`
`he assigned trademark examining attorney has reviewed the referenced application and has determined the following:
`
`Trademark Act Section 2(d) Refusal
`
`(cid:160)R
`
`egistration of the proposed mark is refused because of a likelihood of confusion with the mark in U.S. Registration No. 2767658.(cid:160) Trademark
`Act Section 2(d), 15 U.S.C. §1052(d); TMEP §§1207.01 et seq. (cid:160) See the enclosed registration.
`
`(cid:160)(cid:160)
`(cid:160)
`

`
`Applicant’s mark is “HOMEBASE WIRELESS HD” for “wireless router for transmitting data from electronics devices to a television receiver
`or monitor.” (cid:160) Registrant’s mark is “HOMEBASE” for “Integrated circuits, semiconductor chips and semiconductor chip sets for use in xDSL
`modems and gateways and specification and data sheets, data books and reference materials provided therewith.” (cid:160) The marks are similar in
`commercial impression, and the goods are related.(cid:160) Therefore, a likelihood of confusion determination is warranted.
`
`(cid:160)A
`
` likelihood of confusion determination involves a two-part analysis.(cid:160) First, the marks are compared for similarities in appearance, sound,
`connotation and commercial impression.(cid:160) In re E .I. du Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973).(cid:160) Second, the
`goods or services are compared to determine whether they are similar or related or whether the activities surrounding their marketing are such
`that confusion as to origin is likely.(cid:160) In re National Novice Hockey League, Inc., 222 USPQ 638 (TTAB 1984); In re August Storck KG, 218
`USPQ 823 (TTAB 1983); In re Int’l Tel. and Tel. Corp. , 197 USPQ 910 (TTAB 1978); Guardian Prods. Co., v. Scott Paper Co., 200 USPQ 738
`(TTAB 1978); TMEP §§1207.01 et seq.
`
`(cid:160)T
`
`he marks are similar in commercial impression because the dominant portion of each mark is identical, namely, “HOMEBASE.” (cid:160) The marks
`are compared in their entireties under a Section 2(d) analysis.(cid:160) Nevertheless, one feature of a mark may be recognized as more significant in
`creating a commercial impression.(cid:160) Greater weight is given to that dominant feature in determining whether there is a likelihood of confusion.(cid:160)
`In re National Data Corp., 753 F.2d 1056, 224 USPQ 749 (Fed. Cir. 1985); Tektronix, Inc. v. Daktronics, Inc., 534 F.2d 915, 189 USPQ 693
`(C.C.P.A. 1976). In re J.M. Originals Inc., 6 USPQ2d 1393 (TTAB 1987); TMEP §1207.01(b)(viii).
`
`(cid:160)T
`
`he fact that applicant’s mark contains the additional wording “WIRELESS HD” is not sufficient to render the marks dissimilar because this
`wording is highly descriptive and has no inherent source-identifying significance when used in connection with applicant’s goods because it
`describes the fact that the router is wireless and that the data being routed is displayed in high definition, i.e. at an increase in display or visual
`resolution.(cid:160) See attached dictionary evidence for “HD,” available at http://encyclopedia.thefreedictionary.com/High+Definition. (cid:160) Therefore, due
`to the highly descriptive nature of the wording “WIRELESS HD,” the dominant portion of applicant’s mark is “HOMEBASE,” which portion
`is identical to registrant’s mark. (cid:160) Therefore, the marks are similar in commercial impression.
`
`(cid:160)T
`
`he goods are related because registrant’s “integrated circuits, semiconductor chips and semiconductor chip sets for use in xDSL modems and
`gateways” are manufactured by the same entities that manufacture wireless routers. (cid:160) In fact, the attached evidence from registrant’s website
`shows that registrant actually manufactures wireless routers as part of its Home Media Gateway solution.(cid:160) See attached evidence from
`registrant’s website. (cid:160) In addition, the attached third-party Internet evidence from Broadcom shows that Broadcom manufactures and sells the
`Optimized 802.11g Router in addition to manufacturing and selling Broadcom AirForce wireless integrated circuits.(cid:160) See attached evidence from
`Broadcom’s website. (cid:160) Neither registrant nor Broadcom indicate that the goods are limited in any way for either product.(cid:160) Thus, the attached
`evidence shows wireless routers being sold in the same channels of trade to the same class of consumers as integrated circuits.(cid:160) Therefore,
`registrant’s goods and applicant’s goods are related.
`
`(cid:160)T
`
`he goods of the parties need not be identical or directly competitive to find a likelihood of confusion.(cid:160) Instead, they need only be related in
`some manner, or the conditions surrounding their marketing are such that they would be encountered by the same purchasers under
`circumstances that would give rise to the mistaken belief that the goods come from a common source.(cid:160) On-line Careline Inc. v. America Online
`Inc., 229 F.3d 1080, 56 USPQ2d 1471 (Fed. Cir. 2000); In re Martin’s Famous Pastry Shoppe , Inc., 748 F.2d 1565, 223 USPQ 1289 (Fed. Cir.
