`
`HIS IS A FINAL ACTION.
`
`This letter responds to applicant’s communication filed on November 13, 2007.
`
`(cid:160)T
`
`he refusal as to Reg. No. 2578892 is withdrawn.
`
`(cid:160)F
`
`or the reasons set forth below, the refusal under Trademark Act Section 2(d), 15 U.S.C. §1052(d), is now made FINAL with respect to U.S.
`Registration No. 2913333.(cid:160) 37 C.F.R. §2.64(a).
`
`(cid:160)T
`
`(cid:160)T
`
`he proposed mark is PAPERTOOFFICE for “software for automatically converting paper documents to electronic document file.”
`
`he registered mark is PDF2OFFICE for “computer software for converting PDF documents.”
`
`(cid:160)T
`
`he applicant argues that the marks are not similar because the terms “PDF” and “paper” are not the same the terms “to” and “2” are not the
`same.(cid:160) This argument is unpersuasive.(cid:160)(cid:160) The marks create a similar overall commercial impression with the language “2office” and “tooffice”
`which have the same sound.(cid:160)(cid:160) Similarity in sound alone may be sufficient to support a finding of likelihood of confusion.(cid:160) RE/MAX of America,
`Inc. v. Realty Mart, Inc., 207 USPQ 960, 964 (TTAB 1980); Molenaar, Inc. v. Happy Toys Inc., 188 USPQ 469 (TTAB 1975); In re Cresco Mfg.
`Co., 138 USPQ 401 (TTAB 1963); TMEP §1207.01(b)(iv).
`(cid:160)(cid:160) (The term “paper” is
`Overall, these marks share a similar word construction of a descriptive term (“paper” and “PDF”) + to/2 + OFFICE.
`descriptive because the software converts paper to electronic files and the term “PDD” is descriptive because the software converts PDF files to
`other formats.)(cid:160) Further, regarding the issue of likelihood of confusion, the question is not whether people will confuse the marks, but whether
`the marks will confuse people into believing that the goods they identify come from the same source.(cid:160) In re West Point-Pepperell, Inc., 468 F.2d
`200, 175 USPQ 558 (C.C.P.A. 1972).(cid:160) For that reason, the test of likelihood of confusion is not whether the marks can be distinguished when
`subjected to a side-by-side comparison.(cid:160) The question is whether the marks create the same overall impression.(cid:160) Recot, Inc. v. M.C. Becton, 214
`F.2d 1322, 54 USPQ2d 1894, 1890 (Fed. Cir. 2000); Visual Information Inst., Inc. v. Vicon Indus. Inc., 209 USPQ 179 (TTAB 1980).(cid:160) The focus
`is on the recollection of the average purchaser who normally retains a general rather than specific impression of trademarks.(cid:160) Chemetron Corp.
`v. Morris Coupling & Clamp Co., 203 USPQ 537 (TTAB 1979); Sealed Air Corp. v. Scott Paper Co., 190 USPQ 106 (TTAB 1975); TMEP
`§1207.01(b).(cid:160) Potential consumers are likely to believe that one entity provides a series of document conversion software that follows the word
`construction of ___toOFFICE or ___2OFFICE, with the “blank” being filled in by the term describing the subset of document conversion
`functions (i.e., paper, PDF, etc.).(cid:160)(cid:160) Also, the registered mark is strong as there are no other “2office” or “to OFFICE” marks for document
`
`conversion software.(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`The applicant gave several examples of registrations and pending applications for other marks with the term “paper” or “office” and/or
`“paper” or “office” with the term “to” or “2.”
`(cid:160) The mere submission of a list of registrations does not make these registrations part of the
`record.(cid:160) In re Delbar Products, Inc., 217 USPQ 859 (TTAB 1981); In re Duofold Inc., 184 USPQ 638 (TTAB 1974).(cid:160) To make registrations
`proper evidence of record, soft copies of the registrations or the complete electronic equivalent (i.e., printouts of the registrations taken from the
`electronic search records of the United States Patent and Trademark Office) must be submitted.(cid:160) TMEP §710.03.(cid:160) See In Re JT Tobacconists, 59
`USPQ2d 1080, 1081 n. 2 (TTAB 2001); In re Styleclick.com Inc., 57 USPQ2d 1445, 1446 n. 2 (TTAB 2000); Raccioppi v. Apogee Inc., 47
`USPQ2d 1368, 1370 (TTAB 1998); In re Volvo Cars of North America Inc., 46 USPQ2d 1455 (TTAB 1998); In re Broadway Chicken Inc., 38
`USPQ2d 1559, 1560 n.6 (TTAB 1996); Weyerhaeuser Co. v. Katz, 24 USPQ2d 1230, 1231-32 (TTAB 1992).(cid:160) Further, prior decisions and
`actions of other trademark examining attorneys in registering different marks are without evidentiary value and are not binding upon the Office.(cid:160)
`Each case is decided on its own facts, and each mark stands on its own merits.(cid:160) AMF Inc. v. American Leisure Products, Inc., 177 USPQ 268,
`269 (C.C.P.A. 1973); In re International Taste, Inc., 53 USPQ2d 1604 (TTAB 2000); In re Sunmarks Inc., 32 USPQ2d 1470 (TTAB 1994); In
`re National Novice Hockey League, Inc., 222 USPQ 638, 641 (TTAB 1984); In re Consolidated Foods Corp., 200 USPQ 477 (TTAB 1978).(cid:160)
`Also, none of the registrations listed by the applicant show a similar word construction of ___2OFFICE or its phonetic equivalent
`____toOFFICE for document conversion software (i.e., RN 2821935 is for PAPER TO PAPER and design for paper recycling services, RN
`
`2221092 is for THE PAPERLESS OFFICE for software for document management, etc.).(cid:160)(cid:160)(cid:160)
`
`The goods of the parties is closely related as well as both provide data or document conversion software.(cid:160) As shown in the previous action, many
`entities provide goods or services for the physical conversion of paper documents to electronic files and for the conversion of data or documents
`from one electronic format to another.(cid:160) Attached to the first action are copies of printouts from the USPTO X-Search database, which show
`third-party registrations of marks used in connection with the same or similar goods and services as those of applicant and registrant in this case.(cid:160)
`These printouts have probative value to the extent that they serve to suggest that the goods and/or services listed therein, namely, software for
`the physical conversion of paper documents to electronic files and for the conversion of data or documents from one electronic format to
`
`(cid:160)
`

