`
`STRICT DEADLINE TO RESPOND TO THIS LETTER
`TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE
`RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.
`
`OFFICE ACTION
`
`(cid:160)I
`
`SSUE/MAILING DATE: 10/15/2012
`
`(cid:160)T
`
`HIS IS A FINAL ACTION.
`
`(cid:160)T
`
`his responds to applicant’s communication dated September 10, 2012, wherein applicant amended its identification of goods, including the
`division of certain goods into added Class 10.(cid:160) For the reasons set forth below, the requirement for an acceptable identification of services is
`continued and made FINAL, in part:
`
`(cid:160)I
`
`DENTIFICATION OF GOODS IN CLASS 11
`
`(cid:160)T
`
`HIS PARTIAL REQUIREMENT APPLIES ONLY TO THE GOODS SPECIFIED THEREIN
`
`(cid:160)T
`
`he following wording in the amended identification of goods in Class 11 must be clarified because it is too broad and could include goods in
`other international classes:
`
`“Electronic facial skin beautifier using ultrasonic or steam for household and industrial purposes, namely, beautifier for bare skin in the
`nature of steamers, facial steamers incorporating negative ion generators, and electric facial device using cold stimulation, beautifier for
`pore-cleaning and sebum cleaning, beautifier for tightening the face line and reducing pore size, and suction instrument for removing
`blackheads, beautifier for tightening the face line, beautifier for reducing pore size, and suction instrument for removing blackheads,
`goggle-type eye mask equipment for skincare around the eyes”; and
`
`(cid:160)“
`
`Electronic facial skin beautifier using ultrasonic or steam for use in beauty salons and barber shops”.
`
`(cid:160)A
`
`s previously discussed, goods whose primary purpose is the creation of steam or heat are properly placed in Class(cid:160) 11.(cid:160) It is for this reason that
`
`(cid:160)
`(cid:160)
`
`
`“facial saunas” and “electronic facial steamers” are placed in Class 11.
`
`(cid:160) However, “facial toning machines for cosmetic use” and similar
`
`cosmetic devices which do not primarily create steam/heat are placed in Class 10.(cid:160) (cid:160) (cid:160)(cid:160)
`
`The referenced wording is too broad because it encompasses goods which are not clearly in the nature of facial saunas or electronic facial
`steamers.(cid:160) Indeed, applicant’s response includes clarification and reclassification of many such goods separately in Class 10, suggesting that the
`
`redundant language may have been retained in Class 11 in error.(cid:160)(cid:160)
`
`Accordingly, applicant must delete or clarify/classify the goods accordingly, e.g., “electronic facial steamers for use in beauty salons and barber
`shops,” and “Electronic facial skin beautifier using ultrasonic or steam for household and industrial purposes, namely, beautifier devices for
`
`bare skin in the nature of facial steamers and facial steamers incorporating negative ion generators,” in Class 11. (cid:160)(cid:160)
`
`The Office requires a degree of particularity necessary to identify clearly goods and/or services covered by a mark.(cid:160) See In re Omega SA, 494
`F.3d 1362, 1365, 83 USPQ2d 1541, 1543-44 (Fed. Cir. 2007).(cid:160) Descriptions of goods and services in applications must be specific, explicit, clear
`and concise.(cid:160) TMEP §1402.01; see In re Cardinal Labs., Inc., 149 USPQ 709, 711 (TTAB 1966); Cal. Spray-Chem. Corp. v. Osmose Wood
`Pres. Co. of Am., 102 USPQ 321, 322 (Comm’r Pats. 1954).
`
`(cid:160)T
`
`he Trademark Act requires that a trademark or service mark application must include a “ specification of …the goods [or services]” in
`connection with which the mark is being used or will be used.(cid:160) 15 U.S.C. §1051(a)(2) (emphasis added), (b)(2) (emphasis added); see 15 U.S.C.
`§1053.(cid:160) Specifically, a complete application must include a “list of the particular goods or services on or in connection with which the applicant
`uses or intends to use the mark.” (cid:160) 37 C.F.R. §2.32(a)(6) (emphasis added).(cid:160) This requirement for a specification of the particular goods and/or
`services applies to applications filed under all statutory bases.(cid:160) See 15 U.S.C. §§1051(a)(2), 1051(b)(2), 1053, 1126(d)-(e), 1141f; 37 C.F.R.
`§2.32(a)(6); TMEP §§1402.01, 1402.01(b)-(c).
`
`(cid:160)P
`
`lease note that, while the identification of goods/services may be amended to clarify or limit the goods/services, adding to the goods/services or
`broadening their scope is not permitted.(cid:160) 37 C.F.R. §2.71(a); TMEP §1402.06.(cid:160) Therefore, applicant may not amend the identification to include
`goods/services that are not within the scope of the goods/services set forth in the present identification.
`
`(cid:160)F
`
`or assistance with identifying goods and/or services in trademark applications, please see the online searchable Manual of Acceptable
`Identifications of Goods and Services at http://tess2.uspto.gov/netahtml/tidm.html.
`
`(cid:160)R
`
`ESPONDING TO A FINAL OFFICE ACTION
`
`If applicant does not respond within six months of the date of issuance of this final Office action, the following goods to which the final
`refusal(s) and/or requirement(s) apply will be deleted from the application by Examiner’s Amendment: (cid:160) "Electronic facial skin beautifier using
`ultrasonic or steam for household and industrial purposes, namely, beautifier for bare skin in the nature of steamers, facial steamers incorporating
`negative ion generators, and electric facial device using cold stimulation, beautifier for pore-cleaning and sebum cleaning, beautifier for
`tightening the face line and reducing pore size, and suction instrument for removing blackheads, beautifier for tightening the face line, beautifier
`for reducing pore size, and suction instrument for removing blackheads, goggle-type eye mask equipment for skincare around the eyes"; and
`"Electronic facial skin beautifier using ultrasonic or steam for use in beauty salons and barber shops", in Class 11.
`
`(cid:160)T
`
`he application will then proceed for the remaining goods.(cid:160) 15 U.S.C. §1062(b); 37 C.F.R. §2.65(a).
`
`(cid:160)A
`
`pplicant may respond to this final Office action by:

`(1)(cid:160) Submitting a response that fully satisfies all outstanding requirements, if feasible; and/or
`
`(2)(cid:160) Filing an appeal to the Trademark Trial and Appeal Board, with an appeal fee of $100 per class.
`
`(cid:160)3
`
`7 C.F.R. §§2.6(a)(18), 2.64(a); TBMP ch. 1200; TMEP §714.04.
`
`(cid:160)I
`
`n certain rare circumstances, a petition to the Director may be filed pursuant to 37 C.F.R. §2.63(b)(2) to review a final Office action that is
`limited to procedural issues.(cid:160) 37 C.F.R. §2.64(a); TMEP §714.04; see 37 C.F.R. §2.146(b); TBMP §1201.05; TMEP §1704 (explaining
