`he Trademark Act requires that a trademark or service mark application must include a “ specification of … the goods [or services]” in

`§1053.(cid:160) Specifically, a complete application must include a “list of the particular goods or services on or in connection with which the
`applicant uses or intends to use the mark.” (cid:160) 37 C.F.R. §2.32(a)(6) (emphasis added).(cid:160) This requirement for a specification of the particular goods

`The wording “maintenance of customer images for their computers and providing re-imaging as may be required incident to the repair of
`computers” remains indefinite and must be clarified by using a common commercial description for the services, as explained in the initial
`Office action.(cid:160) Applicant added classes 39 and 41 and included the services “storage services for archiving images” and “digital imaging
`services,” respectively. (cid:160) However, if applicant intended to replace the original wording with these new services, then applicant should delete
`the original wording from Class 36 since it is indefinite and appears to be misclassified and include the original language before the new
`services, e.g. “maintenance of customer images for their computers, namely, storage services for archiving images” and “digital imaging
`
`services in the nature of providing re-imaging of customer images as may be required incident to the repair of a customer’s computer”. (cid:160)(cid:160)(cid:160)(cid:160)
`
`Further, the following services appear to be Class 42 services: “deployment, support and management services relating to deployment of
`computers, namely, creating and applying customer-specific asset tags which allow customers to print specific information on the tag, such as
`company name and/or a specific numbering system, and customer-specific deployment reports for computers to show an itemized listing of the
`equipment each customer receives; providing on-line service analysis to customers based on a shared database as to customer requested repairs
`of computers, namely, providing customers with a service history for all of the customer's repaired laptop computers in both a summary form
`and a form with detailed information; providing asset management reports to customers as to deployed computers, namely, providing a report
`which records the deployment of the computer and updates the report as the status of the computer changes (example, it is damages and retired
`from service) through an on-line tool used by the customer which generates the report and providing replacement of problematic computers to
`promptly resolve user problems”. (cid:160) Applicant must properly classify all services.
