`The assigned trademark examining attorney has reviewed the referenced application and has determined the following:
`SECTION 2(D) - LIKELIHOOD OF CONFUSION REFUSAL
`The examining attorney refuses registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d), because the applicant’s mark, when used
`on or in connection with the identified goods, so resembles the mark in U.S. Registration No. 2601363 as to be likely to cause confusion, or to
`cause mistake, or to deceive.(cid:160) TMEP §§1207.01 et seq.(cid:160) See the enclosed registration.
`The examining attorney must analyze each case in two steps to determine whether there is a likelihood of confusion.(cid:160) First, the examining
`attorney must look at the marks themselves for similarities in appearance, sound, connotation and commercial impression. (cid:160) In re E. I. DuPont de
`Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973).(cid:160) Second, the examining attorney must compare the goods or services to
`determine if they are related or if the activities surrounding their marketing are such that confusion as to origin is likely.(cid:160) In re August Storck KG,
`218 USPQ 823 (TTAB 1983); In re International Telephone and Telegraph Corp., 197 USPQ 910 (TTAB 1978); Guardian Products Co., v.
`Scott Paper Co., 200 USPQ 738 (TTAB 1978).(cid:160) TMEP §§1207.01 et seq.
`The registered mark is NANO and design covering “nanomaterials, namely, molecular scale chemical forms and ceramic particles for use in the
`manufacture of industrial chemicals, electronic devices, electronic apparatus, petrochemicals, pharmaceuticals, catalysts, coatings, cleaning
`preparations, lubricants, fuels, fuel cells, and catalytic converters”; “electrical apparatus, namely, inductors, capacitors, resistors, switches,
`transistors, sensors for use in monitoring environmental conditions, chemical and electrochemical changes, and fuel cells” and “machine parts,
`namely, catalytic converters for use in industrial waste-processing machines and chemical refining machines.”

`n this case, the applicant’s mark NANOE is similar to the cited marks visually and may be pronounced in the identical manner. (cid:160) As such, the
`marks are essentially phonetic equivalents.(cid:160) Similarity in sound alone is sufficient to find a likelihood of confusion.(cid:160) Molenaar, Inc. v. Happy
`Toys Inc., 188 USPQ 469 (TTAB 1975); In re Cresco Mfg. Co., 138 USPQ 401 (TTAB 1963).(cid:160) TMEP §1207.01(b)(iv).(cid:160) The disclaimer of the
`term NANO in the registration is insufficient to distinguish the marks in this case.(cid:160) The marks must be considered in their entireties when
`determining whether there is likelihood of confusion.(cid:160) A disclaimer does not remove the disclaimed portion from the mark for the purposes of
`this analysis.(cid:160) In re National Data Corp., 753 F.2d 1056, 224 USPQ 749 (Fed. Cir. 1985); Specialty Brands, Inc. v. Coffee Bean Distributors,
`Inc., 748 F.2d 669, 223 USPQ 1281 (Fed. Cir. 1984); In re Infinity Broadcasting Corp. of Dallas, 60 USPQ2d 1214 (TTAB 2001); In re MCI
`Communications Corp., 21 USPQ2d 1534 (Comm’r Pats. 1991). (cid:160) Purchasers are not aware of disclaimers that reside only in the records of the
`U.S. Patent and Trademark Office.

`n addition, the applicant’s identification of goods encompasses products which are the same or closely related to those covered by the cited
`registrations.(cid:160) Likelihood of confusion is determined on the basis of the goods or services as they are identified in the application and the
`registration.(cid:160) Hewlett-Packard Co. v. Packard Press Inc., 281 F.3d 1261, 62 USPQ2d 1001 (Fed. Cir. 2002); In re Shell Oil Co., 992 F.2d 1204,
`26 USPQ2d 1687, 1690 n.4 (Fed. Cir. 1993); J & J Snack Foods Corp. v. McDonald’s Corp. , 932 F.2d 1460, 18 USPQ2d 1889 (Fed. Cir. 1991);
`Octocom Systems Inc. v. Houston Computer Services Inc., 918 F.2d 937, 16 USPQ2d 1783 (Fed. Cir. 1990).(cid:160) Since the identification of the
`applicant’s “machine” goods and/or services is very broad, it is presumed that the application encompasses all goods and/or services of the type
`described, including those in the registrant’s more specific identification, that they move in all normal channels of trade and that they are
`available to all potential customers.(cid:160) TMEP §1207.01(a)(iii).

`or instance, applicant’s “machines and machine tools” are presumed to include catalytic converters and, therefore, are likely to move in the
`same channels of trade to the same classes of purchasers as the catalytic converters encompassed by the cited registration.(cid:160) For example, the both
`the applicant’s and registrants’ products would likely be sold through industrial suppliers or environmental treatment machinery manufacturers
`and could be used in conjunction with other similar products.(cid:160) Given the similarities of the marks and the goods, consumers are likely to
`conclude that the goods are somehow related or emanate from the same source.(cid:160) Accordingly, because confusion is likely, registration is refused
`under Trademark Act Section 2(d) based on a likelihood of confusion.
