`OFFICE ACTION
`
`(cid:160)T
`
`O AVOID ABANDONMENT, THE OFFICE MUST RECEIVE A PROPER RESPONSE TO THIS OFFICE ACTION WITHIN 6 MONTHS
`OF THE ISSUE/MAILING DATE.
`
`(cid:160)I
`
`SSUE/MAILING DATE: 1/13/2009
`
`(cid:160)T
`
`his responds to applicant’s communication dated December 12, 2008, wherein applicant amended its identification of goods. (cid:160) Although largely
`acceptable, certain wording in the amended identification for goods in Class 11 remains indefinite and requires further clarification.(cid:160) In addition,
`applicant must reconfirm its entity type and citizenship as indicated below:
`
`(cid:160)E
`
`NTITY AND CITIZENSHIP OF APPLICANT
`
`The application record indicates entry of a change of name of the applicant to Panasonic Electric Works Co., Ltd.(cid:160) This update deleted
`applicant’s entity type and citizenship from the application record. (cid:160) Applicant must confirm for the record whether it remains a corporation of
`Japan.
`
`(cid:160)A
`
`MENDED IDENTIFICATION OF GOODS – CLASS 11
`
`(cid:160)T
`
`he examiner previously advised that the wording “electronic facial skin beautifier using ultrasonic or steam for household and industrial
`purposes” is unacceptable because it is too broad and could encompass goods in other classes, e.g., “facial toning machines for cosmetic use,”
`
`in Class 10.(cid:160)(cid:160)
`
`In response, applicant has replaced the wording with the following list of products:
`
`“Electronic facial skin beautifier using ultrasonic or steam for household and industrial purposes, namely, beautifier for bare skin
`in the nature of steamers, ion steamers, and electric facial device using cold stimulation, beautifier for pore-cleaning and sebum
`cleaning, beautifier for tightening the face line and reducing pore size, and suction instrument for removing blackheads, goggle-
`
`(cid:160)
`(cid:160)
`

`
`type eye mask equipment for skincare around the eyes,” in Class 11.
`
`(cid:160)T
`
`his amended wording remains indefinite and must be clarified.(cid:160) See TMEP §1402.01.(cid:160) Moreover, the amended language is internally
`inconsistent to the extent not every particular good listed after “namely” is clearly in the nature of an ultrasonic or steam device, as dictated by
`
`the introductory clause.(cid:160)(cid:160)
`
`In this regard, the reference to a “beautifier for bare skin in the nature of steamers” is acceptable and perhaps redundant of electronic facial
`steamers referenced elsewhere in the identification.(cid:160) However, “ion steamer” requires further clarification, e.g., facial steamers incorporating
`
`negative ion generators.(cid:160)(cid:160)
`
`The remainder of the identification is generally indefinite and must be deleted or amended to identify specific goods within the scope of the
`original identification.(cid:160) It is unclear, for instance, if the listed facial devices, beautifiers, suction type instrument and goggle-type mask
`equipment are separate goods or features/functions of a single steam device.(cid:160) If the wording represents separate goods, the nature of the goods
`and the role of ultrasonic or steam in their operation is unclear.(cid:160) In this regard, the term “ultrasonic” itself is ambiguous in that it does not
`
`clearly imply a Class 11 nature in the same manner as “steam”. (cid:160)(cid:160)(cid:160)
`
`Applicant must clarify the goods further to enable their proper classification.(cid:160) For example, this portion of the identification may be amended in
`the following manner, if accurate:
`
`“Electronic facial skin beautifiers for household and industrial purposes in the nature of facial steamers, facial steamers
`incorporating ion generators, and facial saunas featuring cold stimulation for use in facial cleaning and conditioning,” in Class 11.
`
`(cid:160)T
`
`he remainder of the amended identification is acceptable.
`
`(cid:160)P
`
`lease note that, while the identification of goods may be amended to clarify or limit the goods, adding to the goods or broadening the scope of
`the goods is not permitted.(cid:160) 37 C.F.R. §2.71(a); TMEP §1402.06.(cid:160) Therefore, applicant may not amend the identification to include goods that are
`not within the scope of the goods set forth in the present identification.

`(cid:160)F

`or assistance with identifying goods and/or services in trademark applications, please see the online searchable Manual of Acceptable
`Identifications of Goods and Services at http://tess2.uspto.gov/netahtml/tidm.html.

`dvisory: Combined Application
`
`(cid:160)I
`
`f applicant prosecutes this application as a combined, or multiple-class application, then applicant must comply with each of the following for
`those goods/services based on an intent to use the mark in commerce under Trademark Act Section 1(b):
`

`2.
`

`Applicant must submit a filing fee for each international class of goods/services not(cid:160) covered by the fee already paid.(cid:160) 37 C.F.R.
`§2.86(a)(2); TMEP §§810.01 and 1403.01.
`
`(cid:160)T
`
`he filing fee for adding classes to an application is as follows:
`
`1.
`
`2.
`
`$325 per class, when the fees are submitted with a response filed online via the Trademark Electronic Application System (TEAS) at

`$375 per class, when the fees are submitted with a paper response.(cid:160)
`