`
`another.(cid:160) In re Infinity Broadcasting Corp. of Dallas, 60 USPQ2d 1214, 1218 (TTAB 2001), citing In re Albert Trostel & Sons Co., 29 USPQ2d
`1783, 1785-86 (TTAB 1993); and In re Mucky Duck Mustard Co., Inc., 6 USPQ2d 1467, 1470 at n.6 (TTAB 1988).
`In fact, many software programs that convert paper to electronic files (the applicant’s goods) also convert PDF files.(cid:160) (See attachments from the
`Internet showing software that converts paper to electronic files and also converts PDF files.)(cid:160)(cid:160)
`
`Finally, any doubt regarding a likelihood of confusion is resolved in favor of the prior registrant.(cid:160) Hewlett-Packard Co. v. Packard Press Inc.,
`281 F.3d 1261, 62 USPQ2d 1001, 1004 (Fed. Cir. 2002); In re Hyper Shoppes (Ohio), Inc., 837 F.2d 463, 6 USPQ2d 1025 (Fed. Cir. 1988);

`NO. E documents can be created in a
`variety of ways. PD-Fs that are generated from
`an electronic source — such as a Word
`document, a computer generated report, or
`spreadsheet data — have an internal structure
`that can be read and interpreted. These

`Abuutlnvuntintnnh E can rely on these electonic charcter
`designations and provide reliable output.
`‘d_oc_gments can also be created through the process of
`_
`"nflig a document into electronic format. What a scanned
`document represents is really just a “picture” of the words
`contained within that document. In order to convert a scanned
`document into an editable format, OCR
`is required to
`analyze the “image” of each character and match it to an electronic
`character-based file. Because of this, it is a much more difficult to
`ensure that the character that is “recognized” by the OCR
`is the character on the scanned document. The quality of
`OCR output is affected by matters such as poor image quality of
`the scanned document, mixture of fonts used in the scanned
`documents, and italicized and underlined fonts, which may blur the
`quality and shape of individual characters.

`
`As noted above, there is more than one way to create a -
`document. One of these methods is by using a scanner, or similar
`machine, that takes an image of a document and then stores this
`i_m
`as an electronic : File. A scanner, or photocopier with
`
`_
`_,
`.
`abilities, does not recreate each character of every word
`
`when I creates this scanned image — rather,
`it simply takes a
`“snap—shot” of the image. This snap—shot is then turned into a

`photocopier — the result is a “scanned” _ document.The
`alternative to a scanned E document is a created _

`
`What is OCR [Optical Character Recognition}?
`
`Optical Character Recognition (OCR) is a visual recognition
`process that turns printed or written text into an electronic
`character—based file. A document that is scanned and co_nve_rted_
`
`into a i document provides the basis for which OCR

`electonic character—based file that can then be entered into an
`editable format, such as a Text or Word document.
`Given the proliferation of scan-to—“ technology available today, Investintech’s OCR solutions
`foeus only on the c'onUi:I"_sion of already ereated seanned E doeurnents. The quality of the
`OCR conversion process will largely depend on the quality of the scanned image and the
`clarity of the characters of that image.
