`continued and made FINAL, in part:

`he following wording in the amended identification of goods in Class 11 must be clarified because it is too broad and could include goods in
`other international classes:

`“Electronic facial skin beautifier using ultrasonic or steam for household and industrial purposes, namely, beautifier for bare skin in the
`nature of steamers, facial steamers incorporating negative ion generators, and electric facial device using cold stimulation, beautifier for
`pore-cleaning and sebum cleaning, beautifier for tightening the face line and reducing pore size, and suction instrument for removing
`blackheads, beautifier for tightening the face line, beautifier for reducing pore size, and suction instrument for removing blackheads,
`goggle-type eye mask equipment for skincare around the eyes”; and
`
`(cid:160)“

`Electronic facial skin beautifier using ultrasonic or steam for use in beauty salons and barber shops”.

`s previously discussed, goods whose primary purpose is the creation of steam or heat are properly placed in Class(cid:160) 11.(cid:160) It is for this reason that

`“facial saunas” and “electronic facial steamers” are placed in Class 11.
`
`(cid:160) However, “facial toning machines for cosmetic use” and similar
`
`cosmetic devices which do not primarily create steam/heat are placed in Class 10.(cid:160) (cid:160) (cid:160)(cid:160)
`
`The referenced wording is too broad because it encompasses goods which are not clearly in the nature of facial saunas or electronic facial
`steamers.(cid:160) Indeed, applicant’s response includes clarification and reclassification of many such goods separately in Class 10, suggesting that the
`
`redundant language may have been retained in Class 11 in error.(cid:160)(cid:160)
`
`Accordingly, applicant must delete or clarify/classify the goods accordingly, e.g., “electronic facial steamers for use in beauty salons and barber
`shops,” and “Electronic facial skin beautifier using ultrasonic or steam for household and industrial purposes, namely, beautifier devices for
`
`bare skin in the nature of facial steamers and facial steamers incorporating negative ion generators,” in Class 11. (cid:160)(cid:160)

`The Office requires a degree of particularity necessary to identify clearly goods and/or services covered by a mark.(cid:160) See In re Omega SA, 494
`F.3d 1362, 1365, 83 USPQ2d 1541, 1543-44 (Fed. Cir. 2007).(cid:160) Descriptions of goods and services in applications must be specific, explicit, clear
`and concise.(cid:160) TMEP §1402.01; see In re Cardinal Labs., Inc., 149 USPQ 709, 711 (TTAB 1966); Cal. Spray-Chem. Corp. v. Osmose Wood
`Pres. Co. of Am., 102 USPQ 321, 322 (Comm’r Pats. 1954).

`he Trademark Act requires that a trademark or service mark application must include a “ specification of …the goods [or services]” in
`connection with which the mark is being used or will be used.(cid:160) 15 U.S.C. §1051(a)(2) (emphasis added), (b)(2) (emphasis added); see 15 U.S.C.
`§1053.(cid:160) Specifically, a complete application must include a “list of the particular goods or services on or in connection with which the applicant
`uses or intends to use the mark.” (cid:160) 37 C.F.R. §2.32(a)(6) (emphasis added).(cid:160) This requirement for a specification of the particular goods and/or
