`
`(cid:160)(cid:160)(cid:160)
`
`SSUE/MAILING DATE: 7/23/2008
`
`The referenced application has been reviewed by the assigned trademark examining attorney.(cid:160) Applicant must respond timely and completely to
`the issue below.(cid:160) 15 U.S.C. §1062(b); 37 C.F.R. §§2.62, 2.65(a); TMEP §§711, 718.03.
`
`(cid:160)S
`
`ection 2(d) Refusal – Likelihood of Confusion
`
`(cid:160)R
`
`egistration of the applied-for mark is refused because of a likelihood of confusion with the mark in U.S. Registration No. 2520512.(cid:160) Trademark
`Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq.(cid:160) See the enclosed registration.
`
`(cid:160)T
`
`(cid:160)T
`
`he applicant has applied to register OPTEON in standard character form for:
`
`Computer software to monitor and control factory manufacturing process for electronic products, in Class 9.
`
`he registered mark is OPTEON in typed drawing form for:
`
`Image acquisition system; namely, electrical, computer and camera cable; photographic, video, and solid state cameras; computer add-on
`circuit board; computer hardware and computer software used for inspecting, monitoring, acquiring, storing, analyzing, and processing
`images, in Class 9.
`
`(cid:160)S
`
`ection 2(d) of the Trademark Act bars registration where a mark so resembles a registered mark, that it is likely, when applied to the
`
`(cid:160)
`(cid:160)
`

`
`goods/services, to cause confusion, or to cause mistake or to deceive. TMEP §1207.01.(cid:160) The Court in(cid:160) In re E. I. DuPont de Nemours & Co., 476
`F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973), listed the principal factors to consider in determining whether there is a likelihood of confusion.(cid:160)
`Among these factors are the similarity of the marks as to appearance, sound, meaning and commercial impression and the similarity of the
`goods/services.(cid:160) The overriding concern is to prevent buyer confusion as to the source of the goods/services.(cid:160) Miss Universe, Inc. v. Miss Teen
`U.S.A., Inc., 209(cid:160)USPQ 698 (N.D. Ga. 1980). (cid:160) Therefore, any doubt as to the existence of a likelihood of confusion must be resolved in favor of
`
`the registrant.(cid:160) Lone Star Mfg. Co. v. Bill Beasley, Inc., 498 F.2d 906, 182 USPQ 368 (C.C.P.A. 1974).(cid:160)(cid:160)
`Comparison of the Marks
`
`(cid:160)I
`
`n a likelihood of confusion determination, the marks are compared for similarities in their appearance, sound, meaning or connotation and
`commercial impression.(cid:160) In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973); TMEP §1207.01(b).(cid:160)
`Similarity in any one of these elements may be sufficient to find a likelihood of confusion.(cid:160) In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB
`1988); In re Lamson Oil Co., 6 USPQ2d 1041, 1043 (TTAB 1987); see TMEP §1207.01(b).
`
`(cid:160)I
`
`n the present case, applicant’s mark OPTEON is identical to the registered mark OPTEON in sound, appearance, and connotation. (cid:160) Overall, the
`marks have the same commercial impression.
`
`(cid:160)C
`
`omparison of the Goods
`
`(cid:160)I
`
`f the marks of the respective parties are identical, the relationship between the goods and/or services of the respective parties need not be as
`close to support a finding of likelihood of confusion as might apply where differences exist between the marks.(cid:160) In re Opus One Inc., 60 USPQ2d
`1812, 1815 (TTAB 2001); Amcor, Inc. v. Amcor Indus., Inc., 210 USPQ 70, 78 (TTAB 1981); TMEP §1207.01(a).
`
`(cid:160)I
`
`n this case, applicant’s “computer software to monitor and control factory manufacturing process for electronic products,” in Class 9, are
`related to the registrant’s “image acquisition system; namely, electrical, computer and camera cable; photographic, video, and solid state
`cameras; computer add-on circuit board; computer hardware and computer software used for inspecting, monitoring, acquiring, storing,
`
`analyzing, and processing images,” in Class 9, because both parties’ goods include computer software. (cid:160)(cid:160)
`
`Likelihood of confusion is determined on the basis of the goods and/or services as they are identified in the application and registration.(cid:160)
`Hewlett-Packard Co. v. Packard Press Inc., 281 F.3d 1261, 1267-68, 62 USPQ2d 1001, 1004-05 (Fed. Cir. 2002); In re Shell Oil Co., 992 F.2d
`1204, 1207 n.4, 26 USPQ2d 1687, 1690 n.4 (Fed. Cir. 1993); TMEP §1207.01(a)(iii).
`
`(cid:160)W
`
`hen the application describes the goods and/or services broadly and there are no limitations as to their nature, type, channels of trade or classes
`of purchasers, then it is presumed that the application encompasses all goods and/or services of the type described, that they move in all normal
`channels of trade, and that they are available to all potential customers.(cid:160) See In re Melville Corp., 18 USPQ2d 1386, 1388 (TTAB 1991) (“With
`reference to the channels of trade, applicant’s argument that its goods are sold only in its own retail stores is not persuasive . . . . There is no
`restriction [in its identification of goods] as to the channels of trade in which the goods are sold.”); TMEP §1207.01(a)(iii). (cid:160) Because neither
`party’s identification of goods includes a limitation on the channels of trade or classes of purchasers, the goods would be sold to the same class
`of purchasers and encountered under circumstances leading one to mistakenly believe the goods originate from the same source.
`
`(cid:160)S
`
`ince the marks are identical and the goods are related, there is a likelihood of confusion as to the source of applicant’s goods. (cid:160) Therefore,
`applicant’s mark is not entitled to registration.
`
`(cid:160)A
`
`lthough applicant’s mark has been refused registration, applicant may respond to the refusal by submitting evidence and arguments in support
`of registration.
