`This responds to applicant’s communication dated July 8, 2009, wherein applicant further amended its identification of goods. (cid:160) For the reasons
`set forth below, the requirement for an acceptable identification of goods is continued and made FINAL:

`he amended identification of goods in Class 11 continues to contain wording which is indefinite and must be clarified.(cid:160) See TMEP §1402.01.(cid:160)
`After several communications with the examiner, applicant was provided with proposed language deemed sufficiently definite to enable
`approval of the mark for publication.(cid:160) Although applicant has adopted this language in full, it also has introduced to the Class 11 identification
`
`without comment the amended language “electric pore cleaners for household and industrial purposes”. (cid:160)(cid:160)
`
`As with the prior amended identification, this wording must be considered unacceptable as indefinite because applicant provides no information
`regarding the operative nature of the goods.(cid:160) As previously discussed, ambiguous devices such as “beautifiers”, or the referenced “electric pore
`cleaners”, may be classified differently depending on their method of operation. (cid:160) For instance, devices operating primarily by heat or steam are
`
`placed in Class 11 while other types of facial toning machines for cosmetic use or medical treatment are placed in Class 10.(cid:160)(cid:160)
`
`Applicant has made several amendments to date in order to clarify the operational nature of its beauty care devices, including clarification
`resulting in the addition of Class 10 to the application.(cid:160) However, the continued inclusion of indefinite language arising from the original
`identification of “electric . . . facial apparatus” for household and industrial purposes suggests that remaining ambiguity concerns goods
`different from those already subject to applicant’s clarifying efforts. (cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)

`he Trademark Act requires that a trademark or service mark application must include a “ specification of … the goods [or services]” in

`§1053.(cid:160) Specifically, a complete application must include a “list of the particular goods or services on or in connection with which the