`1984); In re Melville Corp., 18 USPQ2d 1386, 1388 (TTAB 1991); In re Corning Glass Works, 229 USPQ 65 (TTAB 1985); In re Rexel Inc.,
`223 USPQ 830 (TTAB 1984); Guardian Prods. Co., Inc. v. Scott Paper Co., 200 USPQ 738 (TTAB 1978); In re Int’l Tel. & Tel. Corp ., 197
`USPQ 910 (TTAB 1978); TMEP §1207.01(a)(i).
`
`(cid:160)A
`
`ny doubt regarding a likelihood of confusion is resolved in favor of the prior registrant.(cid:160) Hewlett-Packard Co. v. Packard Press Inc., 281 F.3d
`1261, 62 USPQ2d 1001, 1004 (Fed. Cir. 2002); In re Hyper Shoppes (Ohio), Inc., 837 F.2d 463, 6 USPQ2d 1025 (Fed. Cir. 1988); TMEP
`§§1207.01(d)(i).
`
`(cid:160)A
`
`lthough the trademark examining attorney has refused registration, applicant may respond to the refusal to register by submitting evidence and
`arguments in support of registration.
`
`Potentially Conflicting Prior Pending Application Notice
`
`The examining attorney also encloses information regarding pending Application Serial No. 77348919.(cid:160) The effective filing date of the
`referenced application precedes the applicant’s filing date. There may be a likelihood of confusion between the applicant’s mark and the
`referenced mark under Trademark Act Section 2(d), 15 U.S.C. §1052(d).(cid:160) If the referenced application matures into a registration, the examining
`attorney may refuse registration in this case under Section 2(d).(cid:160) 37 C.F.R. §2.83; TMEP §§1208.01 and 1208.01(b).
`
`(cid:160)U
`
`pon receipt of applicant’s response resolving the following requirement, action on this application will be suspended pending the disposition
`of Application Serial No. 77348919.(cid:160) 37 C.F.R. §2.83(c); TMEP §§716.02(c) and 1208.02(c).

`(cid:160)
`(cid:160)(cid:160)
`

`
`Disclaimer Required
`
`(cid:160)A
`
`pplicant must disclaim the descriptive wording “WIRELESS HD” apart from the mark as shown because it merely describes a feature or
`characteristic of applicant’s wireless routers. (cid:160) Trademark Act Section 6, 15 U.S.C. §1056; TMEP §§1213 and 1213.03(a).
`
`(cid:160)A
`
`pplicant is currently seeking the exclusive right to use the words “WIRELESS HD” for “wireless router for transmitting data from electronics
`devices to a television receiver or monitor.” (cid:160) The word “WIRELESS” clearly describes “ wireless routers,” and the acronym “HD,” which
`means “high definition,” describes the fact that the data being transmitted will be displayed on the television receiver or monitor at an increase
`in display or visual resolution.” (cid:160) See attached dictionary evidence for “HD,” available at
`http://encyclopedia.thefreedictionary.com/High+Definition.(cid:160) Since each of these words is highly descriptive of a feature or characteristic of the
`
`goods, they must be disclaimed apart from the mark.(cid:160)(cid:160)
`
`The Office can require an applicant to disclaim exclusive rights to an unregistrable part of a mark, rather than refuse registration of the entire
`mark.(cid:160) Trademark Act Section 6(a), 15 U.S.C. §1056(a).(cid:160) Under Trademark Act Section 2(e), 15 U.S.C. §1052(e), the Office can refuse
`registration of the entire mark where it is determined that the entire mark is merely descriptive, deceptively misdescriptive, or primarily
`geographically descriptive of the goods.(cid:160) Thus, the Office may require the disclaimer of a portion of a mark which, when used in connection with
`the goods or services, is merely descriptive, deceptively misdescriptive, primarily geographically descriptive, or otherwise unregistrable (e.g.,
`generic).(cid:160) TMEP §1213.03(a).(cid:160) If an applicant does not comply with a disclaimer requirement, the Office may refuse registration of the entire
`mark.(cid:160) TMEP §1213.01(b).
`
`(cid:160)A
`
` “disclaimer” is thus a written statement that an applicant adds to the application record that states that applicant does not have exclusive
`rights, separate and apart from the entire mark, to particular wording and/or to a design aspect.(cid:160) The appearance of the applied-for mark does not
`change.
`
`(cid:160)A
`
` disclaimer does not physically remove the disclaimed matter from the mark, but rather is a written statement that applicant does not claim
`exclusive rights to the disclaimed wording and/or design separate and apart from the mark as shown in the drawing.
`
`(cid:160)T
`
`he following cases explain the disclaimer requirement more fully:(cid:160) Dena Corp. v. Belvedere Int’l Inc ., 950 F.2d 1555, 21 USPQ2d 1047 (Fed.
`Cir. 1991); In re Kraft, Inc., 218 USPQ 571 (TTAB 1983); In re EBS Data Processing, Inc., 212 USPQ 964 (TTAB 1981); In re National Presto
`Industries, Inc., 197 USPQ 188 (TTAB 1977).
