The Office records have been searched and no similar registered mark has been found that would bar registration under Trademark Act Section
`2(d), 15 U.S.C. §1052(d).(cid:160) TMEP §704.02.(cid:160) However, please be advised that a potentially conflicting mark in a prior-filed pending application
`may present a bar to registration.
`
`(cid:160)I
`
`nformation regarding pending Application Serial No. 78773333 is enclosed.(cid:160) The filing date of the referenced application precedes applicant’s
`
`(cid:160)
`

`
`filing date.(cid:160) There may be a likelihood of confusion between the two marks under Trademark Act Section 2(d), 15 U.S.C. §1052(d).(cid:160) If the
`referenced application registers, registration may be refused in this case under Section 2(d).(cid:160) 37 C.F.R. §2.83; TMEP §§1208 et seq.(cid:160) Therefore,
`upon entry of a response to this Office action, action on this case may be suspended pending final disposition of the earlier-filed application.
`
`(cid:160)I
`
`f applicant believes there is no potential conflict between this application and the earlier-filed application, then applicant may present arguments
`relevant to the issue in a response to this Office action.(cid:160) The election not to submit arguments at this time in no way limits applicant’s right to
`address this issue at a later point.
`
`(cid:160)I
`
`nformality
`Disclaimer
`Applicant must disclaim the descriptive wording “PRO SETTING” apart from the mark as shown because it merely describes a feature or
`characteristic of the goods.(cid:160) Trademark Act Section 6, 15 U.S.C. §1056; TMEP §§1213 and 1213.03(a). Please see the enclosed Internet evidence
`indicating that the wording “pro setting” generally refers to a setting or mode for television sets.
`
`(cid:160)T
`
`he computerized printing format for the Office’s Trademark Official Gazette requires a standardized format for a disclaimer.(cid:160) TMEP
`§1213.08(a)(i).(cid:160) The following is the standard format used by the Office:
`
`No claim is made to the exclusive right to use “PRO SETTING” apart from the mark as shown.
`
`(cid:160)S
`
`ee In re Owatonna Tool Co., 231 USPQ 493 (Comm’r Pats. 1983).
`
`(cid:160)T
`
`he Office can require an applicant to disclaim an unregistrable part of a mark consisting of particular wording, symbols, numbers, design
`elements or combinations thereof.(cid:160) 15 U.S.C. §1056(a).(cid:160) Under Section 2(e) of the Trademark Act, the Office can refuse registration of an entire
`mark if the entire mark is merely descriptive, deceptively misdescriptive, or primarily geographically descriptive of the goods.(cid:160) 15 U.S.C.
`§1052(e).(cid:160) Thus, the Office may require an applicant to disclaim a portion of a mark that, when used in connection with the goods or services, is
`merely descriptive, deceptively misdescriptive, primarily geographically descriptive, or otherwise unregistrable (e.g., generic).(cid:160) TMEP
`
`§1213.03(a).(cid:160)(cid:160)
`
`Failure to comply with a disclaimer requirement can result in a refusal to register the entire mark.(cid:160) TMEP §1213.01(b).
`
`(cid:160)A
`
` “disclaimer” is a statement that applicant does not claim exclusive rights to an unregistrable component of a mark. (cid:160) A disclaimer does not
`affect the appearance of the applied-for mark.
`
`(cid:160)C

`Panasonic Introduces First 42-in 1030p Plasma Television

`
`Panasonic is always a name you can trust when
`oolZIng for a plasma television. The company
`announced in NYC today they're 20D? plasma
`lineup along with pricing. These things were
`unveiled back at CES, but this is the first we've
`heard on pricing. Oh, and Panasonic also brings to
`the masses the first 42-inch lEIElI3p plasma. That
`Mn hvC0'C->312 must be pretty awesome_..right?
`The usual suspects are all here. Whatever you're looking for in a
`plasma, there's a good chance Panasonic has it covered. The addition
`of a 42—in 1DSDp set is interesting. When watching that size screen it's recommended you sit F’ feet away
`to get a “movie theater” experience. With a mid-size screen like that the eye can't discern the difference
`between 720p and 1DE:Dp. It's nearly a useless feature to have. The set does come with the increasingly
`standard SD card slot, along with a card with famous paintings on it.
`I guess so you can tell people you
`really appreciate l'-'1anet...or Monet. Whichever one painted those white flowers in a pond.
`
`For the high—end user, later in the year some premium models will be out. The 750 series will include a
`Studio Reference Mode, which allows you to get the same color reproduction E editors have access to.
`A Pro Setting Mode lets the basic user professionally calibrate as well. Add onto that 3 HDMI connections
`and you've got yourself a beast of a television. It'll cost you though, over $5k for the SS-in model.

`less digital
`noise, and greater picture dimension.