`
`(cid:160)T
`
`he computerized printing format for the Office’s Trademark Official Gazette requires a standardized format for a disclaimer.(cid:160) TMEP
`§1213.08(a)(i).(cid:160) The following is the standard format used by the Office:
`
`No claim is made to the exclusive right to use “WIRELESS HD” apart from the mark as shown.

`LSI introduces iSCS| interface Technology
`Across Engenio Family of Systems
`Engenio storage systems now otter unmatched breadth of hosbinterfaoe selection including i5C5|, SAS,
`Fibre Channel and lnl'iniBand
`
`MILPITAS, Calif., October 9, 200? — LS1 Corporation (NYSE: LSl) today announced iSCSl connectivity support across
`its complete line of Engenio“ external storage systems. LSl is introducing its Sirnplicity“‘ iSCSl-based 1532 storage
`system for SMB (srnaillo-midsized business) customers in need of simple and low-cost networked storage. in addition.
`l_Sl has certified select SANtricityT“ Fibre Cl'ianrieH:iased storage systems with the Qi_og:ii: SANboi( 614-0 intelligent
`Storage , providing enterpnse customers with rnulti-protocol connectivity between serves and SAN'l.ncity storage
`systems. Today's announcement further expands the industry-leading selection oi interface options olfered by l_Sl.
`iiiihich now includes iSCSl. SAS. Fibre Channel and lnfinifiand.
`
`"IF netiiiiori-is are ubiqauitous in the industry, and more and more customers are looking to leverage this familiar
`technology for a low-cost storage network that increases elficiencies while oflering easy integration; iSCSl makes this
`possible." said Steve Gardner. director of product marketing, Engenio Storage Group, LSl Corporation. "LSI is delivering
`1808! support across our Engenio family of storage systems in order to provide both SMB and enterprise customers
`with an easily-rnanaged lP storage network that brings the consolidation benefits of a shared environment. This is the
`latest step in our continued eltort to olfer the industry’s most extensive selection ofliost interfaces to meet any
`orgrariizaticin's storage ietiuirerrierits regardless oi connectnrity perforrriarice. availability or funiztioriality reqi.iireri'ients."
`
`The 1532, with iSCSl host interface technology. is the rieiiiiiest addition to the LSl lamily ovl'Simplicity systems. viiiliich
`already oiler SAS and Fibre Channel interface options with the 1333 and 1932. respectively. The 1532 sting system
`is designed as an easy-touse lP SAN (storage area network over an IP network) solution liar SMB customers looking
`for an alternative to a Fibre Channel SAN as they transition from a DAS (Direct Attached Storage) eriirirorirrierit. The
`1532 enables IT organizations to leverage their IP expertise wiiile cc-stelfectively gaining the advantages of consolidated
`storage The 1532 storage system is ideal for applications including relational databases. Exchange. SQL Server. CHM.
`ERP. web. e-commerce or supporting senrer consolidation with products like \i'Mwa.re.
`
`Designed iiiiith four 1Gt:»'s iSCSl hosts per dual controller system, the 1532 supports ‘start small, grow big‘ scalability
`allowing users to only invest in the amount ofstorage currently needed and dynamically scale capacity when their
`storage demands call for it. Entry-level systems begin with a 2U 12-drive configuration, which can scale up to 48 300GB
`SAS and SATA drives, oifeiing up to 36.ilTB of storage The 1532 system is managed by Sirnplicity Storage Manager
`soltvu-are providing customers an intuitive, task-based rrianageriierit structure that significantly reduces the complexity of
`installation, configuration, rnanagernent and diagnostic tasks. Simplicity delivers prrerniurri features to support data
`utilization and protection strategies, including storage partitioriing, snapshot and volume copy.
`
`Bringing together the advantages ol‘Fibre Channel storage and the pervasivieness oflP networks, LSI has also
`completed certilication olits SANtiicity-managed Fibre Channel arrays with the OLogic SAi\lbo)i 6140 Intelligent
`Soragae Router. By testing and certifying this router, select SANtricity storage systems can be bridged across an lP
`network, enabling enterprise customers to have rnulti-protocol connectivity between servers and the SANln'city storage
`systems. it is also an ideal solution for enabling a virtualized serveriostorage interface that allows the deployment of
`hundreds of virtual or physical servers to a SANtricity system, which provides the additional benefit ofconsolidated
`storage
`
`‘The ceitilicaiion of the LS1 Engenio storage systems with the Ql_ogic iSCSi intelligent Storage Routers enables users
`to combine the availability and consolidation advantages olthe SANtncity-‘based Fibre Channel systems across iP
`nelworl-ts for data transfers," said Siiishir Shah. general manager. Slo-rag-e'Solutioris Group, (logic Corporation. "The
`result is a costelfective method to connect all ofan organizations servers to a SAN regardless otloca.tion."
`
`"l_Sl is pleased to be working with our longtime partner, ClLogic to bring iSCSl connectivity to our SANiiicity systerris,"
`said Gardner
